SALINE COUNTY, Neb. - Judge Vicky L. Johnson has ordered Aubrey Trail's next hearing to be moved to the end of the year.

The aggravation and mitigation hearing was originally set for June 23, 24, 25 and 26 at 9:00 a.m. and has now been pushed until December 15, 16, 17 and 18 at 9:00 a.m.

Aubrey Trail, 53, has a new sentencing hearing scheduled for Dec. 15, at which point a panel of three judges will decide if he receives the death penalty or a life sentence.

I have wondering the same thing. Is it still set to begin Wednesday? I’m also wondering about what kind of coverage we will get, considering it’s in Lexington, and of course, covid-19 protocols perhaps?

Trial of Bailey Boswell in slaying of Sydney Loofe begins this week

After a change of venue and a postponement, it’s Boswell’s turn to face a trial, one moved 175 miles west to the meatpacking town of Lexington because of extensive local and national publicity. Boswell is also charged with conspiracy to commit murder and improper disposal of human remains.

Testimony is scheduled to continue through Oct. 16 at the 106-year-old courthouse, which is on the National Register of Historic Places.

Boswell has never given extensive statements to investigators. And, also unlike Trail, she is not expected to testify at her trial. But prosecutors are likely to stress that it was Boswell’s Tinder messages that lured Loofe to her death.

A parade of FBI agents and other investigators is slated to testify, including at least three women who have said they had joined up for a few weeks with Trail and Boswell for sex, drugs, gifts and trips to casinos. Prosecutors have filed a motion to compel one witness from California to return to Nebraska to testify.

A video feed will be transmitted to a nearby county annex building — a former supermarket — that has been hurriedly converted from storage space to a meeting hall. During the trial, Loofe’s family, reporters and other spectators will watch the proceedings from the annex.

Potential jurors will be questioned beginning Wednesday morning.

Aw thanks! I don’t think we will be able to watch unless we actually go to Lexington. Hopefully, some of the media that reported at Trails trial will make the trek there.

3/3/20 Update: Trial had been set to begin on March 16 in Lexington, but Saline County District Judge Vicky Johnson issued an order Tuesday (3/3/20) postponing the trial until further notice because of a serious medical emergency in her family. 3/13/20 Update: Next trial date has been set for 9/23/20 to select jury.

Here's a quick update about this case:

Investigators learned Loofe’s last night was spent on a date with Boswell, who she had met on Tinder. She wasn’t seen or heard from again. Her phone last pinging a cell phone tower in Wilber, where Trail and Boswell lived in a basement apartment.

Trail and Boswell were identified as persons of interest early on, though it took several days for police to track them down in a hotel room in Branson, Missouri. While the pair were on the run, they posted videos on Facebook claiming they had nothing to do with Loofe’s disappearance.

Boswell specifically said she met Loofe on Tinder and they went on two dates which consisted of driving around and smoking marijuana. She said she dropped Loofe at a friend’s house after their second date and never heard from her again.

“I just want the family to know I’m sorry but I didn’t have anything to do with this,” Boswell said in the video. “I hope Sydney is found really soon, she’s a sweet amazing girl.”

Loofe’s body was found three weeks after she was reported missing. It was cut into 14 pieces and put in plastic bags that were abandoned in a field in Clay County.

Trail went to trial for the murder in June of 2019. In his trial, witnesses and early statements made by Trail spoke of a “sex cult” ran by Trail and Boswell. He also talked about witch craft and said at one point he was a vampire who could fly.

At one point, Trail had a violent outburst in which he tried to harm himself. He yelled “Bailey is innocent, curse you all,” and sliced his throat three times with an apparent razor blade.

Trail recovered from his injuries, but didn’t return to the courtroom until he took the stand himself. This is when he claimed Loofe’s death was an accident. He said he and Loofe were engaged in a sexual act and he was chocking her with an extension cord.

“I don’t know if Sydney had a seizure or what but that’s when she stopped breathing,” Trail said in his testimony.

When asked why he didn’t call for help, Trail said he didn’t think anybody would believe him.

Trail was found guilty of killing Loofe after three hours of deliberation.

During the next few weeks, I'll be traveling to Lexington, NE to cover the trial of Bailey Boswell, who's facing 1st degree murder charges in the death of 24y/o Sydney Loofe of Lincoln. Loofe was missing & later found dead & dismembered in a field in 2017.

To start, potential jurors are asked questions about everything - bias, personal interest, health, jobs and age.

More general questions are asked by the judge before attorneys may begin asking more in depth q’s.

When the judge/attorneys deem necessary, jurors are excused.

Boswell herself is here for the jury selection process. Rule 43 of the Federal Rules of Criminal Procedure states that the defendant has the right to be present at EVERY stage of trial, including selection of the jury.

No cameras for video or photos are allowed during the jury selection process in order to maintain jurors identities. So, you won’t be seeing much video from today and tomorrow on our newscasts.

I’m here in Lexington where jury selection is starting in the Bailey Boswell trial, she’s charged with the first degree murder of Sydney Loofe.

Today, the court brought in 90 potential jurors, with others they could call in if needed. Over the next two or three days the lawyers will get to ask them questions to determine their ability to serve on the jury.

Eventually the jury pool will be whittled down to 12 jurors and three alternates who will carry the responsibility of taking in both the prosecution and the defense’s evidence before deciding if Boswell is innocent or guilty.

By the time jury selection has taken a break for lunch, about 15-20 jurors have been dismissed due to personal/employment obligations. It’s going to be a while before they get this list narrowed down.
Such a sad time for the family to have to relive this all again. I attended the Trail trial last year in Wilber almost every day. It was the most disturbing thing I have ever done- and I was an outsider, can’t imagine the effect on those close to Sydney. My heart and prayers go out to them

They started with a pool of 180 jurors and called 90 of those in for questioning Wednesday morning.

Throughout the day, jurors were dismissed for various reasons, including being over 65-years-old, having medical concerns or being essential workers.

Attorneys for Boswell and the state will need to whittle those 180 people down to 12 jurors and three alternates.

To do so, they’ve been asking the potential jurors questions about their knowledge of the case, their opinions about issues like the death penalty and ultimately whether or not they’d be able to serve on the jury fairly.

Jury selection is expected to last through Thursday.

They’re hoping to start opening statements before the end of the week.

The trial itself is scheduled to last four weeks.
