I bet the reason it was a secret because it was last minute.
JSS more than likely asked her several times if she was going to the stand. But, from the posts, it seems that it not even allowed?
Anyways, she's been in the courtroom long enough this go around to analyse the jury.
All the State's witnesses took the stand, now she gets to go.
Can't wait for the live version of the Juan vs Jodi cross.
 
This all makes a lot of sense to me. JA refuses to testify unless the court is closed, which would be unprecedented and come very close to violating the Constitution if JSS allows it. I bet the killer was expecting and hoping for JSS to deny her request, uphold the constitution and thus give her a stronger foundation on which to appeal, since she wasn't allowed to testify in her defense, in the way she felt most mitigated her.

What's very interesting, though, is that now that JSS has surprised everyone, including the killer, and approved her request, all of a sudden, there is a "leak", corroborated by 3 witnesses (!) that it is actually the killer who is the "mystery" witness. This is the second best grounds for appeal, since the identity was sealed and was supposed to remain a secret.

P.S. I had always strongly suspected the witness was JA, because who else would demand that the constitution itself be bent to her will? It all fits so perfectly, and shows just how desperate she is to avoid justice. An effort that's not working out too well for her, thankfully.


Hi Steve, you are making way too much sense, in a very sick sort of way. I mean, it's not you. It's that theory that the killer or DT would come up with this strategy. Makes my stomach roll.
 
Wow, interesting posts since I logged off yesterday. My mind is boggled! I am not convinced Jodi is the "mystery witness" but it sure sounds like it could possibly be so.

If it is in fact Jodi then my opinion is that "in the administration of justice" she argued that she would not be able to get a fair sentencing hearing because although the cameras are not in the courtroom there is constant tweeting to or by the media of a play by play of what is being said. I know that it would be all over the networks that Jodi is on the stand, everyone, myself for sure, is waiting with baited breath to hear what she is going to spew this time around. I know the jurists are not to read or watch any reporting with regard to the case but Jodi being on the stand and what her testimony is would surely be everywhere and much much harder for a jurist to avoid, so perhaps that may have been her argument. The media has pretty much portrayed her as a lunatic, murderer, liar, basically exposed her for what she is. Moo, Jodi hates the media and probably through a big, big, Jodi fit insisting that she needed to testify in secrecy in order to protect the jury -and at the same time get back at the media by denying them what they have all been waiting for. She is very calculating and obviously loves to get even when wronged, as Travis sadly learned.

Anyway, just speculation here. I think if this "secret witness" is on the stand for the next 18 days then we will surely know it is her.
Maybe that is why the networks got out of there the other day. Nothing to hear, nothing to see for awhile.
 
Well I will give it a shot. Could JA claim, among her many other alleged victimizations, that she was sexually abused by her father thus allowing her special consideration such as a rape victim would receive? I actually feel like I am insulting my own intelligence asking this and feel like I am grasping at straw lol, but I CANNOT find a reasonable explanation as to how, if it is indeed JA testifying in secret court proceedings, the Judge can defend this unprecedented decision. I also find it hard to believe that, albeit to a much lesser degreee, Troy, Jeff and Erik would report that it is JA if they didn't trust the sources. Thanks

Just how many times are the jurors and public supposed to believe "the truth" will change in this trial? Showing up at her penalty re-trial with a new story is beyond ridiculous imo.
 
Read an article written by Keifer where he says 'Travis, who counted Arias among his lovers' and ' witnesses and attorneys were harassed and threatened' Biased much?

The only person who was arrested for making threats belongs to the Arias fan club. What hope is there for truth and justice when the Judge herself seems to advocate secrecy and members of the media are biased and championing the cause of a convicted murderer?


Travis isn't here to defend himself against MK's lies. So sad. And no one has been threatened. Though I would like that idea , especially the defense experts who lied under oath.

Because this secrecy is starting to feel like a scene from a Russian courtroom, my nickname for this witness is Boris Badenov--the spy from Rocky and Bullwinkle. IF it is revealed that the witness is female, her code-name shall become Natasha Fatale.

In all seriousness--I just don't understand how this witness will be referred to from this point forward. Will Monday come and court will proceed as if nothing happened? Is it possible that after Juan has the opportunity to cross that the witness' testimony will never be mentioned again? :waitasec:

Therein lies a huge problem for JM. How will this secret testimony hamstring his ability to move forward with his rebuttal?

