Court hears arguments on death penalty in Sydney Loofe murder case

One of two people accused of killing a Lincoln woman, dismembering her and dumping her remains in a southeast Nebraska field challenged the state's death penalty in Saline County's District Court on Monday.

Saline County District Judge Vicky Johnson scheduled a 1 p.m. hearing Thursday to take up the motion. At the same hearing, she will consider requests by Trail for expert witnesses such as a pathologist and forensic anthropologist to review Loofe’s autopsy and other evidence gleaned from her remains.

The motion related to the jail threats does not list specifics other than to suggest that they were prompted by Trail’s media notoriety. It also says Trail gets to leave his cell for only one hour per day to visit an exercise yard. Sometimes, the yard sessions take place after midnight.

Murray said he believes the jail staff are trying to make sure Trail doesn’t communicate with Boswell, who is being held at the same jail in Wilber, Nebraska.

Right now, he has access to books from the jail library and copies of police reports detailing the state’s evidence. Motion to hire a private investigator at a maximum cost of $10,000, and asked that the court release documents regarding the investigation and information gathered from the search warrant. No further court dates given.

Attorney for Bailey Boswell argues that state's death penalty is unconstitutional

On Monday, Boswell was in Saline County District Court with her court-appointed lawyers, who argued that Nebraska’s death penalty statues should be tossed out as unconstitutional.

A Saline County District Judge took the arguments under advisement after a brief court hearing. She gave state prosecutors until Oct. 1 to file a written response.

Aubrey Trail will stand trial - Jury selection will begin June 17, 2019.

Prosecutors have been turning over thousands of pages of evidence in the case to Trail and his defense attorneys, who are beginning to interview some of the state's witnesses for the first time.

On Thursday, a Saline County District Judge approved the defense's requests to hire a pathologist and forensic anthropologist to review the case.

She also approved a request for computer access so Trail can review the files. One of Trail's court-appointed attorneys had asked for TV or radio access for their client but withdrew the motion after he was granted computer access. The computer won't have access to the Internet.

"We're hoping he has solitaire," one of his court-appointed attorneys said.

Aubrey Trail underwent a competency evaluation hearing today in Saline County Court.

It was decided Trail will be evaluated by a psychiatrist to assess whether or not he is competent to stand trial.
