For its brazenness and its avarice - I truly hope Trump Organization's corporate charter is revoked. It will still be little justice to New York taxpayers but at least would ensure he couldn't continue to defraud the state sometime in the future. I think at this point dissolution is beyond warranted.

New York Attorney General Letitia James’ office estimates former President Donald Trump falsely inflated his net worth by $3.6 billion, according to a new court filing, marking a significant increase from the $2 billion her office claimed he overstated his wealth by last month.

James’ office revised the estimate in a new court filing Friday, explaining that the previous figure was a “conservative” estimate and that the new number is “still a conservative estimate of the extent of the inflation.”

In an emergency court filing Thursday morning, attorneys for the former president and his associates cited an “urgency” that required New York’s higher courts to step in. They want an appellate judge to commence an “Article 78 special proceeding” against Justice Arthur F. Engoron, one that would force him to decimate a case brought by Attorney General Letitia James.

“Although he has yet to perform his lawful duty, Justice Engoron plans to proceed with the trial of the Attorney General’s claims on October 2, 2023—just nineteen days from the date of this petition,” attorneys Clifford S. Robert and Michael Madaio wrote.

It’s a rare move of aggression—particularly this close to trial, which starts on Oct. 2. But this has become Trump’s preferred strategy in recent months, a far-fetched gamble he’s currently trying against federal judges in Washington and West Palm Beach who remain utterly unswayed by his relentless attempts to violate their orders and delay cases

Thursday’s court filing claims Engoron and James are both acting to defy appellate orders that could narrow the AG’s behemoth bank fraud lawsuit, putting the judge in the awkward position of having to use lawyers to defend himself alongside the AG. He is expected to be represented by the local court administration’s own lawyers.

Trump’s legal team says Engoron is overstepping his authority, and they want an appellate judge to put him in his place. It’s the latest escalation against the trial court judge, who has increasingly grown tired of their delay antics.

