Everyone, no matter where you live, wear blue tomorrow for support of Justice for Travis Alexander.

What I wish for the Alexander family tonight:
blue2-smiley.gif

God grant me the serenity
to accept the things I cannot change;

courage to change the things I can;
and wisdom to know the difference.

Living one day at a time;
enjoying one moment at a time;
accepting hardships as the pathway to peace;
taking, as He did, this sinful world
as it is, not as I would have it;
trusting that He will make all things right
if I surrender to His Will;
that I may be reasonably happy in this life
and supremely happy with Him
forever in the next.
Amen.
~Reinhold Niebuhr (1892-1971)

Amen!

Ambien post alert (it always makes me get all sappy): You guys are the best over here at the Sidebar. I love the other chatty/debating thread, too, but I always feel at home over here with Bernina. Bernina and Yes/No take such good care of us over here. It's been a rough ride and tomorrow's shenanipants will soon be upon us.

(I'm secretly hoping for a huge, HUGE, huge ice storm tonight so I can ditch work and hang out with you guys in my pjs during the madness tomorrow. Shhhh, don't tell my boss.)

Hugs to my (((sidebar peeps))))

My final answer is JSS will not give Jodi LWP. The only way she'll ever get out is on a gurney. MOO

A great HBO special I have been watching. It is a 6 part documentary on Robert Durst.
called

"The Life and Deaths of Robert Durst”

OMG. This guy was a serial murderer IMO. The only thing he actually admitted to was cutting up and disposing of his neighbor but get this....he never admitted to killing him. LOL

IMO, he also personally killed his wife for sure, which started his mess.

Then I think he ordered a contract killing of a lady he knew in California because she knew he killed his wife. That 1 is controversial because that lady also owed a lot of people money, so there is some question whether Durst did it.

Anyway, the 6 different parts have been on HBO the past few nights, so if you can DVR or watch it, it is done really well in true documentary fashion.

The guy is real scary.
Oh, and I forgot to say. He never went to prison for any of it. He has so much money, he hired good lawyers and got off.

Heres an article about the documentary that is showing on HBO

I don't get HBO. Wonder if it's on Amazon or Netflix. Sounds interesting though.

Everyone, no matter where you live, wear blue tomorrow for support of Justice for Travis Alexander.

It would be wonderful if all of Travis's friends and supporters could escort the family out of the courthouse and encircle them with love. Heck, all of Phoenix could come out in support of Travis and his family. Does anyone know if Travis had a favorite song...or if there's a special prayer that means a lot to the family? It would be wonderful if they could not only feel the love of others...but see and hear them as well. I know they have one another, but they also have the love and support of others. Justice for Travis was important to so many.

PS- and I will be wearing blue!

Ambien ? Haha, sappy you say. I don't think I've ever told you guys here my Ambien experience.

So it was like the first time I had ever taken Ambien, and I guess you could say that I didn't follow the instructions or even read them for that matter, so I had absolutely no idea what to really expect. I just figured I could take it, and in a little while 30 minutes to an hour or so, I'd feel drowsy and sleepy and just go to bed. Well, come to find out Ambien acts a little faster than I expected.

I can honestly say this... I don't remember a thing after I took that Ambien that night, so all I have to go on is what my husband told me the following day.
He always goes to bed before me, and according to him, I woke him up as I was just standing beside the bed saying repeatedly, " Is this my bed, is this my bed, is this my bed ? ". :crosseyed:
After that, let's just say that I generally avoid taking Ambien if at all possible. :giggle:

Today was a hard day! I'm so glad I didn't have to go it alone. Thank you for letting me be here.. a part of your group! = )
Tomorrow is a new day..
Tonight... Prayers for The Jury and The Alexander's
Sleep Well All.

According to Court Chatter, the jury was taken out a different exit. They did not pass by the Arias family.

You know, I've been thinking about this. They didn't know the Arias family was there, maybe they asked to be taken out the other way because the Alexander family were sitting there the previous days. :/

My final answer is JSS will not give Jodi LWP. The only way she'll ever get out is on a gurney. MOO

I agree.
I know many of us, including myself, have justifiably criticised JSS for her handling of this case. But the one thing that I think she will get right is she will give JA LWOP.

I've always felt she will do that part right.

