I read that earlier, so sad. I always loved James Garner. If anyone could be immortal , I always thought it would be him. But in reality, we all know that can never be the case. God Bless James Garner, he was one of the few, a truly, real authentic man, and an understated asset to the movie industry. IMO
 
Amicus briefs are filed by "a friend of the court" ie., interested parties, aren't they? I think that's what many interested parties did when Az SB1070 was challenged by the the court system?

Yes, you're right. What I couldn't figure out was what the thing about deposing somebody was all about. It seems very unlikely to me that anybody would waste time deposing the nutjobs who filed that amicus brief. And yet that's sort of what is implied. Sigh. Well, I guess we will find out.

Wouldn't that amount to them submitting a false document to the court which essentially would be interfering with the sentencing process of this trial. Could that be a cause to bring charges against inmates who are already in prison and this is why they are requesting a deposition? While they have ignored these filings in the past I think this judge has had enough of the game playing. jmo
 
Just made a long post but it said I wasn't logged in. Oh well. Don't want to repeat it. Just a question. Could her former lovers now testify for the prosection during the penalty phase? The last penalty phase was underwhelming. And surely those guys won't be afraid of her now that she has been found guilty.
Just seems to me they need to man up and tell the courts what a stalker and psychotic human being she was even before meeting Travis.
 
Sorry you lost your long post, Curious. So maddening. One of the killer's complaints was Nurmi's failure to procure witnesses who would mitigate her guilt. During the long monthis leading up to May, 2013 she could have herself initiated indirect contact with these phantom defenders by using her mother and other family members, plus cyber supporters as intermediaries. We don't know if she made such attempts. We do know she expected Nurmi to find them and recruit them. We also know D.B. and P. were no longer willing to speak in her behalf once they learned the full extent & horror of her crimes. There was nothing the defense attorneys could do to make them testify for her. It seems extremely unlikely that she will have better luck this time around with people who actually knew her. As you say, maybe the prosecutor will be able to make use of figures from her past instead. So the killer will resort to professionals and those she has met since indictment. She will also have relatives on her side but their value is suspect as they are always considered interested parties.

Do you think she will represent herself in the end or fail miserably as she did in her first try? And if Nurmi (by order) has to step in to salvage her self-styled mitigation, what will ensue since they detest one another? We know she will extol her own virtues because of the eulogy to them in her allocution and we also know how that puts people off, including jurors. She feels sorry for herself, she also considers herself the absolute It of Now, and she claims to have a good and pure heart. What an unconvincing piece of fiction.

I just posted a long reply to your thread and it didn't post. Even though I was logged in, I kep getting a message saying I am not. Until the administrators can correct this error, I don't think I will try anymore.

I don't know. It's possible they COULD, but it sounds like it would get into those guys demanding a chance to prove their hilarious accusation -- I just see it as going on forever, just like everything else relating to this trial. The thing is, the amicus brief was removed from the court record because it wasn't filed according to court rules. I think the deposition is of somebody else, but I don't know who or why. JMO

BTW Lambchop, I've always wanted to say you have the best signature on Websleuths! One of these days I will steal if from you.

Ran some errands and came back and thought I would try to post again. I am glad this trial is going forward. I would like to see Travis' family get justice. The convicted killer thrives on attention but no, I do not think she will be allowed to represent herself this time. I am hoping JSS can stop that from becoming an issue.

In the first trial I felt Nurmi was somehow pulled into her game. I think he truly does detest her now. Doesn't everyone? It would be nice to see them remove De La Rosa from the case. She appeared so unprofessional. Not sure how Wlmott will come across this time around.

I would like to see the penalty phase televised, even though the killer loves the attention. I am hoping that Juan Martinez will do his best to find an intelligent jury and maybe they could choose a woman as foreperson this time.

It will be quite interesting to see the dynamics between Nurmi, the killer and Wilmott this time around.

I am hoping too, that Juan can locate her former lovers and that they will testify. Something about DB was off. Surely if he feared the killer, he won't have to anymore. After all this time, I would think that even some family members would be willing to testify for the prosecution. Yes, she is their daughter/sister/niece, etc. but it appeared they were afraid of her as well.

One thing is for sure, the killer can no longer bluff anyone. Her desires are all too transparent. She has proven time and again that she cares for NO ONE.

I'm glad your post "took"! As you say, the killer can no longer bluff anyone. The judge must know that she is the same deceiver she was when she & M.M. trumped up evidence against Travis before. Why should Judge Stephens entertain her act a second time? Arias made a great show of chumminess with Willmott in court. She and Willmott must have fallen out since last year. If Arias is refused the privilege of self-representation, there will be awkwardness in that relationship too. I do think the killer blames the verdict of aggravated, premeditated murder, not on her acts and planning but on her attorneys' failure to get her off. Just as she criticized Juan Martinez in her Twitter account, she finds fault with her own lawyers and she does this regarding the way they all practice law. As though she were the authority. What a turnip head!
 
I hate losing post, so I started to do it in an email and send it to myself. But I've seen the new do auto save, but I don't know where it is saved or how to retrieve it. I tried doing it in word note pad what ever is loaded on my laptop, and I name the damn thing, but can never find it afterwards.
 
Just lost my entire post too. It had to do with defense arguments in their motion to ban cameras. The argument was that live streaming coverage produced threats against the lawyers and ALaV, Patti W. But does delayed video of courtroom action solve the problem? Some members of the public will still feel incited to make threats. We also know those two witnesses had other problems; they have refused to return. I think the court is interested in protecting the verdict and the re-trial from outside influence, even though threats may come. They will be tardy as to the proceedings.