4/11/23 Update: Former President Donald Trump is scheduled to return to New York City Thursday, 4/13/23 to sit for a second deposition as part of New York Attorney General Letitia James' $250 million civil fraud lawsuit. Trump did not answer many questions in the first deposition other than affirming he understood the ground rules and the procedures. When asked questions about his finances, Trump repeatedly invoked the Fifth Amendment and continued to do so for the next several hours.
4/13/23 Update: In a civil case, if a defendant asserts the Fifth Amendment, the jury can make what's known as an "adverse inference" & place weight against Trump for refusing to answer questions. Trump previously appeared for his first deposition in the civil fraud case last August; he did not answer anything but procedural questions, invoking the Fifth Amendment more than 400 times. It is unclear whether he will answer questions in his deposition on Thursday. Trump spent about 7 to 8 hours at New York AG Letitia James' office Thursday for a deposition in her $250 million lawsuit alleging fraud in the former president's real estate business practices. Trump spoke a lot & that James was present for part of that time. It was not immediately clear what questions Trump was asked. On Friday Trump also claimed he felt he made a solid case for the NY AG to "drop" the case.
4/24/23 Update: Cohen will be deposed by Trump’s attorneys on Friday, 4/28/23, where he is expected to answer questions about whether he ever saw the tycoon fake the value of his many business properties. According to letters filed in court, Cohen remained hunkered down in his New York City apartment for at least three days earlier this month—making it impossible for Trump’s contracted process server to place a judge’s order compelling him to testify into his hands. In the end, Justice Arthur F. Engoron intervened to rule that a simple email from Trump lawyer Michael Madaio to Cohen would have to suffice.
4/25/23 Update: On Tuesday, the attorneys representing just Ivanka, Figel & Kellogg, withdrew from the case. Three days later, Bennet Moskowitz of Troutman Pepper informed the court that he was taking over as Ivanka’s counsel & that Clifford Robert & Michael Farina, the attorneys Ivanka shared with her brothers, were no longer representing her. And asked the judge to delay the trial.
4/28/23 Update: Michael Cohen on Friday showed up for a deposition in Manhattan by Trump’s lawyers in a fraud suit brought by New York Attorney General Letitia James’ office against the embattled former president & his company.
4/28/23 Update: Trump, his three eldest children & the Trump Organization failed to turn over emails & other communications in a fraud lawsuit, the New York attorney general’s office claimed in a letter submitted in court last week. The office singled out “an unexplained drop-off in emails for Ivanka Trump” as one of the more significant issues. The letter notes a significant decline in emails turned over from Ivanka Trump, dropping from an average of 1,200 emails per month in the first nine months of 2014 to just 37 emails a month in 2016. The attorney general’s office asked Ivanka’s lawyers about the issue & was unimpressed by their response. “Not only have defendants failed to offer any substantive response to this inquiry, but there have been no documents produced by Ms. Trump,” the attorney general’s office told the judge on Friday. In response to the letter, Engoron granted some of the attorney general’s requests on Monday, 5/1/23 requiring all defendants to submit affidavits detailing how they have compiled with discovery and setting a deadline of 5/12/23 for the Trumps to turn over all outstanding documents.
5/15/23 Update: The deadline for Trump & others involved in a tax fraud lawsuit against the Trump Organization to confirm under oath that they have handed over all necessary documents ahead of the upcoming trial has now passed. In April, New York Judge Arthur Engoron ordered the former president & others who are named in James' $250 million lawsuit—Donald Jr., Ivanka & Eric Trump plus two senior executives at the family real estate business —to complete by 5/12/23 the process known as discovery by handing over information & evidence that will be used against them in trial. Judge Engoron also gave each defendant a deadline of Monday, 5/15/23, to submit a compliance affidavit to confirm to the court they had complied with their legal obligations to hand over the requested information under the discovery process, which includes every email address, telephone number or other electronic account used for communications concerning the business of the Trump Organization. In April, 2023 Trump spent several hours answering questions under oath as part of his deposition in James' tax fraud lawsuit. During his previous deposition hearing in August 2022, Trump invoked his Fifth Amendment protection against self-incrimination hundreds of times rather than answering the questions. Next hearing pretrial conference hearing (in person) on 9/18/23 @ 10am.
6/6/23 Update: A New York appeals court on Tuesday signaled it was unlikely to grant Trump's request to dismiss state Attorney General Letitia James' civil lawsuit accusing him, his family business & three of his children of a "staggering" fraud. The Appellate Division in Manhattan was considering Trump's appeal from a January lower court ruling allowing James to sue. Christopher Kise, a lawyer for Trump, told the five-judge appeals court panel that James sued too late & lacked broad authority to police a wide range of transactions that the parties thought were legitimate. But some judges suggested that James had a role & that whether fraud occurred could be decided at the scheduled Oct. 2 trial. "You keep saying that because the two parties to the alleged fraud aren't complaining of it, therefore the AG can't address it," Justice Saliann Scarpulla told Kise. "That is the argument that I'm having difficulty accepting." The appeals court appeared more receptive to arguments by Ivanka Trump's lawyer Bennet Moskowitz that James may have sued her too late. The appeals court did not say when it will rule. The case is New York v Trump et al, New York State Supreme Court, Appellate Division, 1st Department, No. 2023-00717.
6/27/23 Update: A New York appeals court on Tuesday narrowed state Attorney General Letitia James' civil lawsuit accusing rump & his family business of a "staggering" fraud & dismissed all claims against the former U.S. president's daughter, Ivanka. The Appellate Division in Manhattan said statutes of limitations prevented James from suing over transactions that occurred before July 13, 2014 or Feb. 6, 2016, depending on the defendant. The court also said that because all allegations against Trump's daughter Ivanka Trump were too old, all claims against her should have been dismissed as untimely.
7/28/23 Update: Manhattan District Attorney Alvin Bragg has signaled that he is ready to set aside former President Donald Trump's trial date in New York to make way for a possible trial related to Special Counsel Jack Smith's January 6 investigation.

