The new judge assigned to the Casey Anthony case has ordered a management hearing for April 30 at 9:30am, according to a document released Thursday.

Chief Judge Belvin Perry has taken over after Judge Stan Strickland recused himself from the case Monday. Council for the state and the defense will discuss pretrial and trial dates, motion deadlines, scheduling and completion of depositions, along with other topics.

Chief Judge Belvin Perry also sent out an administrative order on courtroom behavior and decorum. The order specifies how anyone in the court must act while Judge Perry is presiding

In a written order, Perry said both judges and lawyers have "a professional obligation to conclude litigation as soon as possible."

He also said it's his responsibility to monitor and control the pace of the process.

Perry said the prosecution and defense should be prepared to discuss discovery deadlines, including the deposition of all witnesses as well as deadlines for future motions, and pre-trial and trial dates.

That hearing will begin at 9:30 a.m. at the Orange County Courthouse.

UPDATED: New Anthony Judge Calls For Hearing
Belvin Perry Takes Case Over From Stan Strickland

POSTED: Thursday, April 22, 2010
UPDATED: 6:30 pm EDT April 22, 2010
<snipped>
Judge Belvin Perry has called for a case management hearing on April 30. Perry took over the case from Judge Stan Strickland after the defense filed a motion asking that Strickland be disqualified over a friendship with a blogger. Strickland recused himself earlier this week.

The hearing will be an opportunity for Perry to call all the attorneys together to make sure he has all the information he needs to get up to speed on the case.

Meanwhile, a new batch of public records related to the case is expected to be released on Friday by the state attorney's office.

The release is expected to include police evidence logs, which may have already been released in a digital format.

Friday's release is also expected to contain witness interviews, but the state attorney's office has not specified who the interviews are with.

UPDATED: Perry Sets No-Nonsense Agenda In Anthony Trial
Attorney: Up To Jury To Recommend Death Penalty

POSTED: 6:09 pm EDT April 22, 2010
UPDATED: 8:19 pm EDT April 22, 2010

Perry scheduled a case management hearing for a week from Friday. He also reminded attorneys that it's their responsibility to keep the case moving as quickly as possible.

In his order, Perry said attorneys are expected to follow the rules of courtroom decorum at all times. His appointment has renewed talk about whether he would be more likely to sentence Anthony to death if she's convicted.

Under Florida law, it's up to the jury to make the life or death recommendation. "The jury can say what they want to, but isn't it the judge who has the final decision?" asked Orlando resident Tim McClosky.

"It's all up to the jury in the sense that only the jury can recommend death," said former prosecutor Tom Luka.

If Anthony is found guilty in what's called the "penalty phase," Luka, who is now a defense attorney, said it would be the jury's job to weigh the amount of aggravating evidence in the crime versus what mitigating factors Anthony's defense presents. "Normally the biggest mitigation is the remorse factor," Luka said. He said, ultimately, it's still up to the judge to make the decision between life and death.

Several attorneys said judges in only the rarest of circumstances overturn a jury recommendation for life, so that life-or-death question really is in their hands. Also, a death recommendation only requires seven of 12 jurors to vote for it, attorneys said.

Casey Anthony: Is new judge’s order ‘the clampdown’?

Chief Judge Belvin Perry’s order for a case-management hearing was studied for what it means. The hearing will be April 30. Perry this week took over the case from Judge Stan Strickland, who stepped down.

“I’m going to call it [the order] the clampdown,” Orlando defense attorney Diana Tennis told WOFL-Channel 35.

WOFL’s Holly Bristow said Perry’s order means “there is going to be no drama in my courtroom, come prepared because we’re going to be getting down to business and moving this case along.”

Tennis said the order was directed at the state and the defense. “They won’t be able to squabble as they have in the past,” she said.

Tennis said it was a special order for a special case and sent the message that Perry “is going to put this thing on a tight leash.”

WOMEN IN CRIME INK: When Anonymous is Not So Anonymous
April 22, 2010
by Donna Pendergast
<snipped>
Cuyahoga County Common Pleas Judge Shirley Strickland Saffold has found herself in the eye of a storm. Currently presiding over the high-profile case of serial murderer Anthony Sowell, Saffold became the subject of a very public controversy after anonymous comments to the Cleveland Plain Dealer's website were traced to her personal AOL email account. Several of these comments involved the Sowell case. One post allegedly disparaged Rufus Sims, the attorney defending Sowell, who is accused of murdering 11 women and hiding their bodies around his Cleveland home.

Whether or not anything improper occurred, there's an appearance of impropriety. The harm is done, whether Saffold is responsible for the comments or not. Since all death penalty cases are automatically appealed, the potential for reversal is too dire of a consequence to risk.

