Two of the teens, in separate interviews, told investigators that the father and the daughter were having sex when they discovered them on the playground, a law-enforcement official said.
“They indicated that the father is the one who put her in this compromised position and they took advantage,” the official said, adding the suspects say that as they walked into the playground, “One of them says, ‘We’ll take it from here.’ ”
At the arraignment, defense attorneys referred to those claims, with Mr. Montgomery saying the woman’s father should provide a DNA sample.
No one answered the door at the father’s apartment Tuesday and he couldn’t be reached for comment.
Earlier, New York Police Department Chief of Detectives Robert Boyce said the father appeared “hysterical” when he found police officers about two blocks away from the playground.
