It's a substantial charge - a 3rd degree felony. LE needs one charge to hold him on until they figure out what else to charge him with. I predict that there will be a few other charges forthcoming as well. If it follows with the Cummins case, the Federal charges will be brought to trial first.

The federal charge he could be charged with is transporting a minor across state lines for purposes of sex. It's essentially a sex trafficking charge. It's illegal for an adult to have sex with a minor in most states and so if he had sex with her after he moved her from PA he would be guilty of a federal charge. Let's see if the Feds charge him.

Otherwise, there could be other charges coming in PA as well, related to sexual contact with AY. Like corruption of a minor.

Interviews with her and assessment of the evidence will tell them more.

That is so sad. She has a lot to learn about life, she has treated her mom soooo badly.

The good news: She has been brought back safely. She doesn't want to take his calls.
The bad news: She doesn't want to see her mom.

Where will she go? And if she goes to her home (where else but there?), will she try to run away?

My heart is happy she safely home, and it also aches for her and her mom & brother.

It ain't over, folks, as we sadly know.

That poor child. What must be in her mind right now? And her poor mom and brother -- truly, they are all she's got. I hope she will think about that. This is just a sad, sad situation. I hope Esterly is at least as miserable as AY is.
 
I hope and pray there is someone in her family, Auntie, grandmother, older cousin, that can come to her aid and give her support while she sorts things out.
 
So glad to see she’s been found, safe and returning home. I hope the justice system gives KE what he deserves. I hope his wife and kids and AY’s mother and brother can recover from this.
 
Can the hospital force AY to submit to a rape kit exam??? Does she have a right to refuse?

In certain cultures; The daughters bare the brunt of having to keep up the family image or facade, honor or nobility status.

While the boys get do whatever. So this makes it easier for them to be lead astray by a sympathetic ear that is only there for selfish reasons.
 
She went to another hospital? ! That can'take be good.
Some hospitals have crisis intervention units she may be uniter evaluation especially if she is not responding to the mom.

I would assume at this point she has threatened suicide. That could be with intention or without. I hope she’s holds on so she can arrive at the point where she gets to look back and know she had the strength to make it through. And she does.

I'm not thinking that strong. She may be exhibiting depression along with emotional maybe erratic behavior, detachment from family, right from wrong That along with her history - running off to Mexico, the police episodes that she was the center of, leaving school, - maybe enough to get her a physc evaluation to see where she is in her mind and what to do next.

I feel so vad for the mom, hope she has a support network, friends or the school community's

I wondered why until I thought about some laws that the US citizen has to obey regardless of where you are. Turns out you can not have sex with someone under the age of 18 outside the US.

Protect Act 2003, used mainly to stop sex tourism of minors. But I do believe it applies in this case.

The US government can - and has - passed laws which include a jurisdiction outside of the US. The most well known of these is the "PROTECT Act of 2003", which makes it illegal for a US citizen to partake in illicit sexual conduct abroad with someone under the age of 18. In effect, the intent of these laws was to stamp out "sex tourism", and many other countries have passed similar laws.
 
Since he signed her out as her stepfather, could he also be hit with a fraud charge for however many times he signed her out as her "stepfather"? Plus he signed the initial form saying he was her stepfather. Every little bit hurts.

Yes, the Mann Act. I cited it here several pages back along with the PA Age of Consent law and the PA Corruption of Minors law. I hope they do it all -- Fed & State, because that's what he did.

Seriously. What an idiot. He smiles that smug, smile after getting caught molesting a 16year old family friend and then he thinks he can call his wife for help? He's destroyed so much. I hope he loses everything.

Its hard to understand weirdos like this. I have to hold back what I want to say about him!! But one thing I do kind of want to say is that I wouldn't chrarcertize this as a stupid, sex-driven guy thing or even truly about sex primarily.

I mean we are all sexual beings. Most of us have desires and many people can have pretty intense urges. I feel this is different.

The years of patient grooming involved and the overall detailed planning of this abduction as well as just the age of the victim - wanting sexual contact with an immature kid who has zero life experience when it comes to adult romance- that's something else.

This is predation. It's predatory. It's about a sick freak, exactly as you said, who enjoys destroying the youth and innocence of a kid. Who enjoys dominating someone young and inexperienced and controlling that person.

It's so gross. Who is turned on by having sex with a child like that? A kid who still needs reminders on day-to-day things in life. Still needs a parent. Maybe still really needs a security object like a blanky or stuffed animal.

What grown adult could be at all aroused by a kid who can't have a normal, adult conversation? It's gross.