Judge Strickland-Saffold would be well advised to follow the example that an unrelated Judge Strickland set earlier this week.

As Judge Strickland noted in an order granting disqualification that speaks volumes about his integrity and class: "The Court takes heed of the defendant's present uneasiness. It is axiomatic that no judge owns a case. No defendant's rights should ever be subordinated to judicial ego ... The Court is now being accused of being biased in favor of the prosecution. While dozens of motions have been filed, many more wait in the wings. If the past is prologue, some defense motions may be denied. Since the undersigned has now been accused of bias and wrongdoing potentially each denial of a defense motion will generate renewed allegations of bias. The cumulative effect will be to elevate an otherwise meaningless situation into a genuine appellate issue."

So Judge Strickland-Saffold fights to stay while Judge Stan Strickland decides to go. "Indeed, the irony is rich."

Kudos Judge Stan Strickland --- you get it. Fair or not, you see the big picture and understand that it's not all about you. You have my utmost admiration for being a class act.

Casey Anthony latest news: Judge Perry could rule for death penalty despite jurors vote
April 22, 3:27 PM
<snipped>
Since Casey Anthony faces the death penalty, she will undergo two phases during her trial: the guilty phase and the penalty phase. Judge Perry’s personal views regarding the death penalty may determine the final outcome as to whether Casey Anthony faces life in prison or is sent to Florida’s death chamber.

Under Florida Statute 921.141 death penalty procedures must be conducted during a second phase of the trial referred to as the Penalty Phase. This takes place after the first phase or where the jury decides whether the defendant is guilty or innocent. If Casey Anthony is found guilty, the same jury will be called in and will sit under the same judge who presided over the trial: Judge Belvin Perry. The jury will then vote on sentencing.

Under Florida law, the judge has the authority to override the vote of the jury and set his own sentencing. If the jury found Casey Anthony guilty but voted for life in prison, Judge Belvin Perry could override the vote and sentence Casey Anthony to death.

There are currently three men on death row who were sentenced under Judge Belvin Perry.

UPDATED: FBI lab notes among latest batch of Casey Anthony evidence
7:26 p.m. EDT, April 23, 2010
<snipped>
According to a report, FBI analysts looked for human hairs that had signs of decomposition in evidence they collected, including from a steam cleaner and vacuum. The report said none was found. The FBI also analyzed hair samples belonging to Orange County Sheriff's Office crime-scene investigators. That evaluation was done to determine who a strand of hair — found with evidence — came from.

Evidence logs from the Sheriff's Office again detailed items taken from the woods where Caylee's remains were ultimately found, including dirt, soda cans, bugs and electrical tape.

Also released Friday was a transcribed interview with Cecilia Benhaida, sister of the woman who sparked a close relationship with Casey Anthony's father George Anthony.

The next hearing in the Casey Anthony case is scheduled for Friday.

UPDATED: Casey Evidence Tops 14,000 Pages
Friday, April 23, 2010 1:26:16 PM

The public has already seen transcripts of interviews, FBI reports, pictures and cell phone logs, but when Casey is tried for the murder of her 2-year-old daughter, Caylee, it’s unlikely every bit of evidence in the small mountain of pages will be brought up during the trial.

Friday’s batch of documents include FBI testing results, case notes, command logs and evidence logs.

The logged evidence includes items taken from the Anthony family’s Orlando home, a black trash bag found near the site where Caylee’s remains were found, comparisons of duct tape and hair samples taken at the crime scene.

The documents also included a transcript of an interview with Cecela Benaida, who told investigators her sister, Krystal Holloway, also known as River Cruz, had an affair with Casey’s father, George Anthony.

NOON UPDATE: The documents say hair samples were taken from a vacuum in the Anthony’s home. The vacuum was believed to have been used to clean Casey’s car. The documents say none of the hairs taken from the vacuum show signs of decomposition.

The documents also say that George Anthony’s alleged mistress’ twin sister befriended Casey in jail, and helped clean Casey’s jail cell.

3 p.m. UPDATE: An acquaintance of George Anthony told investigators that she was told the little girl's death was an accident. Cecelia Benhaida said during a police interview that George Anthony told her sister the death of his granddaughter, Caylee, was an accident. She said she didn't know any other details. The interview with Benhaida was released Friday by the State Attorney's Office in Orlando. Benhaida says her sister, Krystal Holloway, had a close friendship with George Anthony.

George Anthony's attorney didn't immediately return a phone call seeking comment.

FOX 35 Reporter Holly Bristow will have a full report during FOX 35 News at 5PM and 6PM.

