Friday Casey Hearing Will Be 1st With New Judge
Status Hearing Slated For 9:30 A.M.

When Perry takes the bench on Friday at 9:30 a.m., he has told both sides to be prepared to discuss the following:
&#8226;Deadline for depositions of all ordinary and expert witnesses.
&#8226;Deadline for future motions both pending and unresolved.
&#8226;Pretrial and trial dates.

Sources in the case said the number of emails between the two sides has picked up, and they've already met once in anticipation of Friday's hearing.

Perry also told lawyers to re-familiarize themselves with his 15 point courtroom decorum policy, address remarks to the judge and not each other, and avoid disparaging personal remarks or acrimony towards opposing counsel. The last point is aimed clearly at Jose Baez and prosecutor Jeff Ashton, who have been known to mix it up a little in previous hearings.

Analysts had called Perry a &#8220;no-nonsense&#8221; judge, and that was reflected in the first court hearing in the case.

The judge was all about the calendar, pushing both the prosecution and defense to be ready for trial. At one point, when Perry was talking to defense attorney Jose Baez about his budget for the Justice Administrative Commission to pay for Casey&#8217;s discovery process, he said: &#8220;That needed to be done, like, yesterday.&#8221;

Perry set the hearing for May 6, then started pressing the attorneys to get all their pending motions resolved, and until May 10 to prepare them for his decision.

Both sides said they had a lot to do -- for example, the state trying to get depositions from as many as 250 witnesses. Perry said he wants a schedule of when they will take depositions. Anyone who misses a set deadline could be held in contempt of court. &#8220;I will not be taking the excuse, &#8216;They don&#8217;t show up; we need a delay.&#8217; Give them a courtesy call, and if we need him, I&#8217;m sure the sheriff, Jerry Demings, will be helpful in making those witnesses available,&#8221; Perry said.


Defense Files Objection About Former Judge
Judge Stan Strickland recused himself from the case earlier this month, and was critical of the defense in responding to their request that he step down. Defense attorney Cheney Mason filed an objection with the court Friday, taking exception to Strickland's response.

New Motions Filed
Among them is a motion to seal jail visiting log records. The defense said if they cannot keep confidential the people visiting Anthony, they cannot properly prepare her case for trial. A memorandum supporting motion to declare death penalty unconstitutional was also filed, along with a motion seeking a protecting order with respect to death penalty. The defense wants to protect Anthony from revealing any information relating to any potential witnesses or testimony in a penalty phase proceeding prior to a first-degree murder conviction, if should that happen.

Secondary Casey Anthony attorney leaves case

One of Casey Anthony's attorneys has removed himself from her case after getting in trouble with the California Bar.

Todd Mancuso said in a motion this week he was on "involuntary inactive status."

Mancuso told the defense team for the mother accused of killing 2-year-old Caylee Anthony in February he had entered an alternative discipline program.

Anthony is still being represented by Kissimmee-based attorney Jose Baez, prominent Orlando lawyer Cheney Mason and two other out-of-state attorneys.

The trial is scheduled to start in May 2011.

Casey Anthony on Friday made her first appearance before a new judge, who made it clear that her trial will be held in Orange County although the jury may be chosen elsewhere.

Perry set a closed-door hearing on defense costs, which will be paid for by taxpayers, for May 6; several other open-court hearings will be held the following week. Later in the hearing, Perry said that the May 9, 2011, scheduled start date for Anthony's murder trial will likely remain.

Perry also discussed a possible change of venue. The state said it will not oppose most of the defense motion for a change of venue, but that only means a jury would be chosen in another Florida city. The jurors would then be brought back to Orange County for the trial, which attorneys predicted could take up to nine weeks.

In the next two weeks, Judge Belvin Perry said he plans to address most of the outstanding motions and issues in the case. He also sent a strong signal about where the murder trial will be held. Perry said he plans to decide the defense team's budget, any death penalty challenges and a request to have the trial moved in just weeks.

With lawyers on both sides displaying their best behavior, and Casey Anthony mostly stone-faced, Perry made his first order of business setting the defense team's budget hearing for Thursday.

Perry said he wanted to move the start date of the trial up, if possible, but he reluctantly kept it as scheduled on May 9, 2011. Perry said he plans to keep things moving and promised status hearings every 45 days to make sure everybody is on track. He even offered to have the Orange County Sheriff's Office help make sure witnesses scheduled for depositions make it there with no excuses.

