DA STALLS FOR TIME AS BROOKLYN GANG RAPE CASE CRUMBLES

The Brooklyn District Attorney’s Office is stalling for time in the crumbling case against five teens accused of gang rape — as the alleged victim’s dad was questioned by police again on Thursday evening, law enforcement sources told The Post.

Prosecutors had until Friday to secure a grand jury indictment, otherwise the teen suspects could be released without bail. But they won’t make that deadline, so 17-year-old Onandi Brown was to be released from jail on Thursday, law enforcement sources said.

Why is the case crumbling? They either have DNA from those boys or they don't. The police said there was "no doubt" she was raped so what's the issue?
 

Lawyer for Brooklyn Gang Rape Suspect Claims Victim 'Needs Help'


The attorney for a 14-year-old boy accused in the suspected gang rape of a teen female tells PEOPLE the victim "needs help."

"She's still a child herself," says attorney Kenneth Montgomery, who represents Denzel Murray.

He would not comment on whether the victim was having sex with her father, as has been claimed by some of the suspects, according to The New York Times.

"Obviously if you listen to the reports, she's a young lady who's had tremendous adversity in her life and she needs help in several ways," says Montgomery. "So many people's lives have been affected by this, but no matter what happens this is a young lady who needs help."

Four of the five teenagers accused in the rape, which allegedly occurred on a Brooklyn playground, were released without bail on Thursday. The fifth remains in custody in connection with a separate assault case from October.

At a press conference today, NYPD Commissioner Bill Bratton talked about a video that has been retrieved from the cellphone of one of the teenage suspects, calling it a 'significant piece of evidence.' Bratton did not specify what was in the video, only saying that it was 'nine to 11 seconds' long.

The commissioner then added cryptically: 'The first story is never the last story. I think in this case that's certainly the case or will prove to be the case.'

Hmmm, what does this all mean.....?

Two of the other boys told investigators that the young woman had been having sex with her father when they encountered her in the park, which their attorneys have seized on to try to discredit the victim.

"The case is getting weaker by the minute," said Brown's lawyer, Spencer Leeds.

Leeds claimed the young woman has recanted her accusation and the lawyer cast doubt that the father is biologically related to her. The attorney also suggested that the father's behavior in the incident seems to disprove that she was raped.

The father, who admitted he was drunk at the time, told police that the teens pulled a gun on him and forced him to leave his daughter with them, officials said. He then walked into two nearby delis asking for people's phones, only to be rebuffed, witnesses said.

Hmmm, what does this all mean.....?

I think it means let DA/LE do a thorough investigation, cross t's, dot i's before they proceed further. This is a very sensitive case, and all the MSM/media is doing at this point is speculating and spinning, and it's beyond totally disrespectful. Notice LE/DA say first story is not the last story and to me, that could mean so so many things. Jmo/

Six days after the attack, in the early evening, the playground remained very dark, and even during rush hour, foot traffic around its borders was minimal. Three of the four lights attached to a small building of toilets illuminated a tiny section of the park, but on the night that the incident occurred all three of those lights were broken. A handball court almost entirely walls off another quadrant of the park, situated in a low-density section of Brownsville, from public view.
The case, with bizarre and conflicting details as if from a Richard Price novel, has emerged to highlight, affirm and upend common biases surrounding urban poverty. A father and his teenage daughter were drinking together on a Thursday night, in the park; you can hear the refrain of good liberals telling themselves that this would never happen among the chess-playing families of Park Slope. Some of the suspects said the father and daughter were having sex, a claim one law enforcement official felt the need to point out would not mean that the woman “was not a victim of a pretty horrific attack.” What seemed to go unrecognized was that if the assertion turned out to be true, she would already have been horribly victimized.

Beyond that, two of the suspects were turned in by their mothers, women clearly unafraid of difficult lessons in consequence. The gesture provided an image strikingly different from what we received at the hands of Tonya Couch, known to the world as the affluenza mom, who was accused of helping her privileged son leave the country to avoid probation for killing four people in a drunken-driving accident.

If this was a made-up lie my compassion for fake rape victims gets stiffer each time police and the public are mislead. Four were release without bail but charges were not dropped hmm... Jmo

DNA results weren't back yet. Prosecutor had a week and couldn't meet the deadline. Doesn't sound like either the woman or her father could pick anybody from the line up (although there seem to be no doubt police got correct suspects since three of them admitted they were there (one refused to talk)).
 
In regards to the prosecution of the rape case against they male suspects: It doesn't matter who she was or wasn't having sex with. (While disturbing and illegal, it doesn't matter in the prosecution of the rape case) A victims past sexual experiences are no longer admissible in court. You can be married to, and have had sex for 20 years with the man who rapes you and the case can be prosecuted. They have video that proves the male suspects where at the crime scene from one of their own phones! She was intoxicated and can not give consent legally. I honestly don't see the problem with the case. I'm concerned that these guys are back out on the streets and feel horrible for the victim having to sleep at night knowing they are out.
 
If she was having sex right prior to the alleged rape (not saying that she was, but that's what suspects are alleging) that evidence is going to be allowed in court. Rape shield laws won't apply because suspects could claim injuries were caused by prior sex and that evidence is allowed.
Then both her and her father were apparently very intoxicated, can not pick anyone from a line up (not good for prosecution).
If prosecutor were to allege rape by intoxication, it's not as simple as claiming that victim was intoxicated. They have to prove she was so intoxicated she couldn't actually consent to anything.
So none of it is simple.
 
When a woman reports just being raped and is intoxicated, do the police not do a breath or blood test for use in court if required?

If there was sex prior to the rapes then that may add a further complication that the defence could use to their advantage. If she was unable to consent to the alleged attackers, then they might suggest she was also unable to consent to the earlier sex.

Many rape victims feel like the ordeal of pursuing the case would be too much for them to cope with. I wonder if claims of the victims having sex prior to the attack are an attempt to make her feel people don't believe her and won't support her.
It also serves to portray the victim as 'up for anything' and therefore likely to accept sex from a group of underaged boys she doesn't know.

What a horrible situation. Reports being so inconsistent certainly doesn't help!
 
This case isn't necessarily over.
Prosecutor now has six more months to get suspects indicted. I hope more evidence is found on the suspect's cell phones.