The independent financial monitor for the Trump Organization told a New York judge she identified issues of incompleteness & inconsistency in certain disclosures to lenders & others by the company owned by Trump. The trial in the case is set for 10/2/23.
8/4/23 Update: In New York, Trump now faces the risk of new penalties for documents he allegedly failed to keep. Buried in a "ready for trial" notice filed this week by New York Attorney General Letitia James is a warning: She may ask the judge in Trump's October 2 fraud trial to punish Trump for the "spoliation of evidence." As defined under New York case law, "spoliation" is the intentional failure to preserve documents or other evidence for pending or reasonably foreseeable litigation. Potential penalties for spoliation include fines & a contempt-of-court ruling. But a finding of spoliation can lead to still more serious consequences. It would allow a judge to hold any missing documents against the party that failed to turn them over. If spoliation is proven, New York Supreme Court Justice Arthur Engoron could infer, in reaching his verdict, that any evidence the defendants kept from the attorney general would have been harmful to the defense. James' lawyers may also ask Engoron to draw a similar "adverse inference" from the more than 400 times that Trump pleaded the Fifth at a deposition a year ago, and the more than 500 times that his co-defendants in the lawsuit, son Eric Trump & ex-CFO Allen Weisselberg, also pleaded the Fifth. Out of some 900,000 documents that the Trump Organization has turned over to James in response to her subpoenas, only ten have come from Trump's personal files, despite the fact that he ran the multi-billion-dollar real-estate & golf-resort business.
8/30/23 Update: Trump fraudulently inflated his net worth by as much as $2.2 billion per year, New York officials said in court filings unsealed Wednesday ahead of his upcoming civil fraud trial. The new estimates came in filings from the NY state attorney general’s office, which is suing Trump, some of his adult children & his business empire for falsifying his net worth in an effort to obtain favorable terms from banks & insurance companies. The trial is set to begin Oct. 2.
In a legal filing Wednesday, James urged Judge Arthur Engoron to grant summary judgment on one of seven claims in her lawsuit — that Trump & his company defrauded lenders, insurers & others by lying about his wealth and the value of his assets. To rule, Engoron needs only to answer two questions, James’ office argued: whether Trump’s annual financial statements were false or misleading, and whether he and the Trump Organization used those statements while conducting business transactions. “The answer to both questions is a resounding ‘yes’ based on the mountain of undisputed evidence” in the case, James’ special litigation counsel Andrew Amer said in a 100-page summary judgment motion. Even if Engoron rules on the fraud claim, he would still preside over a non-jury trial on six other remaining claims in the lawsuit if it is not settled. Trump is not expected to testify in court if the case goes to trial, but video recordings of his depositions could be played.

9/5/23 Update: NY AG James wants to sanction Trump & his lawyers for repeating "frivolous" arguments, she argued on Tuesday. "The Court rejected these arguments for a second time, noting that they 'were borderline frivolous even the first time defendants made them,' & observed that reading Defendants' brief 'was, to quote the baseball sage Lawrence Peter ('Yogi') Berra, ‘Deja vu all over again,'" Assistant Attorney General Andrew Amer wrote in a nine-page motion for sanctions.
9/5/23 Update: Trump's attorneys asked (filed Mtn #25) for the trial to be delayed until after the Judge considers both sides’ motions for summary judgment, which could end the case before trial. "A trial of this magnitude should not begin in chaos," the filing said. "The court & the defendants are entitled to know the claims & issues to be tried sufficiently in advance to prepare adequately for trial." 9/6/23 Update: Order to Show Case (Mtn #25) Oral Argument requested. Judge Arthur F. Engoron declined to sign as defendants' arguments are completely without merit.

Engoron heard arguments Friday from lawyers for James, who are asking the judge to issue a summary judgment that Trump, his adult sons and his business are liable for fraud ahead of the scheduled Oct. 2 start of the former president’s $250 million financial fraud trial, Reuters reported.

Trump’s lawyers also argued in court that the judge should dismiss all the charges against the defendants, saying that most of the charges fell outside the statute of limitations and that there was insufficient evidence to bring the case to trial.

Engoron, who has said he expects the New York trial to last three months, is expected to rule on the motions Tuesday.

Claiming Enroron is biased against the former president by not granting a request to delay the trial, Trump’s lawyers have also sought to get the judge removed from the case.

After an appellate court judge temporarily halted the trial, a five-judge appeals court will rule next week on whether it should continue.
 

"When I first heard those arguments, I thought that was a joke," said Judge Arthur Engoron, who added that he has repeatedly ruled on and been upheld on some of the arguments rehashed by defense.

"The rule on sanctions is if you've been warned, don't do it. You were warned," Engoron said.

"As a lawyer, I have to make the arguments," Trump attorney Chris Kise told Engoron.

Kise earlier in the afternoon asked the judge to dismiss the case against Trump and the other defendants.

"What is happening here is what happens every day in complex business transitions," Kise said about the vast differences in appraisals for Trump's assets.

When Kise argued that no one was harmed by Trump's business dealings, Engoron offered a frank assessment.

"The fact that no one was hurt does not mean the case gets dismissed," Engoron said, adding that he believes that "fairness in the marketplace" was a victim of the defendants' actions.

