One thing that I don't think was brought up today that I would have liked to heard explained: I can take my laptop over to your house and turn it on and it won't download anything. I would need to connect to your network in order to get to the internet and download things. Or somebody's network. I guess there are laptops with satellite connections or whatever they're called, but did Travis's computer have that? I'm really and ignoramus when it comes to computers -- I'm just wondering how all this works.
They're claiming the laptop downloaded two (?) program updates when it was brought back from sleep mode at the scene, when it had internet connection. Then when it was powered up at the PD in 2009, they (one of the lawyers or LE) allowed them to update. Then somehow in 13 minutes JM and EF - in front of 2 defense attorneys - not only found, but then isolated and deleted 70,000 files. Or something...:waitasec:

I normally like Beth, but I sure wouldn't be asking her for computer advice. I suspect JM knows more about these issues than she does, but probably only because he's had to learn what really happened here?
 
Judges aren't elected in my country. They aren't even allowed to vote. Far better system than what we see happening here IMHO.

I agree with you - I think she is exhausted and sick of it. However I do think she should insist on basic respect from all parties and proper courtroom decorum. My DH had jury duty today and ended up on a jury for a criminal trial. He told me the judge gave the jury very specific instructions such as all men's shirts had to be tucked in, phones off, etc. (But they could bring coffee to the jury box - lol.) I think that is how a courtroom should be run.

Yes, and first and foremost, respect for the court! None of the DT or their witnesses have shown any! They are a classless lot.

ETA: But then JSS hasn't demanded it.
 
It blows my mind how easy it is to manipulate the court system--- the defense will throw any old garbage out there to deflect and distract - looking for a mistrial - it is easier with an empty-robe judge like miss stephens
 
Secret witnesses, blackout testimony, sealed everything. If you ask me this defense team should be the poster children for televised trials.

It's very coincidental that the 14 witnesses only come out of the woodwork after Martinez pointed out the flaw in argument regarding cited cases in the State's response to the last motion to withdraw the death penalty. Merely a coincidence and not some grand scheme to get a successful appeal by not presenting mitigation evidence, I'm sure. ;)

Any open network will do. There may have been one at the Mesa PD since it's publicly funded city property, but I don't know. Could also have been from a nearby house.

Gee, I don't know. I would assume the police department wants it's network password protected. But it's all beyond me.

This trial is going to drag on and on and on. Seriously <modsnip> Nurmi and Willmott are being unreasonable. Stretching out testimony for days if not weeks when it's just not relevant. Witnesses like the last trial who have no respect for the court or the process. CMJA and Maria laughing like they are in a playground. The sooner this is all over the better. But <modsnip> Nurmi wants the cash cow to keep producing milk. We've all gotten much older while he has gotten much richer.
 
probably in total if there was no good cause shown, i.e. if all these witnesses had always been known to the defense and nothing new was presented that put them at some actual legal disadvantage that would impact the right to a fair trial. The only place I practiced was in NY and there were lots of curmudgeonly judges who had NO problem ruling against anyone for anything-they weren't scared of appeals. Especially if an attorney was seen to be repeatedly abusing the system, judges would curtail their behavior by preclusion. I mean, attorneys ALWAYS manipulate the system and it's expected and attorneys indulge each other quite a bit with regard to extenions of time. But, honestly and seriously, this case is way beyond anything I've ever seen.

I really think this is way beyond any rational concern about appeals. Appeal are automatic. There is no protection from them. Appeals aren't the only concern. Proper administration of justice is an obligation too. I think the defense should be held to the case and witnesss they disclosed. They didn't need 14 witnesses in the first trial and if they felt they did in the second they had plenty of time to plan it. And there are easy actual bases to use on the merits to deny them too-I would imagine cummulative may be one. You don't have to be permitted to parade a multitude of witnesses who will all basically testify to the same mitigation, like she was nice to me kind of stuff. But I've kind of given up on this judge at this point. But I really think if she permits these witnesses and this *advertiser censored* stuff, the jury will be lost before a verdict. We've all seen how Nurmi can take a decade to elicit the simplest testimony. He will ensure this gets dragged on for months. He'll have new "experts" continue to challenge evidence from the already completed trial and relitigate that proceeding. I'm sure Jodi has no shortage of ideas for him. And the judge seems incapable of keeping this trial on track.

What are the consequences (if any) in your neck of the woods? If anything like this happened - such absurdity, what would you envision would be the response from fellow colleagues, judges, financial people for the State, etc?

Indeed. I don't know how many people use spybot - it's a nifty little utility. It's got me wondering though - when you opt to perform a full system scan, the program literally searches known viruses, worms, trojans, etc by name. You get a window with the names of the ick it's looking for at the bottom. So, it'll say something like 89% of scan complete....Zlob.download.net (just for example).

I have a 13 year old boy who downloads any free game he can find so I've had my fair share of nasties on my PC. Spybot will only remove some automatically while others can only be deleted by going into the registry manually to delete it, clearing caches, cleaning the registry, and sometimes having to repeat the process a few times over to remove all the registry keys associated with a certain virus.

Just thinking aloud, really, and wondering how spybot's files appear on a hard drive. Hmmm.

That is exactly how my teen's computer got over run with malaware---downloading free games. We tried spybot but eventually had to have a comp guy come wipe it clean because it was so over run with sexual images, like a hydra. Hundreds of images at a time by the end.

When the comp guy came and cleared it he told us that downloading games and films and music videos was very dangerous to do because of the *advertiser censored* viruses. Which was interesting because I originally assumed it came from my son going to *advertiser censored* sites, but the comp expert said NO, it is just as common on games/films to get the *advertiser censored* viruses.
 
Unless I interpreted it incorrectly, one of the computer "experts" that works with/for BN is Tony. Other than that apparently the hd that was given to the PT belonged to a Tony so who knows whether it was a client's hd or this "expert's" hd, but it's all about as hinky as JA's finger that she told RB, the day after murdering TA, she had cut on a glass while working at an imaginary place called Margaritaville.

Wouldn't the HD 'Tony" used have to be factory new and use the exact same version of operating system before transferring anything from TA's on to it for it to reflect only what was on TA's HD? I'm not understanding how Tony's anything gets into this. It should be the DT's HD we're talking about here shouldn't it?