FBI Seeks To Identify Source Of Hair Found At Crime Scene

A statement is contained in the documents that is attributed to Mallory Parker. She is the girlfriend of Anthony's brother, Lee. The statement suggested that Lee Anthony and Parker knew on some level that Casey Anthony killed Caylee.

Lee Anthony's attorney spoke about the documents on Friday. "To this day, I believe everything my sister tells me," Lee Anthony said in a videotaped deposition.

In multiple sworn depositions, Lee Anthony has said under oath that he doesn't know what happened to his niece. But in a 2008 interview included in the documents released on Friday, a journalist, Rozzie Franco, told authorities of a conversation she had with a co-worker of Parker. The co-worker said Parker and Lee Anthony have suspected for a long time that Casey Anthony killed Caylee.

"He is in support of his sister all the way," attorney Tom Luka said. Luka denied that Lee Anthony or Parker ever made a statement to anyone that suggested they know or suspect that Casey Anthony killed her daughter -- or that she confessed to any role in her daughter's death. "Nor did he admit to any sort of behavior that would indicate that Casey knew what happened to Caylee," Luka said.

UPDATED: Documents: Mystery Hair Was Found Near Caylee Remains
POSTED: Friday, April 23, 2010
UPDATED: 12:17 pm EDT April 23, 2010
<snipped>
Local 6 News reported that it appears neither the prosecution nor the defense knows to whom the mystery hair belongs. The state could argue that there is a simple explanation for the hair that was found in the woods. But the defense could try to use the hair to suggest that it belongs to an unknown killer.

When Caylee's remains were discovered, detectives found a World of Disney bag nearby. Inside the bag was a Gatorade bottle, which contained a syringe and a brown liquid that contained extremely small amounts of the chemical chloroform. The FBI crime lab later determined that the liquid was testosterone, possibly used as a steroid for bodybuilding.

Crime scene investigators placed the items from the bag on a piece of brown paper to take a photo, and the 5-inch-long strand of human hair was discovered on the paper, the documents show. The hair does not belong to Casey or Caylee Anthony, and the documents released on Friday show that it also does not belong to any of the crime scene investigators who handled the evidence.

Meanwhile, a transcript of a taped interview with Cecilia Benaida, the sister of Krystal Holloway -- who is also known as River Cruz -- conducted by Orange County Cpl.. Eric Edwards was also included in the documents. In the interview, Benaida told investigators her sister and Anthony's father, George Anthony, became friends and she assumed they had a physical relationship. Under oath, Holloway denied having an affair with George Anthony. Benaida also said that her sister gave George Anthony about $5,000, but she didn't know what he did with the money, according to the transcript.

UPDATED: Mystery Hair Disclosed In New Casey Documents
Posted: 8:58 am EDT April 23, 2010
Updated: 6:43 pm EDT April 23, 2010
<snipped>
The mystery hair could help the defense claim that other evidence in Casey's case was contaminated by investigators, and there’s still their theory that there’s another killer responsible. The documents indicate the FBI tested the mystery hair against samples from Orange County sheriff's investigators who were at the scene and whose hair could be a match to the dark strand that was found. The hair did not match Caylee or her family.

The newly-released documents show that a five-inch long, fine, dark brown strand of hair from a Caucasian was found with a piece of plastic from the scene where Caylee's remains were found. The documents show the medical examiner's office investigator isolated it on collection paper while examining the piece of plastic. Seven Orange County sheriff's investigators each submitted five head hairs so the FBI could determine whether the hair came from any of them. The records don't show whether they ever figured out whose hair it is, but WFTV has learned they haven't.

Could that mystery hair do for Casey what the bloody glove did for OJ Simpson? WFTV legal analyst Bill Sheaffer says no. “’If it doesn't fit, you must acquit.’ This evidence does not rise to that level,” Sheaffer said.

The documents released Friday also included a transcript of an interview with the sister of a woman who claims she had an affair with Casey's father, George Anthony. Cecelia Benhaida spoke to investigators on February 18, 2010. Cecelia Benhaida said during the police interview that George told her sister the death of his granddaughter, Caylee, was an accident. She said she didn't know any other details. George Anthony's attorney didn't immediately return a phone call seeking comment. His daughter, 24-year-old Casey Anthony, has pleaded not guilty to first-degree murder and has said a baby sitter kidnapped her daughter, Caylee.

Another transcript released was a November 2009 interview with Derrick Williams, whose name got connected to the case as a result of his address at the infamous Sawgrass Apartments, where Casey allegedly left her daughter with the mystery nanny named Zenaida Gonzalez. Williams contacted deputies to speak with them in an attempt to clear his name.