The part where she struggled was being so afraid of future appeals, that she went way too overboard with allowing the DT to get away with "murder" again.

It really is unfortunate too that she was like that. Because I honestly think that the jury was affected by all the crud that the DT was allowed to bring up. False child *advertiser censored* allegations, etc. We will never know if a stronger and firmer judge may have ended up with a different jury result.

Oh well, if the jury puts it in JSS hands, I feel pretty confident she will give her LWOP.

I just hope she doesn't make like another 1 month delay before she schedules her sentencing hearing. She knows this case even better than we do, so I see no reason why she should not be able to have the sentencing hearing right away.

She would have already had to been thinking about what her sentence would be if it gets put in her lap, so she should already know what she is going to do. There would be no excuse to have a lengthy delay before sentencing. If there is a long delay before sentencing, I will be very upset. Mainly feeling so sorry for Travis family.

They need this madness to end.

This trial has been ridiculously long and has had a ridiculous amount of "garbage" allowed to be brought into it. It has been appalling what we witnessed.
Which ties back to why I feel a different judge very likely could have ended up with a different and quick verdict from this jury.

Oh well. It is what it is.
Sorry kind of got on a rant there. :)

VERDICT IN JODI ARIAS CASE? Not Really Jury is Hung…

"...” Oh hey you special little snowflakes. I know you are trying ever so hard to reach a verdict. I am going to give each of you a gold star! Your opinion is your opinion and you don’t have to change it. But hey, if you feel like it, why don’t you identify areas of agreement and disagreement and relate to law. If you still don’t agree you can write me another note and I can answer your questions. No pressure. We have all the time and money in the world to wait for you. Do some yoga. Meditate. Write a poem about your feelings and let us know. *smooches*”..."

GOOD MORNING < I wouldn't want Laurence to accuse me of being biased :wink: (even though I am)
Here is an excellent read from over in the retrial thread and posted by a member of ours that is also New York attorney. I brought it over here so everyone could read it.

I tend to agree-the "attitude"

exhibited by the trial management skills of this judge, combined with the the excess of testimony concerning the victim rather than the defendant, may have tended to skew the perception of the jury here as to what the actual issues were. I have a legal background and I found it incredibly difficult to reconcile the fact that this was supposed to be a trial about whether there was sufficient mitigation to spare the life of the defendant with the actual proceedings which focused on proctorial misconduct, *advertiser censored*/child *advertiser censored*/computer evidence and the psychological "experts" who focused on the psychological makeup and tendencies of the victim rather than on the defendant. I really believe a different judge may have made a difference. This should never have taken this long. The scope of evidence and testimony should have been limited. To allow the focus of so much of the mitigation testimony to be on the victim presented a false picture of what the proceeding was about and what mitigation is. But how would the jury know? If 90% of the testimony is about the victim why should they be thinking about heinous the crime was and how the defendant lacked mitigation.

Defense experts should not have been attempting to "diagnose" the victim which is the reality of what they were doing despite their claims otherwise and despite the fact that I doubt the standards of their profession would have allowed such a diagnosis on a deceased person via selected e-mails sent by a victim to the person who murdered him. I know for sure victims rights were not advanced by this process. And the guarantees of due process for the defendant are not a license to "convict" a murder victim on charges never leveled against him. All along Nurmi's strategy was to wear down the jury, to drag this out so that any serious urgency was negated and to confuse the jury with regard to who was on trial for what. And this judge let him win time and time again. He is simply getting the mistrial and thus life sentence he has bargained for all along one way or another. And I do totally blame this judge.

I am not one who thinks JSS is taken in by Jodi or has any sympathy for her at all. She acknowledged as much when she permitted the absurd secret testimony but noted that Jodi was being manipulative. Yet she allowed herself to be manipulated. Over and over. I think she lacks confidence in her decisions. My experience with tough NY judges was that they never lived in fear of appeal. They made what they felt were the correct decisions and let appeals lie in the future. They had no qualms about time limits and holding both sides to schedules. Once the DT sensed JSS's uncertainly they took full advantage. She has aided and abetted their strategy.

Personally, I don't care what sentence Jodi gets. Either way her goose is cooked. All I cared about was the 1st degree conviction. But I felt the victim's family deserved to get the DP they wanted. This whole process has been absurd-this murder occurred in June 2008 people! That family has gone through way too much. I agree with KCL and others that victims rights needs some work in AZ if this trial is an example.