Chief Judge Belvin Perry won favorable reviews for the way he guided a hearing this morning in the Casey Anthony case.

Perry is the new judge in the high-profile case, and his style at the Anthony hearing was the top story on noon newscasts.

WKMG-Channel 6&#8217;s Tony Pipitone said, &#8220;He runs a no-nonsense court. The decorum was impeccable. Everyone stood when they were speaking. They addressed the judge. They didn&#8217;t address each other. It was like they were all back at law school trying to act like young lawyers.&#8221;

WESH&#8217;s Bob Kealing agreed. &#8221;If you blinked once during this 45-minute hearing, chances are you missed the judge scheduling something,&#8221; Kealing said.

Defense attorney Jose Baez was seen on WFTV saying: &#8220;We love the knowledge that Judge Perry brings to the bench.&#8221;

Yeah, a lot of people love Perry at first glance.

WOFL-Channel 35 anchor Sonni Abatta saw &#8221;a whole new attitude&#8221; with Chief Judge Belvin Perry taking over from Judge Stan Strickland, who recused himself from the case. &#8220;Judge Perry is very direct and made it clear he doesn&#8217;t want anything to slow down this case getting to trial, which is now set for a year from now,&#8221; WOFL&#8217;s Holly Bristow reported.

WESH anchor Jim Payne said Perry &#8220;set up an ambitious schedule to put this trial back on the fast track.&#8221;

WESH&#8217;s Bob Kealing said Perry displayed a vintage style in asking direct questions and seeking direct answers. &#8220;He also sent a surprise signal today that this trial will be held right here,&#8221; Kealing said outside the Orange County Courthouse. Kealing quoted a lawyer who said that Perry &#8220;is like having a general on the case.&#8221;

WESH&#8217;s Kealing highlighted that Anthony chuckled briefly before the hearing but &#8220;sat emotionless&#8221; during the hearing.

WFTV&#8217;s Belich said that Anthony&#8217;s &#8220;expression was serious, her jaw tightened when the death penalty was mentioned.&#8221;

WOFL anchor Abatta noted that Casey Anthony wore a pink shirt and had her hair pulled back. Abatta explained that Cindy Anthony waved at Casey and mouthed &#8220;I love you&#8221; at her daughter when the young woman was escorted in handcuffs out of the courtroom. Casey Anthony briefly smiled at her parents, Abatta added.

Casey's defense mad about judge's insult-filled motion

In a motion filed today, J. Cheney Mason objected to Strickland's criticism of the defense.

"The judge, in filing his order, chose to utilize that opportunity, even though improvident and innapropriately so, to insult defense counsel and do so by either serious mistaken recollection of the facts or worse," Cheney wrote.

Casey Anthony's trial could last 2 months

In his first hearing after taking over the case, Chief Judge Belvin Perry, Jr. said he would not announce the venue for the trial until right before it starts.

"Unfortunately, if you disclose the location too soon, then you have the problem with interviews asking what's called a man or woman on the street," Perry said. "You generate stories in those local papers, so we must balance the interests of the defendant and receiving a fair trial and balance the right of the public to know."

Casey defense files motion to seal jail visit records

Casey Anthony's defense team filed a motion Friday to block to the release of jail visiting log records from the public.

The defense claims in the motion that "the media is constantly aware of any visits that the Defendant has." They also claim that the visits reveal the identity of any expert witnesses that may visit Casey in the jail.

Casey Anthony faces new judge

"I think the judge will assert himself and clearly establish whose courtroom it is," said Mark Nejame. "I think he'll run a very tight, orderly, no-nonsense conference."

The chief judge has the power to move up the accused child killer's trial date which was set for May 9, 2011 by Strickland, but Nejame says Perry probably won't take that step. "I think he will honor the existing date but will likely let them know that he believes that that is more than enough time, and they better be ready," said Nejame. "Judge Perry will be a bit more exacting and demanding in holding people to schedules."

Nejame says Perry will also be strict when it comes to handling any bad behavior by attorneys in the courtroom. "He will simply lay people out," said Nejame. "He'll likely give people a chance to correct their behavior, and then he won't tolerate it again. He will not be shy to impose sanctions."