A third transcript, an interview with Rozzie Franco, was previously released in early April and involves a conversation Franco overheard at an Orlando Houston's restaurant.

New judge already setting tone in Anthony case
Updated: Thursday, 22 Apr 2010, 11:04 PM EDT
Published : Thursday, 22 Apr 2010, 11:04 PM EDT
<snipped>
The new judge in the Casey Anthony case takes some action on Thursday. Judge Belvin Perry lays down the law in setting his first hearing in the case he also some rules for the attorneys on both sides of the case to follow.

The judge ordered attorneys to review the 9th Judicial Circuit's Courtroom Decorum Policy. "I think that's directed at both sides. They're not going to be able to squabble like they've been doing," said Tennis. The new judge also wants to set deadlines and know what motions have not yet been heard. "I think that's defense oriented. I think he's going to want depositions set, what exerts are you going to use. I think he's going to get this on a tight leash," said Tennis.

Judge Perry also wants to know what motions will require hearings. And he's demanding a courtesy copy of all future motions sent to him. "I don't think he appreciated that Judge Strickland went way on a Friday afternoon for a weekend not realizing this was going to be brewing over the weekend I think he's thinking it was rude. I don't think he's planning on that happening to him have any surprises he learns about in the media," said Tennis referring to Casey's defense team, who filed their motion after 4:30 p.m. Friday, asking Judge Strickland to recuse himself.

FOX 35 asked Tennis is it's typical for a Judge to write an order like the one Chief Judge Perry did when taking over a case. "This is a special order for a special case. It sends a signal, he doesn't care for how the lawyers have been behaving in the courtroom and that's going to come to an end," said Tennis.

That hearing is April 30th at 9:30 a.m. on the 23rd floor of the Orange County Courthouse.

Casey Anthony: Stations focus on mystery hair and what it means to case
posted by halboedeker on April, 23 2010 1:39 PM

“The documents raise more questions than answers, but they show how thoroughly the FBI was trying to figure out whose hair, other than Caylee’s, was on the duct tape” found with the todder’s remains, WFTV’s Kathi Belich said.

WFTV anchor Barbara West later said, “The FBI was trying to identify a hair that didn’t match Caylee Anthony’s which was apparently found on a piece of duct tape over her mouth.”

And a WFTV promotional spot talked about “a hair found on a piece of duct tape.” But the documents released today say nothing about a mystery hair on duct tape. WKMG’s Mike DeForest correctly noted “that mystery hair was found with the Disney bag and the Gatorade bottle.”

WESH’s Bob Kealing focused on Lee Anthony’s girlfriend, Mallory Parker, and a conversation she had with a co-worker.

“The words jump off the page: Mallory knows Casey did something to Caylee, and she’s sure she killed Caylee,” Kealing read. The tip came from a journalist covering the case. But when detectives pressed the issue, Kealing added, they “deteremined the context of the alleged conversation between Parker and a co-worker was only that Parker believed Casey killed Caylee and that Casey never confessed the crime to her.”

Local 6 Details Mystery Hair In Anthony Case
April 23, 2010
<snipped>
A piece of potential evidence in the Casey Anthony murder trial is a hair that was found near where her daughter Caylee’s body was found on Dec. 11, 2008. FBI lab results previously showed the hair did not belong to Casey or Caylee.

Other media have inaccurately reported the hair was found on duct tape with the body. This is how Local 6 correctly determined where the hair originated.

Page 13846 of the discovery released on Friday contains this information:
23246240_480X98.jpg

That shows the FBI compared the hair to those from evidence technicians who had access to specimen Q107 and found no match -- so it was not contaminated by the evidence technicians. But what is specimen Q107?

For that, Local 6 went to page 10284 of discovery released in October 2009 and found this:
23246214_480X64.jpg

These FBI lab notes show the Caucasian head hair was compared to Caylee’s (Q59) and Casey’s (K2) and found not to be a match. It also shows where the collection paper that contained the hair came from: H-60518, Item 4, Q91. This is an Orange County sheriff’s evidence number, and Local 6 found it on page 3473 of the discovery released in February 2009.
23246213_480X171.jpg

That proves that Q107 Collection paper (H60518, Item 4, Q91) is referring to the paper underneath the World of Disney bag and Gatorade bottle, found just inches from Caylee’s skull.

For further proof that the sheriff called this evidence number Q91, look to page 3705 of the February 2009 discovery release, and you see this:
23246207_365X480.jpg

Q91 clearly refers to the paper upon which the bottle and bag were photographed. And if you look closely at the lower right-hand side of this evidence photo of the Gatorade bottle, you see what appears to be a hair on the collection paper. Whether it is the “mystery” hair or the animal (rabbit) hair referred to in the FBI lab notes above (page 10284), we cannot say.

