Prosecutors get new judge in Peterson case

Will County Chief Judge Gerald Kinney today allowed prosecutors to replace a judge in the Drew Peterson murder case, saying the defense had not established a pattern of abuse by the state of its right to replace judges.

"I do not find that this has been established by the defense's response," Kinney said during a hearing held at the Will County courthouse.

Prosecutors had filed a motion to replace Judge Richard Schoenstedt, arguing he was prejudiced against the state.

Kinney assigned the case to Judge Carla Alessio Policandriotes -- at which point Peterson's attorney, Joel Brodsky, said he wanted to replace that judge. But after a brief recess, Brodsky withdrew his request.

A hearing with the new judge is scheduled for 1:30 p.m. Friday.

Autopsy reveals little about river body

The Will County coroner's office said DNA testing that may determine the body's identity will take at least two weeks.

There has been speculation the body could be Stacy Peterson, who disappeared from her Bolingbrook home in October 2007, or Lisa Stebic, the Plainfield mother who went missing in April of that year.

While the autopsy indicated that the person has been dead several months or more, it "did not reveal any significant information in reference to the identity, race or sex" of the person, the coroner's office said.

"Positive identification may hinge on forensic DNA analysis" through the state police crime lab, Coroner Patrick K. O'Neil said in a statement.

The remains consisted of a rib cage, spinal column and partial left and right femur bones. The remains were found with shreds of blue jeans containing a small amount of U.S. currency, according to the coroner's office.

The head, arms and parts of the body below the knee were not found with the remains examined today, the coroner's office said. Authorities continue to search for them, officials said.

A witness at the scene said the body was taken from the scene about 7:50 p.m. after police and Will County coroner's staff had investigated the body. The body weighed no more than 30 pounds and appeared to have been mainly bones, according to the witness.

A source at the scene said the body was not found in the water but off onto a nearby shore.

Witnesses said it was around 2 p.m. that a barge crew discovered the remains &#8212; not an intact body &#8212; near the south shore after spending the past four days clearing logs and debris.

A source said the remains looked like that of a small female wearing underwear, but that DNA testing likely would be required for a positive ID.

"Positive identification may hinge on forensic DNA analysis, which is being expedited through the Illinois State Police Forensic Crime Laboratory," O'Neil said.

The coroner's office, he said, was given a conservative time frame in receiving forensic DNA and forensic anthropology results of approximately two weeks.

Kelly Hollis said she and her husband, Steve, were hiking near Moose Island, a little further down the river, when they saw a blue barrel.
"It was either late fall (2007) or early spring (2008) and at the turnoff, we looked across the river and saw a plastic blue barrel all by itself," she said.

The Hollises immediately thought of Stacy Peterson but thought the barrel at the shore was "too obvious" to indicate anything sinister.
"But it stayed in my head and a few days later I called the sheriff's police who put me in touch with the state police hotline," Hollis said. "I left a message with the story and the police said wait a few days and call back if I didn't hear from them, so I did."

Hollis said she was never contacted by state police, but she found it "a little freaky" when she saw a news report saying a blue barrel had been found Wednesday.

"We saw that quite a while ago. Could it have been there all along," she wondered.

Police continue search of Des Plaines River

A dive team took part in Thursday's search.

Around 2 p.m. Wednesday, a barge crew that had been clearing logs and debris discovered a partial skeleton near the south shore, approximately a mile west of the Interstate 55 bridge, near the Big Basin Marina. The cleanup crew has been working in the area for the last four days, according to reports.

At 7:50 p.m., a skiff carrying detectives and a deputy coroner landed at the marina. A coroner's van backed up to the skiff. A deputy coroner and investigator carried a white body bag from the skiff and loaded it in the van. The drooping ends of the body bag showed that the remains were only about two feet long.

Drew Peterson is headed back to court as his attorneys ask a judge to reduce his $20 million bond.
A judge will hear arguments Friday afternoon (1:30PM) over whether the former Bolingbrook police sergeant's bond should be reduced, allowing him a chance to get out of jail pending trial.

Prosecutors in the murder case against Peterson got their wish Thursday when a new judge was appointed to preside over his trial.

