3:23pm: Court has been adjourned for a 10 minute break.



3:22pm: Justice Byrne has turned his attention to the issue of "lies" and the prosecutions allegations that the Mr Baden-Clay lied about how he sustained the scratches on his face.

"It would be wrong to approach the case on the basis that, if the accused told lies, he must have killed his wife," he said.

"If you find that what the accused said about injuring himself while shaving was false, still there is more for you to consider.

"Sometimes, where there appears to be a departure from the truth, it may not be possible to say that a deliberate lie has been told ...

"If you conclude that the accused lied because he realised that the truth would implicate him in killing his wife, you would need carefully also to consider whether the lie reveals a consciousness of guilt."

Are you sure it was a caterpillar? Or was that just because everyone else suggested it might have been a caterpillar? Did you actually see the caterpillar? It could have been a spider. Or the tell-tale signs of a struggle. No, it was probably a caterpillar. Lock in c) Your Honour - caterpillar.

As for the scratches. It could have been from pruning branches. Or an overzealous Magpie. Or an unscheduled, reverse-order sh-sh-sh morning routine? Yeah, let's run with that!

He should have just said they were scratches after an arguement re Toni, A slept on the couch, then must have been out walking when he woke up, but he raised the alarm early given the fight last night. Ie A was so angry and never normally lashes out etc.
Unfortunately that would have lent credence to a prosecution theory that he had overpowered and killed her during a physical argument. He had to make a choice as to what was more implausible - that they'd had a physical altercation but he hadn't killed her, or that they'd had no physical altercation but the marks to his face were caused by some other means such as shaving.

He chose ... poorly.

I reckon there is another element in Gerards lies.. that he asks himself,..'what would a nice guy say in these circumstances?... what would a bloke with money to throw around say under these conditions? . what would a free and easy kind of bloke, with no wife or kids say in this situation? '.. then he imagines what this fictional fellow would say, ( of course, its all donkey stuff because he is only guessing what that kind of person would say, he isn't one of them... .its just a wild guess ) and then he says it!

Judge says when asked if Allison was suicidal, Gerard said no.

Judge says Gerard told her it was one motion, then said it must have been a couple. He was rushed. #badenclay

Judge says Gerard then went to see Dr Renu Kumar about his injuries. Told her cuts on face from an old razor. A "rush job". #badenclay


Hmmm, this got me thinking.

It doesn't seem like GBC was going with the suicide theory first up?
Or did he say no because it sounds like he's in denial because Allison was suicidal which he will later say?
Or is this theory put forward by GBC family members?
Was the suicide angle only suggested after Allison's body was found?

What do you all think?

I think he wrapped Allison in a tarp and dragged her down the hill to the car, put her in the car on the tarp and used it again to dispose of her at Kholo Creek.

I was also told by a reliable source, that Nigel would be charged with being an accessory after GBC was found guilty.

I don't think the purple is of any significance, purple and black are often teamed to together on fabric.

Now surely we will finally have our roundabout evidence, we've all so longed to hear!

Justice Byrne speaks of incriminating conduct. If jury decides he disposed of Allison's body, doesn't indicate intent to kill. #badenclay