Casey Anthony: Is mystery hair found with Caylee as crucial as bloody glove in O.J. Simpson case?
posted by halboedeker on April, 23 2010 6:36 PM
<snipped>
“If it doesn’t fit, you must acquit — this evidence does not rise to that level,” Sheaffer said. “There is so much other circumstantial evidence indicating that Casey Anthony killed her child. In the O.J. Simpson case, there was not that quality or quantity of circumstantial evidence.”

Earlier, Belich had reported that the mystery hair was on the duct tape found with the toddler’s remains. WESH-Channel 2 also reported that the strand was “on the duct tape across Caylee’s skull.” But the documents released today say nothing about a mystery hair on duct tape. And Belich updated her initial report by later saying: ”A 5-inch-long, fine, dark brown strand of hair from a Caucasian was found with a piece of plastic from the scene where Caylee Anthony’s remains were found.”

In other Anthony news today:
***Belich focused on the news that an FBI expert unintentionally left her DNA on a piece of duct tape. “The defense could use the FBI’s slip-up to Casey’s advantage,” Belich said. Analyst Sheaffer predicted that the defense would seek to have the evidence excluded but the court is unlikely to agree.

***WKMG reported that Anthony defense attorneys Jose Baez and Cheney Mason visited the office of Mark NeJame, attorney for Texas EquuSearch. The Anthony attorneys went to look at records of EquuSearch volunteers; the defense had wanted photocopies of the records. “Twice the judge ruled that the only way for the defense team to see those records was to view them in person at Mark NeJame’s office,” DeForest reported. “For the first time in eight months, the defense finally did that.” NeJame was out of the office and didn’t want to comment on the situation, DeForest said.

***WESH-Channel 2’s Bob Kealing focused on Lee Anthony’s girlfriend, Mallory Parker, and a conversation she had with a co-worker. “He is in support of his sister all the way,” attorney Tom Luka told Kealing.

Lee Anthony has said Casey never confessed or suggested she knew what happened to her daughter, Luka added. “He’s obviously waiting to see what happens, if there’s any more evidence comes out,” Luka said. “But as it stands at this moment, he is 100 percent behind his sister.” Lee Anthony has immunity from prosecution for anything he testifies to as long his stories are truthful and consistent, Luka told Kealing.

Artist, cook and blogger: 'Marinade Dave' stirs up Casey Anthony case
April 25, 2010
<snipped>
Among friends, Dave Knechel has always been known for three things: loyalty, fairness and dependability.

The self-taught artist, writer and cook has left his mark designing slogans for companies, creating advertisements for department stores and selling homemade marinade. His biggest mark might be from his newest venture — his blog about accused child-killer Casey Anthony.

Knechel (pronounced NECK-al) is "Marinade Dave," a Casselberry blogger whose moniker comes from his days as a meat marinade maker. He was thrust into the public eye this month after he was the recipient of kind words from Orange Circuit Judge Stan Strickland. The judge's comments sparked a defense request for Strickland to recuse himself from Anthony's high-profile case. Strickland granted that request. And just like that, the judge was out and Chief Judge Belvin Perry was in.

It was an outcome Knechel never imagined when several months ago he posted a blog entry about the day Strickland called him to the bench to compliment him on the coverage. "I rue the day that I wrote about it," Knechel said while seated in front of his laptop at the Seminole County Library. "I'd rather be remembered as a writer," he said, not the guy who played a role in Strickland's recusal.

The national news has garnered him lots of attention – some good, like an increase in page views and national exposure; and some bad, like a few death threats and lots of nasty e-mails. He has not reported any of the threats to the police. "Most are idle threats, I hope," Knechel said.

Casey Anthony case: Why is there such interest in it?

I recently asked WFTV-Channel 9 anchor Bob Opsahl if he’d ever seen a story like this one and why there is such interest in it. “It is the ultimate reality show involving wild parties, multiple sex partners, serious family problems, lies, deceit and murder,” Opsahl told me.

Of the players, Opsahl said, “Each one appears to be hiding a dark secret. The only innocent in the whole scenario is beautiful Caylee, the victim of a horrible crime. And almost every week, there are surprising new revelations, and a never-ending supply of fascinating plot twists. No, I’ve never seen a news story like that before. It’s going to be hard to forget the Casey Anthony saga, but I’ll try.”

Casey is charged with first-degree murder in the death of Caylee. I think Caylee is the main reason the story holds enduring interest. People want justice for her and the full story about what happened to her.