Interesting reading (Wendi Andriano's jury was given the "dynamite" instructions and came back 2 days later with the death penalty)

STATE v. ANDRIANO

"...4. Jury coercion

¶ 53 Andriano argues that the trial court coerced the jury's death verdict in two ways when it gave an impasse instruction:  (1) by giving the instruction before ascertaining whether the jury was truly deadlocked;  and (2) by improperly instructing the jury about its duty to deliberate.  “In determining whether a trial court has coerced the jury's verdict, this court views the actions of the judge and the comments made to the jury based on the totality of the circumstances and attempts to determine if the independent judgment of the jury was displaced.”  State v. Huerstel, 206 Ariz. 93, 97, ¶ 5, 75 P.3d 698, 702 (2003)....

Think I watch a program about him.

IN CASE YOU DIDN'T ALREADY KNOW
THIS LITTLE TIDBIT OF TRIVIA,
ON JULY 20, 1969,
AS COMMANDER OF THE APOLLO 11
LUNAR MODULE,
NEIL ARMSTRONG WAS THE FIRST PERSON
TO SET FOOT ON THE MOON.

HIS FIRST WORDS AFTER STEPPING ON THE MOON, "THAT'S ONE
SMALL STEP FOR MAN,
ONE GIANT LEAP FOR MANKIND,"
WERE TELEVISED TO EARTH
AND HEARD BY MILLIONS.*
BUT JUST BEFORE HE RE-ENTERED THE LANDER,
HE MADE THE ENIGMATIC REMARK -
"GOOD LUCK, MR.
GORSKY".

MANY PEOPLE AT NASA THOUGHT
IT WAS A CASUAL REMARK
CONCERNING SOME RIVAL SOVIET COSMONAUT.
HOWEVER, UPON CHECKING,
THERE WAS NO GORSKY
IN EITHER THE RUSSIAN
OR AMERICAN SPACE PROGRAMS.

OVER THE YEARS,
MANY PEOPLE QUESTIONED ARMSTRONG
AS TO WHAT THE -
'GOOD LUCK, MR. GORSKY'
- STATEMENT MEANT,
BUT ARMSTRONG ALWAYS JUST SMILED.
ON JULY 5, 1995, IN TAMPA BAY , FLORIDA ,
WHILE ANSWERING QUESTIONS FOLLOWING A SPEECH,
A REPORTER BROUGHT UP THE 26-
YEAR-OLD QUESTION TO
ARMSTRONG.

THIS TIME HE FINALLY RESPONDED.
MR. GORSKY HAD DIED,
SO NEIL ARMSTRONG FELT HE COULD NOW
ANSWER THE QUESTION.
IN 1938,
WHEN HE WAS A KID
IN A SMALL MID-WESTERN TOWN ,
HE WAS PLAYING BASEBALL
WITH A FRIEND IN THE BACKYARD.
HIS FRIEND HIT THE BALL,
WHICH LANDED IN HIS NEIGHBOR'S YARD
BY THEIR BEDROOM WINDOW.

HIS NEIGHBORS WERE MR. AND MRS. GORSKY.
AS HE LEANED DOWN TO PICK UP THE BALL, YOUNG
ARMSTRONG HEARD
MRS. GORSKY SHOUTING AT MR. GORSKY
-
"SEX!
YOU WANT SEX?!
YOU'LL GET SEX WHEN THE KID NEXT DOOR
WALKS ON THE MOON !"

TRUE STORY. It broke the place up.

:hilarious:

Another day of this. I think the jurors are frustrated and trying to do their job to the best of their ability, but how long can they keep this up. I have a feeling today will be it. It may not end up to be the verdict that a lot of people want but I think today will be verdict day. At any rate, one of the articles up thread says what I feel, although she won't go away quietly: "...In the end, what Jodi Arias deserves is to be ... forgotten.
Jodi who?..."

If she gets LWOP I could see her getting into trouble with other inmates and she might end up in solitary for the long, long term. I don't see her being a great inmate. She never had any female friends when she was living in the real world. She will never be able to get along with these females, guaranteed. She can't manipulate these females, they won't put up with her crap.