The judge in the Casey Anthony murder case has set a new deadline for attorneys. He is giving them two-and-a-half weeks to file a detailed deposition schedule.

That's a huge undertaking. It means that by May 17, attorneys must contact more than 50 witnesses and schedule them for sessions during which they'll be questioned &#8211; sometimes very sharply - under oath about the case. He signed it Friday. It is another signal that he intends to move the case forward aggressively.

At a hearing Friday, Assistant State Attorney Linda Drane Burdick told the judge that the state has listed 250 witnesses. She predicted that defense attorneys would want to depose about 90. Defense attorney Jose Baez said they had finished only 36. That leaves more than 50 yet to do.

On Thursday, he'll hold a hearing about defense public spending in the case. Thursday's hearing could be the first time defense attorneys disclose just how much money they expect to spend. Tuesday will be dedicated to defense motions attacking Florida's death penalty. Hearings both days start at 9 a.m.

Judge Orders Hearings In Casey Anthony Case

The first hearing that Judge Perry ordered is scheduled for May 6 at 9:00am, which will address the budget.

The second hearing is on May 10 at 9:00am. The court will hear any pending motions. The defense is ordered to provide the court with a list of motions identifying those that will require the presentation of witness testimony or other evidence.

A hearing is also scheduled on May 11 at 9:00am, where the court will hear any pending motions related to the death penalty.

In the order regarding the deposition schedule, both sides must submit a schedule by May 17 with names and addresses of witnesses to be deposed on each date.

Meanwhile, attorneys will return to court for a hearing in the civil case against Casey Anthony Tuesday on the defamation lawsuit filed by a woman named Zenaida Gonzalez. She claims her reputation was ruined when Casey said a babysitter named Zenaida Gonzalez took Caylee Anthony.

The first one is scheduled for Friday. In that hearing, Perry wants to go over the budget. Since Anthony was declared indigent, and the state is picking up the tab, the judge wants to make sure the expert witnesses won't bust the budget.

The second hearing is scheduled for next Monday. Judge Perry wants to hear about any pending motions that he will be asked to consider.

The third hearing is set for the next day, May 11, to hear motions regarding the death penalty.

Judge Belvin Perry finalized a schedule Monday shoehorning three critical hearings in the next eight days.

On Thursday morning, a hearing will be held to talk about how much taxpayer money Anthony should be budgeted to aid in her defense, now that she has been declared indigent.

On Friday, defense attorney Jose Baez asked Perry if the budget concerns will be discussed in private. Perry decided the budget hearing will be held in open court Thursday.

Perry said he also plans to consider a series of defense motions challenging the death penalty.

Meanwhile, Anthony's civil case will be back in court Tuesday. A status hearing is scheduled for the defamation suit brought by the woman Anthony said was Caylee's nanny, Zenaida Gonzalez.

Anchor Jim Payne listed the hearings: On Thursday, there&#8217;s a hearing on taxpayer money that Anthony will receive for her defense; on next Monday, there&#8217;s a hearing on a change of venue; and a week from Tuesday, Chief Judge Belvin Perry will consider a motion that challenges the death penalty in the case.

WFTV-Channel 9, on its 10 p.m. news on WRDQ-Channel 27, reminded viewers that a pretrial hearing will be held Tuesday afternoon in the defamation suit against Anthony. Zenaida Gonzalez is suing Anthony for defamation for linking her to the disappearance of Caylee.

The civil trial was initially set for June. However, Anthony's civil attorney, Jonathan Kasen, who was not at today's hearing, and Gonzalez lawyers wanted more time to prepare and requested the trial be postponed. Orange Circuit Court Judge Jose R. Rodriguez agreed &#8212; but warned them the earliest date he could offer is sometime next year.

While Gonzalez's attorneys were hoping for a trial in August, they understand the delay."I'm not surprised," said Keith Mitnik, one of Gonzalez's attorneys. "The courts are very busy. It's not an old case." The new trial date gives her legal team time to investigate information that Anthony spoke and exchanged letters with another jail inmate, who claims Anthony told her that there was no babysitter named Zenaida. "They could be bombshells for our case," Mitnik said after the hearing.

At this point, the civil case will likely take place before Anthony's criminal trial, which is scheduled for May 2011.
