The whole X on the door thing and the ridiculousness that ensued on FB after the news report came out last night made me so livid that I had a very difficult time finding sleep. People can be any thing or any one they want on the internet. It just baffles me when so many choose to be stupid.

Anyway, I thought I'd share some quotes that I found fitting. (It's how I keep myself grounded :))

The shops are called live/work meaning there is a residential unit above the shop. The rear entrance is for residential tenants if there is one. Retail/shop entrance is on Howard (front). If he exited out the back it is plausible to not notice anything for a year on the other side of the door. He doesn't use that door as an entrance.
 
I don't really see how what Tammy said on her FB account will be allowed in trial, or will help the prosecution. I am specifically talking about how people say she taunted the family, by posting Sidney's tattoo, etc. Just people think you have no tact doesn't make you a murderer.

Perhaps it could be brought up in the penalty phase as...what is the word...circumstances, but since she never directly contacted the family, I'm not sure it would be allowed.
 
The only time I can recall having spoiled meat and not knowing it was when my cats managed to unplug my chest freezer. I smelled an odor in the basement but couldn't find where it was at first. All I can say is that's some nasty odor!! I opened that chest freezer and started gagging. I can't imagine it being on the kitchen counter and not noticing it. Potatoes...not sure why they were cooked, but the meat wasn't. Doesn't add up right to me. I've had cooked potatoes in the fridge but no idea how long it would take to mold as they don't last long enough around my house. Sitting out on a counter...again, no idea. I might have to do an experiment and see! :D Maybe just a small bowl of them, and pray the police don't show up during that time or you all will have to be my witnesses! :D

I posted this yesterday, maybe in PL? we had pork loin & new potatoes, somehow (teen boys!) it got put in the oven... we went camping for 5-6 days, a few days later I opened the oven and found it, ewww!! pork was covered in a fuzzy gray mold, but I don't recall the taters having any mold on them. could have to do with method of preparation.

Yes, the kidnapping charge makes it possible. However, after reading State vs. Curry, the "Hand of one is the hand of all" law is not as cut and dry as the information in your link.

Will a gag order be issued in this case, possibly on Monday? I know it forbids LE from talking about the case, but what else does it do?
 
First of all, Good Morning everyone.
Today is Friday, March 14, 2014. The last business day before the Ms are set to appear in court.




I also fear this.

I am not sure if it has been stated if they will be tried together or separately.

If they are tried separately, I would think that any competent defense attorney could get them off.

Lets face if. If there were two people there, the only way we will know beyond a reasonable doubt if they both *equally* participated is through a confession. And I don't see that happening.

Therefore each defense is going to try and put the blame on the other. And unfortunately, that is enough cause in and of itself to find reasonable doubt.

The defense attorneys don't have to prove their clients innocent, they just have to prove 'reasonable doubt'.

Maybe that's why (so far) it isn't a death penalty case. Maybe LE has a good idea of who committed the actual offense and how it happened, but can show that even though they may not particularly know who's hand 'did the deed', but they were both knowledgeable of what was about to happen to our beloved Heather.

To me, it makes sense. I feel a jury would be less likely to sentence one or both of them to death not knowing who actually took her life, but would be more inclined to hand down a sentence of at least 30 years knowing they both conspired in the plot.

This is why I hope what ever evidence LE has is solid as a rock.

Since we don't have Heather home, I think the only thing that could break my heart worse is seeing one or both of these (insert one of many explicatives here) walk away from this, free.

IMO, anything short of bringing Heather home and laying her to rest peacefully is unsatisfactory. And (god forbid if they hold out for that long) I hope its taken into consideration during the sentencing phase of this trial.

Please give us Heather back...

PS. This black jeep seems to be a reoccurring vehicle. With as much community support behind the Elvis's, I don't think it will be long before they pinpoint it. And I think they owner of the jeep isn't very bright (I won't go into why I think this), therefore I think that narrows down the field somewhat. IMO, whoever runs the TM and SM are innocent FB page, and the owner of this mysterious black jeep are either closely acquainted, related, or one in the same. I don't think LE will have to look too overly hard to figure out who this person is. In fact, they may already be on LE's radar...

direct evidence n. real, tangible, or clear evidence of a fact, happening, or thing that requires no thinking or consideration to prove its existence, as compared to circumstantial evidence.

This evidence requires no assumption by a jury. So they have got to have something strong. IMO.

JMHO and all.

ETA: I do agree, though, that it would be a stronger case if they were tried together. And I think it's possible they could be.

The plan need not be derived far in advance, only thing that sets it apart is that it not be in "the heat of passion". So if they conferred in any way, it was a plan. JMO

If the video is pre 2/21/2014... well, anyone of the main subjects could have taken it and or originally posted it on that Call Da Popo FB page.

It's weird how the article keeps getting changed. The articles used to say that he hadn't used the back door in a year, so some people thought that perhaps it meant he didn't see part of the door, and lo and behold, the article is then changed to say just that. IDK...
 
This may be a little off topic, but I am wigged out by the "indecent exposure" events (not to minimize the horror of murder of course!). It just seems so odd... were one or both of them naked in public? Having sex in public? Has anyone heard any more information about these charges?

Trying to figure out if they are related to Heather's disappearance. Since they were "indecent" they must have been in public where other people would have witnessed them? Strange...

IMO, this is over kill. There was another quote that said he propped it open sometimes for air. As another sleuther pointed out, it was an exterior door that lead to two inner doors, one for an apartment and one for his business. That means these doors would have been locked. Meaning the exterior door didn't necessarily need to be locked. And if it did it could have been self locking (especially with an apartment), TE may have just let it swing shut that day without even looking at the back of it. So even if he exited out the back, he still may not have seen the back of the door.

How often do we take notice of things in our everyday life that are always there, if it's not necessary to take notice of them... until there is a reason?

As someone who is diagnosed with both bipolar and borderline, there are a lot of misconceptions here that are hurtful. Then again, as a borderline I take everything to heart. The media does a horrible injustice with the broad brushes it uses to paint people, often incorrectly.