Circuit Judge Carla J. Alessio Policandriotes took over the murder case Thursday, after prosecutors successfully removed the Will County persiding judge who they claimed was "prejudice against the state."

Policandriotes will hear arguments Friday afternoon over whether the former Bolingbrook police sergeant's bond should be reduced, allowing him a chance to get out of jail pending trial.

Results of a Thursday autopsy on decayed partial human remains found along the Des Plaines River were inconclusive, but Stacy Peterson's family is hopeful they are hers. An expedited DNA analysis will likely take about two weeks.

Drew Peterson's lead attorney said he and his infamous client are confident the grisly discovery is insignificant to their case.

"I can just tell you we are not at all concerned," attorney Joel Brodsky said. "Not one bit."

Prosecutors in the murder case against former police officer Drew Peterson got their wish when a new judge was appointed Thursday. Peterson's defense attorney quickly said he'd ask that the new judge be replaced, too, but then changed his mind and said he won't object to the new judge.

Asked whether they were worried about the find, Brodsky said, "We are not concerned with that one bit ... You can speculate why."

The "why" Brodsky wants us to speculate on is that Drew maintains Stacy ran off with another man.

Prosecutors say Drew Peterson tried to hire a hitman to kill his third wife, Kathleen Savio.

The information came out in a hearing in Will County Criminal Court on Friday, where a judge said there would be no change in his $20 million bond.

A source tells CBS 2 that the new judge's husband is an investigator with the Will County Sheriff's office.

Sue Doman argued in vain five years ago that Peterson had killed her sister Kathleen. Today, she had this message for the sister she always called Kitty.

"I love you, Kitty," Doman said. "It took five years. I put a note in your coffin, you finally answered my prayers. I love you and I miss you. And we're gonna get him."

And just three weeks before Kathleen Savio was slain, Peterson, then a Bolingbrook cop, allegedly said to a fellow officer: "My life would be easier if she were just dead," Glasgow alleged in court.

After hearing the claims, a Will County judge refused to lower Peterson's $20 million bail this afternoon.

Peterson, who is known for making smart-aleck remarks in the media, was much more subdued in court Friday. He hung his head as he left the hearing, and got into a van to go back to jail.

The former Bolingbrook sergeant finally understood the seriousness of his situation, Glasgow said.

Peterson "realizes there is no way out," he said.

The $20 million bond keeping Drew Peterson behind bars on murder charges won't be lowered, a judge ruled Friday, after prosecutors argued that the ex-police sergeant hired someone to kill his third wife.

Peterson and his defense team were back in court in Joliet, Ill., to fight for a reduction in the hefty bond so that he could get out of jail while he awaits trial. That request was denied.

Prosecutors contend that the former Bolingbrook, Ill., officer hired someone to kill his third wife, Kathleen Savio.

Peterson is charged with murdering Savio and staging the death to look like an accidental drowning.

Additional Remains Found Along Des Plaines River

New information emerged Sunday about additional human remains found along the Des Plaines River this weekend.

The river clean-up crew that found the skeletal remains of a human torso Wednesday was back in the water today working to clean up the Des Plaines River near Channahon. While their focus is now back on garbage, the importance of last week's find was clear.

And they were out yesterday again when one man says they found evidence: an arm bone from shoulder to elbow. He wanted his identity withheld but praised the efforts of the volunteer searchers.

No one knows yet how the body found along the Des Plaines River last week ended up there.

But if it was submerged, there's little doubt its journey through the debris-filled river was rough. It may have crashed into boat traffic that moves year-round, got stuck on logs and roots, and been impacted by fish, wildlife and the changing currents and temperatures. By the time it arrived onshore, not far from Big Basin Marina near Channahon, only portions of the midsection and partial leg bones were left.

Although a preliminary autopsy last week couldn't say whether the body was that of a man or woman, the race or identity, the remains did hold a few clues. Found with the body were shreds of jeans, meaning the person likely had not been out for a swim and then drowned.

The body is undergoing DNA testing, and officials said results aren't expected for up to two weeks. Sources said they could be returned as early as this week.