Jodi was caught with her pants down, when JSS granted her dark courtroom request. She is not "ready" yet, hence the delay?

Sorry you find it inappropriate, but this was just a twitter message from the media to the judge. The forceful adjectives and nouns used in this photo are fairly common and are in no way vulgar in its present grammatical form of speech in this context.

Let me translate the this for you “I will never forgive your behind for this nonsense, this was some messed up obscene nonsense”, does not change its meaning because the message is not meant to be personal nor offensive. Just sounds better with expletives, as the media is angry, but so are we. lol

In contrast, JA, the things we have witnessed she's said and done, now that is repulsive.

Poor Travis, those five months with CMJA must have been the longest, most frustrating, time of his life. Now, that manipulation extends to his family--my thoughts and prayers are with them.

Regardless of the continued stunts by CMJA and her defense team, I have faith that this jury and Juan will prevail with justice for Travis and his family.

ICAM. And I have faith that the jurors will balance whatever is said by the secret witness against the VIS they just heard. It will be painfully clear which words come from the heart and which words come from the mouth of a killer.
 
Read through the posts from the last few days. Interesting to watch the speculation at the beginning of all of this.

Because everything related to this recent development of shuttering the court in darkness is now sealed, there is no way to know what Nurmi argued as the basis for making such a request. Perhaps things will become clearer after the issue is appealed and hopefully there will be an end to all of this secrecy.

This whole case has been nothing but twists and turns that defy both logic and usual court proceedings. Throwing out some random pieces, I still cannot connect the dots:

  • On 10/6, Arias tried to submit a written pro per motion to the court, but was quickly shot down because she was no longer representing herself. Stephens said another judge would hear the motion and this disappeared off the radar, never hitting the docket.
  • A new pro per motion dated 10/20 was recorded on the docket on 10/30. The motion to change counsel was heard ex parte and a ruling was made. Since Nurmi is still acting as counsel, it appears that this motion was denied.
  • Nurmi and Arias cited strategic differences for presenting the mitigation case. Is her testifying at the heart of this?
  • The timing of the motion to seal the court is suspect to me. If Nurmi knew of concerns for this witness, why did he wait until the last minute?
  • The fact that JSS vacillated with protecting this witness or their testimony seems odd. The initial announcement was that testimony could be viewed from the overflow room, and ultimately ended up with everything shut down, including the transcript being sealed until after the verdict.

For those posters living in Arizona, what is the media coverage like now? From what I can see on the web, there are not many outlets covering this now and it seems like the audience is now mostly trial watchers and not a large part of the general public.

My sense is that the direct parties in this have lost perspective; what testimony could possibly be so explosive as to make Arias the center of the universe where tainting of the jury is almost guaranteed?

He wouldnt be able to do it in open court. If the appeal by the media fails, I'm afraid we'll be looking at a closed courtroom for the rest of the proceedings.
 
If it's a scheduling issue, I shudder the thought to consider maybe they will "pepper" their case with JA testimony and they "needed" to get her on prior to another witness,then plan to put her on again, then another witness, then again then basically giving all of the jurors a lifetime of PTSD.
 
If my above theory is correct, it also shows JSS is not the fool some are making her out to be, and is not in any way in the killers pocket. She's onto her, and one step ahead, blocking any doors to appeal the killer tries to pry open.

I've been wondering about this myself. Some of the things that JSS has done during the retrial seem to be a matter of calling JA's bluff ("You think demanding to act as your own attorney will get me to dismiss Nurmi? Think again.") But closing the courtroom seems to be going a little far.

If The Court of Appeals doesn't overturn JSS' ruling, it's possible this testimony could remain sealed until JA's appeals are heard and ruled on, imo. I believe her goal is to never let the public see whatever she plans to lie/admit to during this retrial.

Your last sentence...how did the networks know? This is very bothersome to me. Since no one in the courtroom but staff, attys a jury and JA, why were there leaks to the press? And how could CNN know in advance? Again.....is there a justice system in America anymore? Think of it! And are the judges and prosecutors a part of it? Too scary for me to entertain.

I just noticed at the bottom of the page we can see who is logged in. I am NOT actually sitting here logged in 24 hours a day, I just always have this page open on my iPad and hit refresh when I get here. LOL
