Attorney Seeks Hearing On EquuSearch Records

Defense attorneys for Casey Anthony made a quick entrance and exit Friday at the office of the lawyer for Texas EquuSearch. The attorneys reportedly left after the news media showed up.

Officials with EquuSearch said they now plan to try to break the standoff with Anthony's defense team in court. A source said officials with Texas EquuSearch want the new judge in the case, Belvin Perry, to weigh in because they're they are fed up with playing the waiting game with Anthony's defense.

For more than eight months, officials with Texas EquuSearch have waged an epic legal battle have fought to keep private records of Central Florida residents who answered their call for help.

A source said EquuSearch plans to file legal paperwork to have the judge order Anthony's defense to review the records and be done with it. EquuSearch attorney Mark NeJame would not comment on what the group is planning.

The defense team for Casey Anthony has filed a motion that argues prosecutors in the case chose to pursue the death penalty against their client because they knew it would break her financially.

Jeff Dowdy has defended many high-profile death penalty defendants, including the man behind a massacre in Deltona that claimed six lives. The defendant was Troy Victorino. "The whole case in its entirety was $1.1 million, but that was with four co-defendants and eight attorneys ... That was just for the defense," Dowdy said.

Another legal expert said he see little chance the motion will succeed. He believes Anthony's defense is making sure they've put anything they can think of on the record to increase the possibility of a successful post-conviction appeal.

Casey Anthony's California attorney Todd Macaluso has filed a motion to be removed from her case because he is in trouble with the California Bar.

Macaluso filed the one-page motion Monday stating that he is on "involuntary inactive status with the California State Bar&#8230;for an undetermined period of time."

In February, Macaluso told the defense team that he could no longer represent Anthony because he had entered an alternative-discipline program after being accused of "moral turpitude, dishonesty or corruption" in handling several trust accounts.

Casey Anthony: truTV to carry Friday hearing live

Viewers will get to see Chief Judge Belvin Perry, the new judge in the case, that morning. A national TV audience can catch the hearing live at 9:30 a.m. on truTV&#8217;s &#8220;In Session.&#8221;

WOFL-Channel 35 will broadcast part of the hearing live during a morning newscast. WKMG-Channel 6 said it will carry the hearing at its Web site, ClickOrlando.com.

When I hear what other stations are doing, I&#8217;ll pass that information along.

Coverage will be available at OrlandoSentinel.com as well.

Anthony Attorney Officially Withdraws

A California attorney on Casey Anthony's defense team has filed paperwork to withdraw from her murder case.

Todd Macaluso filed a motion in Orange County on Monday, saying he is currently on involuntary inactive status with the California State Bar.

Macaluso announced his withdrawal from the case in February.

One of Casey Anthony&#8217;s defense attorneys has filed a motion to officially be removed from the case.

Attorney Todd Macaluso submitted the motion on Monday because he has been disbarred in California. WFTV reported in February when Macaluso left the defense team due to a disciplinary issue with the California state bar.

Embattled Lawyer Wants Off Casey Case

Todd Macaluso said he is in trouble with the California state bar after he was accused of mishandling some cases.

A motion he filed with the court said his license to practice law in California is inactive, and he is being disciplined by that state&#8217;s bar.

Macaluso&#8217;s departure from the Casey Anthony case would still leave her with four other lawyers to defend her from charges she killed her 2-year-old daughter, Caylee.

New Judge In Casey Case To Hold Hearing

Judge Belvin Perry will hold a case-management hearing at 9:30 a.m. in courtroom 23 at the Orange County Courthouse. The hearing will be streamed on ClickOrlando.com.

Perry took over Anthony's murder case after Orange County Circuit Judge Stan Strickland recused himself. Strickland's move followed a defense motion asking that Strickland be disqualified over a friendship with a blogger.

The hearing will be an opportunity for Perry to call all the attorneys together to ensure he has the information he needs to get up to speed on the case.

Orange County Chief Judge Belvin Perry scheduled a status hearing for 9:30am to review the case.

Judge Perry has been on the bench in Central Florida for 21 years.

The state and the defense have met once in anticipation of the hearing, WESH&#8217;s Bob Kealing reported. Kealing noted with Perry in charge there is a new emphasis on deadlines, speed, court decorum and avoidance of disparaging personal remarks.

In a later report, Kealing showed how Perry reacted strictly in sentencing a murderer who refused to cooperate with authorities. &#8220;You will never, never walk this Earth again as a free man,&#8221; Perry told the young man.

