We have been treated appallingly by the defence. We didn't deserve this. I want to thank Mr Daubermann for being neutral.

Judge says the date was chosen by Price? He did not have enough time to prepare

Price says a pre-sentence report may be necessary. He has not had time to prepare. The Judgement was long

Price says we can postpone to next week but his report might not be ready. Says Judge is not obliged to ask for report

Toni asks if she will be recorded, answer is no. Nqgeza wants to be excused. He leaves court

Toni wanted to come today to give her family some closure. She is reading out a statement

Toni is looking straight at accused, none of them can look at her.

Toni says hating them is an understatement as to how she feels. Jayde deserved more she begged for your love and attention, this is how you repaid her

Toni says Chris changed her. She used to be a confident woman. She is paranoid that Chris will send someone for her next

Toni would memorize faces and number plates. She trusts nobody

Toni has watched her parents fall apart over and over again. She has never felt more helpless

Toni says her sister was shot execution style by her own husband. They were treated like enemies by Defence

Toni thanks Daubermann for always being neutral and says others can learn from him

Toni says they should never walk free. She no longer believes in heaven and hell. It is here on earth everyday

Toni says Chris does not deserve the death penalty. As he does not deserve the peace brought by death

Toni asks Chris to look at her. Family applauds. Price upset asks the Judge how he can allow this. Court laughs at him

Judge says the witness is busy and people are emotional. She is done. Price addressing her now.

Price tells Toni he will ignore her disrespectful comments. Also feels for the family. `Someone heard saying Bulls**t`

Wow, very moving.

I hope she gets some measure of peace now knowing she has been honest and true, getting all that said and witnessed by everyone. What a courageous young lady, being the family spokesperson. Bravo!

I agree with your sentiments. It was a very powerful victim impact statement. She didn't mince her words and it's rare to hear such brutal honesty. Bravo indeed.
 
The pre-sentencing report should be interesting. I can’t begin to imagine how there could be any mitigating factors in this case.

Mitigating factors which may reduce culpability include mental problems, remorse, youth, childhood abuse or neglect, a minor role in the homicide, his background, intellectual disability or previous trauma that he may have suffered. None of those will fly, especially remorse and a minor role in Jayde’s murder.

Oh, wait, this may be one … the absence of a prior criminal record.

Chris was a prefect and good hockey player. She says he is loving and compassionate

Sister says Chris studied, then worked as estate agent then a medical rep. hard worker

Chris co-operated with police, Chris is polite. We humbly ask for mercy and a lesser sentence than life

Price understands that the minimum is life unless he can convince otherwise. He brings up case law of a person who was sentenced to death

Price says life in this country is not necessarily life. It can mean that you wont sit your full time (think Oscar)

[What a ludicrous thing to say. CP has been found guilty of premeditated murder under Schedule 4. This carries a mandatory life sentence which in reality means that the accused must serve 25 years before being eligible for parole. It can also mean that it may indeed be a life sentence. This is NOT what Oscar was found guilty of]

Price says life can be cruel and inhuman in certain cases especially if there is hope for rehabilitation.

Chris gave staff money and airtime if they needed. Price says it must also be considered that Chris has already been in prison nearly 3 years

Price now talks about mercy, says it is an integral part of our Justice system

Daubermann speaks very softly. Starts with Nemembe. He is a 30-year-old father. Finished school and was studying IT at NMU at time of arrest

Nemembe was sentenced in another matter. Was in custody for 17 months in this matter, asks Judge to take that into consideration

Sibeko is 38, three children, finished St 8. His eldest is 18-year-old girl.

Sibeko been living with his parents his entire life. He was earning R4 000pm and supported all his children

Sibeko been in custody 16 months. Sentence must reflect mitigating factors. He has no priors and was convicted only for conspiracy to commit murder

Sibeko is liable for same sentence of murder but it should not apply in this case. He states case law

Daubermann asks what a suitable sentence would be? Sibeko cannot be held responsible for the commission of murder (he was never present)

Daubermann is basically asking for a more lenient sentence for Sibeko since he was convicted of a `lesser` crime

Daubermann states case law where someone got 5-7 years for conspiracy to commit murder

Daubermann is basically saying that 5 years should be appropriate for Sibeko. He is done. Stander will now address the court for the State

The correct approach is that Sibeko did not complete his role. Minimum sentence will not be applicable. He states case law

Judge now addressing Nqgeza about Siyoni.

Nqgeza says we need to look at pre-agreement of 204 and then the testimony. Mentions his emails to Stander

Nqgeza says the email clearly said he wanted to be an accused rather than a 204.
Judge says he read all the emails, it is not what he asked

Judge wants Nqgeza to argue as to why Siyoni should be discharged in this matter.

Nqgeza says Siyoni was a victim in this case. He made it clear that he will not stick to statements and tell the truth

Nqgeza is telling Judge how Stander changed his mind in using Siyoni as 204. He says Stander knew that Siyoni would not stick to statements

Nqgeza says Siyoni testified to the best of his ability. Says he only advised Siyoni to keep quiet when State wanted to discredit him

Nqgeza says if he was in the wrong he will take responsibility for that. Surely if the State discredits their witness the indemnity is gone?

Nqgeza says court must consider the background of the matter.
Judge now talks about Siyoni

Judge says Siyoni will not be discharged. He must face murder, conspiracy to commit murder and defeating ends of Justice.
Sentencing will be at 9.30 tomorrow morning

Eighteen years (guessing they are paroled in nine) for murder? That's obscene. Why is the U.S. the only Western country that actually punishes murderers?