Engoron told the courtroom that he intends to issue a single ruling by Tuesday that would decide the three major issues at question, including the government motion for partial summary judgment -- which could allow Engoron to decide a portion of or the entire case without a trial -- and New York Attorney General Letitia James' request to impose legal sanctions on the defendants.

When my mind is a muddle, I make notes. Here is what I have for this particular court case. Fill in/correct me if I have anything wrong.
  • NY Attorney General Tish James filed suit against DT, the three oldest children, and the company for fraudulent business statements.

  • Trump moved to dismiss the case due to statute of limitations and moved to remove the judge. Both were denied.

  • Ivanka appealed on her own, based on statute of limitations. She won.

  • Trump filed an appeal and a delay. Delay denied.

  • The decision on Trump's appeal is fuzzy.
    • Defense thinks the decision means the case was dismissed because charges are for actions that happened too long ago. Defense filed an argument that the case is essentially thrown out.
    • The AG says the decision means the case proceeds, leaving it up to the judge to rule on what charges are too old and what charges can be used in court.

  • Trump sued the judge and the attorney general, making the argument that the AG and the judge are ignoring the appeal court's decision.

9/21/23 Update: NY Attorney General Letitia James’s office late Wednesday night pushed back on Trump’s “brazen & meritless” attempt to delay an upcoming civil trial in which she is suing Trump, his business & two of his adult children for fraud. James warned a delay could cause issues with Trump’s broader court calendar, in which he is facing four criminal indictments. The trial in this civil suit was set to begin Oct. 2, but a judge issued an interim pause after Trump claimed the trial judge was ignoring an appellate ruling. The pause request now heads to a panel of New York appeals judges for a final decision.
9/22/23 Update: Judge Engoron heard arguments Friday from lawyers for James, who are asking the judge to issue a summary judgment that Trump, his adult sons & his business are liable for fraud ahead of the scheduled Oct. 2 start of the $250 million financial fraud trial. Trump’s lawyers also argued in court that the judge should dismiss all the charges against the defendants, saying that most of the charges fell outside the statute of limitations & that there was insufficient evidence to bring the case to trial. Judge Engoron, who has said he expects the New York trial to last three months, is expected to rule on the motions Tuesday, 9/26/23. Claiming Judge Enroron is biased against Trump by not granting a request to delay the trial, Trump’s lawyers have also sought to get the judge removed from the case. After an appellate court judge temporarily halted the trial, a five-judge appeals court will rule next week on whether it should continue. Why it matters: A ruling by Judge Engoron or the appellate court in Trump’s favor could quash or limit the charges against him. A summary judgment that finds the defendants liable, however, could cost Trump hundreds of millions of dollars & prevent the Trump Organization from operating in New York. Judge to rule on what charges AG can proceed with. After judge rules on charges, appeals court to rule on lawsuit.
9/22/23 Update: Prosecutors on Friday unveiled a piece of evidence in Trump's civil fraud case. Included among the many examples of allegedly fraudulent accounting practices by the Trump Organization, argued prosecutor Andrew Amer, was listing business deals between Trump Organization entities as deals with outside companies. Investigators found that Trump duped insurance companies by lying about his stash of cash,". "They claimed that the Trumps inflated the value of Trump Tower in Midtown Manhattan by an estimated $178 million by incorrectly declaring funds as 'stabilized income' when it wasn’t." “There was rampant fraud in preparation of Trump’s personal financial statements,” Amer argued to the court. “The defendants used those fraudulent statements repeatedly and persistently with banks & insurance companies in transactions seeking financial benefits.”

WHAT TO WATCH FOR:

The trial against Trump and his business allies is set to begin on Monday and run until December, though that date remains slightly up in the air. An appeals court temporarily delayed the trial earlier this month amid a lawsuit between Trump and the judge—the appellate judges will hear arguments this week, and could let the trial proceed as scheduled. While Engoron already ruled on part of the case by finding Trump and his co-defendants guilty of fraud, the trial will still go forward on other allegations—such as falsifying business records, financial statements and committing insurance fraud—as well as determining whether there was intent to commit fraud and the damages Trump and his co-defendants will face.

Another step closer to conclusion of this. The appeals court needs to rule before the Oct 2 trial. Trump is claiming the allegations are too old and that an appeals court agreed with him. The AG disagreed, so he sued the judge and AG, with the appellate court to rule after today's decision that Trump and Trump Org had indeed committed fraud, if I have everything straight. (I may not have everything straight.)