&#8220;Attorneys expect Perry to bring that same tough-as-nails, but-fair-to-both-sides attitude to the case against Casey Anthony,&#8221; Kealing said.

Casey Case Goes Before New Judge Friday

"Judge Perry expects you to get to the point and he values his time and he takes it personally when you waste his time," said Richard Hornsby, a criminal defense attorney.

"You went from the most defense friendly judge, or what most defense attorney's would want -- Judge Strickland -- to the one judge most prosecutors want because they have a case. They have their evidence and they know they're in the right most of the time," Hornsby said.

Hornsby said Perry is a by-the-book judge, but that guarantees nothing for the defense. "You can have a very fair judge but if you lose the case, you have to be prepared to pay the ultimate penalty -- whether it's the maximum sentence or in Casey Anthony's case, the death penalty," Hornsby said.

The hearing was merely a formality. Judge Belvin Perry got acquainted with the case&#8217;s key players and discussed deadlines, including the deposition of all witnesses, as well as deadlines for future motions.

Another hearing will be held on May 6th about the defense team budget. Additional hearings will be held on May 11th and 12th for defense death penalty motions.

Judge Perry wanted the attorneys on both sides to know he has strict rules and he expects them to be followed. An order went out to both prosecutors and Anthony&#8217;s defense attorneys to make sure the rules are clear. Counsel has to stand when court is opened and adjourned. And disparaging personal remarks won't be tolerated. Judge Perry is also mandating deadlines for new discovery and pushing to move past any unresolved motions. The order also says the attorneys must refer to everyone by their last names only, ask permission before approaching the bench, and they can't make gestures or facial expressions that show any disapproval while witnesses are testifying.

Once Judge Perry arrived, things got going quickly, with the judge carrying a firm tone, pressing both parties on outstanding motions, including for change of venue and dealing with the death penalty. Perry scheduled a hearing during the week of May 10 to discuss several motions dealing with the death penalty.

Regarding the change of venue request made by the defense, Judge Perry said he would consider it but, if he did change the venue, it would not be disclosed until the last minute. He also said it's possible they could get the jury from a pool outside of Orange County and still hold the trial inside the county. Judge Perry said, once the trial starts, if the jury were to be sequestered, he would work five and a half days a week (a half-day on Saturdays).

Judge Perry asked the two parties about the scheduled trial start date of May 9, 2011 and if they were okay with it. Both seemed satisfied with that date. &#8220;I would like to do it sooner, but it looks like ya&#8217;ll have agreed on something. My only concern is that, as you know, under our system of laws, the adversary system of justice is memory dependent and, unfortunately, memories deteriorate over a period of time,&#8221; Judge Perry said. &#8220;I will think about it. I&#8217;m inclined to stick to the same schedule, but once we do that I will enter an order and you will be stuck with it.&#8221;

Judge Perry then pushed for information much more aggressively than in previous hearings, pressing the two parties on how long the trial will take. After brief discussion, Judge Perry suggested that it sounded like the guilt/innocence phase of the trial would last between four and six weeks with one week for sentencing if Casey were found guilty.

"As you know, we will have status hearing every 45 days to make sure you are following this schedule," Judge Perry said, referring to the schedule he'll provide to be sure they're ready for the trial date.

Among the items Perry is discussing with defense attorneys and state prosecutors today: pending motions, pre-trial and trial dates, deadlines for future motions, and deadlines for when evidence will be released as part of the discovery process. The tenor of Anthony's case already has changed dramatically with Perry on the bench during the first meeting.

Perry is pressing attorneys to move now with the case. He set one hearing &#8211; to determine how much public money the defense plans to spend &#8211; for May 6. He set several others hearings, including whether jury selection should be moved to another county &#8211; for the following week.

State prosecutors said there are now 250 witnesses, 90 of which defense attorneys will likely want to question before trial. Also discussed is a possible change of venue. "It is no secret that this case has received widespread publicity," Perry said. If he grants a change of venue it will not be disclosed until "the last possible moment" because of possible media coverage and disclosure of case details to potential jurors.

After talking to attorneys, Perry predicted the trial would last four to seven weeks. Tentative trial date, set earlier, stays at May 9, 2011.

Throughout the hearing, prosecutors and defense attorneys maintained an orderly air which is different from other hearings that were filled with bickering.
