If Shaffer is not death penalty qualified..perhaps they are just using him to do the prelims? and someone else will be appointed that is qualified. I believe that does happen.
My guess is that they will want to fully investigate Ces case, and any others there may be before deciding if they will pursue the DP, and he will then have to get a new lawyer if Shaffer isn't qualified.

This is a common pleas jurisdiction case, which should be handled by a the common pleas judge, not the eastern or western district judges. I don't think his trial is likely to happen here, as his counsel will probably argue that he won't get a fair jury from the community. While they can deny this, it will bring up another issue on appeal, which prosecution really wouldn't want. But we shall see.

Your post prompted me to surf to better understand the "Ohio language" for court systems as I have never followed a trial in Ohio and "The Court of Common Pleas" was :confused: me, and why the prelim would be with the district court and not the "Court of Common Pleas".

I see that that judicial term is comparable to another word familiar with trial followers for other states cases have been followed/we live in: which is Court of Common Pleas = "Trial Court" .

I also found that perhaps the reason he is with the district court tomorrow is that district courts can hear/oversee preliminary hearings (which is still showing tomorrow as shown on post #488). :moo:

So a question for those in Ohio; the district court is involved in the preliminary hearing, and then it goes back to the county court aka Court of Common Pleas? Is that correct on how it works?

his hearing tomorrow has been moved to the Common Pleas Court. That announcement was made when they upgraded his charges.

The eastern district court has jurisdiction over cases in Delta, Metamora, Lyons and the Fulton County sections of Swanton.
The court of common pleas has jurisdiction over all felony crimes committed by adults in Fulton County.

So his prelim got moved to Wauseon because his charge was upgraded to felony murder, I'm guessing. Although it doesn't state that the Eastern District court does preliminary hearings, but the Wester district court does, which services Wauseon, Pettisville, Fayette, and Archbold. So maybe the Eastern District court doesn't conduct preliminary hearings? I've never been to felony court before in Fulton County, so I'm not sure how that works.

the kidnapping was a felony 3rd degree..but still a felony. I'm not quite sure how that works but yes..a criminal trial for murder would be held in Common Pleas Court.

That's what I was thinking because it was upgraded to murder it got changed to the courthouse in Wauseon. I've only ever been there to pay a traffic ticket and do some jury duty before, so I honestly am not sure how trials work in Fulton County.
