mblue, thanks for the "Family Sheds Light' article post.
IMO, it takes a lot of denial for the Richardson family members to state that BSR's Baby Bump was merely 'healthy eating' and 'curvy' weight gain.
It took a high degree of chutzpah for BSR to wear that body fitting red dress to the Senior prom when she was 9 months pregnant.
Did she assume that everyone was that vacuous? Obviously she did.

Judge denies change of venue in Carlisle burned baby trial
https://www.wcpo.com/news/local-new...change-of-venue-in-carlisle-burned-baby-trial

“Judge Donald Oda II didn't just deny it -- he ordered it stricken from the record and referred to an attached memorandum as a "self-serving recitation of facts" that posed a "serious and imminent threat" to the jury pool's impartiality.”

Perhaps this was already posted, but I didn’t see it in this thread. Bringing it up because like so many others, this case weighs heavy on my heart. I wondered if the public will ever know or even regret finding out what really happened to this newborn baby.

**Has anyone seen any updates to
1) Has the defense indeed involved it’s own experts to “examine the remains of the infant”?
2) Does the prosecuted intend to bring paternity into the case, if established? (This was the first reference I’ve seen to establishing paternity even being considered.)**

Highlights:
1) From the Defense:
•Rittgers was clear Monday: “I can tell you Brooke Skylar Richardson did not kill her baby,” he said.
•He said the defense has filed motions for a bill of particulars of the indicted charges and evidence in the case.
Rittgers said he anticipates the defense will have its own experts examine the remains of the infant.

2) From the Prosecutor:
•sometime between May 6 and May 7 -- Richardson gave birth to the newborn and caused the child’s death. She then burned the infant and then buried it in her backyard, Fornshell said.
•Fornshell would not say how long the baby was alive before it was killed, nor how the baby died. “We may never know the medical cause of the baby’s death,” he said.
•Fornshell said investigators may be able to positively identify the baby's father through DNA testing, but that his office has "some idea" of who the father may be. He declined to release the name of a suspected father

Defense seeks new venue for Carlisle cheerleader in buried baby case
http://www.journal-news.com/news/cr...ader-buried-baby-case/4dzqPB8SdoV1VN9Bp0V3HJ/

WARREN COUNTY— Attorneys for a Carlisle teen....filed a motion to have her trial moved from Warren County. The judge provided a strongly worded response.
[.....]

That memorandum apparently was four pages long and contained specifics of the case. Last year, Warren County Judge Donald Oda II issued a gag order prohibiting all parties involved in the case from making public statements about the case.

In his response to the change of venue motion, Oda said, “this case is not going to be tried in the press.”
.....added in his response that the memorandum attached by the defense “is highly inflammatory and prejudicial to the administration of justice in this case.”
[....]
The judge ordered the defense memorandum supporting the change of venue motion stricken from the record.

Oda said the case will not be tried in the press, “nor will it be tried in the pleadings. It is particularly troubling that such an inflammatory and prejudicial memorandum would accompany a motion for change of venue.”
[.....]
A pre-trial conference in the case is scheduled for Feb. 20. A hearing is set for March 14, and Richardson’s trial is scheduled to begin April 16.

https://www.wcpo.com/news/crime/def...ks-judge-to-reconsider-change-of-venue-motion

The Rittgers team filed a motion in response Friday just 10 minutes before the clerk of courts office closed asking Oda to amend his entry on the change of venue motion.

“The court’s entry, which is now available to the press, states that the defense counsel’s motion for change of venue is ‘more that a little disingenuous.’ The court’s order, which is now in the public sphere, is casting doubt as to the defense counsel’s sincerity, credibility, and truthfulness by indicating that the court is troubled by the defense memorandum,” the Rittgers team stated in the motion.

The motion notes the defense was never instructed by the judge to file motions under seal.

“Defense counsel respectfully requests the court amend its entry and order to reflect that it is not characterizing defense counsel as dishonest, disingenuous or deceitful, that defense counsel was following competent legal standards…” the Rittgers team said in the motion.

The defense team also argued, “Prior to the filing of the motion for change in venue, the narrative for the public has been the prosecutor’s press conference and the associated media coverage from the prosecutor’s selective and incorrect narrative at that press conference. If the state had not voluntarily injected into the public sphere alleged facts that are contradicted by opinions of all the experts, state and defense, there would be no need for the motion for change of venue.”

Oda has not made a decision on the actual motion for change of venue

Hearing - Defense wants Judge to reconsider change of venue.

I'm guessing the Judge didn't "reconsider" the Defense's motion for change of venue?

Next hearing I have is March 14th.

WARREN COUNTY, Ohio -- A state appeals court lifted the gag order in the case of Brooke Skylar Richardson, the 18-year-old accused of killing, burning and burying her newborn, according to the Warren County Clerk of Courts.

On Monday, the 12th District Court of Appeals in Middletown lifted the gag order issued by Judge Donald Oda in August. The gag order prohibited the prosecution and defense from talking to the media.

“To presume that there may be news coverage that threatens the administration of justice, whether that be against the state or the defendant, is nothing more than pure speculation,” the court opinion reads.

Richardson, 18, is accused of killing her newborn baby, burning the body and burying the remains in her backyard "all within a few hours" of the baby's birth, according to Warren County Prosecutor David Fornshell. In addition to aggravated murder, she's charged with involuntary manslaughter, endangering children, tampering with evidence and abuse of a corpse.

Fornshell said the baby was born at about 38 weeks to 40 weeks — full term, and the baby was born alive.

Richardson pleaded not guilty to the charges in August. Her attorney insists that Richardson "did not kill her baby."

and another article re gag order, plus a court date for Monday 3/5. Going assume she still has a pretrial hearing March 14 also.

Buried baby case: No more gag order in Skylar Richardson trial
https://www.cincinnati.com/story/ne...-gag-order-skylar-richardson-trial/384294002/

.....
Warren County Judge Donald Oda issued a gag order last year, forbidding attorneys, family members and law enforcement from publicly discussing the case. He said he feared pre-trial publicity would impede jury selection and the teen's right to a fair trial.
.....
The Enquirer appealed, saying Oda didn't follow the law. An appeals court in Warren County agreed, barring the judge from enforcing the gag order earlier this week.

The court found although Oda acted with good intentions, he didn't base his order on evidence. Instead, he relied on "nothing more than pure speculation," Judge Stephen Powell wrote in a unanimous judgment.
.....
Richardson is next scheduled to appear in court Monday, and her trial is expected to begin in April.
