Motion Hearing Held
On January 11, 2023 the cause comes on for hearing of motions. State appears by Locke Thompson and Miranda Loesch. Defendant appears in person and with her counsel, Justin Carver and Delaney Catlettstout. By agreement of both parties, the Motion for Court Order Directing Illinois Department of Healthcare and Family Services to Produce Records Concerning Alleged Victim D.S.G. is sustained and the Court enters separately the proposed order provided. The parties will confer to provide a proposed confidentiality order with respect to the records. Defendant's Motion for Continuance is heard. Mr. Carver indicates that a report is forthcoming from a private psychologist opining that Defendant is unable to assist her counsel with trial preparation. The State indicates that upon receipt of the report it will then intend to request an evaluation as a matter of right under section 552.020.6, RSMo, which generally requires six months to be completed. Thus, the case cannot be tried on the currently scheduled trial date beginning March 13, 2023 and the case is continued. The parties are asked to confer concerning a proposed scheduling order. The case is scheduled for status update and trial setting on February 27, 2023 at 9 a.m. by Webex. The Court's Webex contact information is the same as previously given. The Court anticipates that the jury trial will begin in Cole county on September 11, 2023, with two weeks reserved for trial, and that jury selection in Pulaski County will occur a sufficient time in advance so that the jury can be seated and ready for trial beginning September 11, 2023. Defendant's Motion to Appoint Private Psychologist For 552.020 Evaluation is heard and taken under advisement. After review of applicable law, the Court sustains the motion and enters separately the proposed order provided. /s/WEH/dj

LOL! Probably on extended vacation! :D That is a whole lot stuff that happened. I see we missed a hearing in January. Oh well... probably wasn't there when you looked. But then the last time I asked was on 1/1/23.
