The problem is that in this case with CA-H, he had completed his sentence, he wasn't on parole, so he couldn't be monitored. The social contract, so to speak, is that if you do a crime, you do your time, and then are free. We can't monitor people who have completed their sentence.

If we want to change the process, then it needs to happen with regard to sentencing requirements/laws.
 
Went back and watched the hearing from the beginning. The public defender had not asked to be removed from the case, but wanted the judge to review some information and make a ruling as to whether she should be removed "out of abundance of caution" as to if there's a conflict of interest. Judge stated this was based on the public defender's office representing CA(H)? previously (2001). In that case, he plead guilty (with representation by public defender).

The judge stated based on his review, there is no conflict of interest and she can remain as his attorney.
 

MEMPHIS, Tenn. — Cleotha Abston-Henderson, the suspect in the anduction and murder of Memphis teacher Eliza Fletcher, appeared in court for a third time in three days Thursday morning.

Judge Montesi said it was brought to the court’s attention there may be a conflict of interest, and there was a motion to review the appointed public defender. The Shelby County Public Defenders Office in 2001 represented Abston-Henderson when he entered a guilty plea.

However Judge Montesi said there is “no reason” to disqualify the public defender. She will represent Cleotha Abston-Henderson.

The public defender requested a gag order, saying Memphis Police Chief Chief CJ Davis referred to Abston-Henderson as a “dangerous predator.”

The case is now set. Monday, Sept. 19 will be the next report date. Abston-Henderson was held with no bond. He was escorted out, flanked by deputies.
 
We are currently arguing a rezoning request in my community about ex cons. One of the problems is when a person, such as CA, gets out of prison they are a free citizen with no monitoring required since he wasn't on parole. He was a disaster waiting to happen. JMO

Well, look at it this way. What good would parole have done? On the surface, he seemed to be integrating back into society. Had a place to live, a legit job. He’s not going to tell the parole officer that in his spare time he goes out stalking women. (Assuming that he did.)
 
I suspect the incidence of this would be close to nil. On websleuths, there are multiple threads on women jogging who did not return home. Women who jog and return uneventfully don't get threads. In fact, EF had apparently jogged this route many times with no reported events. The odds of a single observed jogger being followed by a strange vehicle at any given time is very small. The anecdotal experience of websleuths posters is skewed since many are here because of personal experience with violent crime or the experiences of family members or friends. My personal anecdotal experience is that I have known more female joggers killed by drunk lawyers in traffic accidents (1) than women who have been assaulted while jogging (0).
I live in a high-crime county and there have been no results of women missing while jogging, and there are a lot of joggers in my neighborhood. I am not aware of any missing female joggers in surrounding counties or states. I know there is a similar case in Atlanta (population around 5 million). The perception that it is somehow now open season on female joggers is not backed by objective facts. This was a horrible crime, but in a country with over 150 million women, abducted joggers are a very small group. Women are still much more likely to be victims of people they know

In perspective, prior to the 24 hour news cycle and internet fora, the overwhelming majority of us would have never heard of this horrible crime.
Thank you. It is SO important to maintain perspective, in spite of this heartbreaking and maddening crime.

I am far more likely, by order of thousands (millions?), to die of obesity, depression, heart disease, diabetes or stroke if I DON’T run, than die of violence if I do. Yes, I take many precautions, but to live indoors and wrap myself in bubble wrap is not a reasonable option.

I dont think it would have done a bit of good.
 
I didn't see the hearing this morning but someone commented he wasn't cuffed or shackled? What's up with that?! This is standard procedure for violent criminals charged with heinous crimes such as this one. Maybe Tennessee does things differently? He should be restrained, imo.
 
At age 14 this suspect raped someone, most likely another child (male), younger and smaller than him. And probably not his first sex offense. This means that the suspect most likely was also a victim of SA at a young age. Once the brain has been miswired, violence is part of sexual development, impossible to undo, and difficult to control. He then committed more violent crimes and at 16, was in long-term incarceration. Who knows what sexual violence he saw, did, and experienced while in juvenile/prison.

If the public, lawmakers, judges, etc, don't get this, we won't have the fortitude to do what is necessary to protect the public, especially females and children.
This is not an issue of mental illness, misdirected anger, rehabilitation, lack of treatment etc.
This is about sexual gratification, only satisfied by violence, murder and/or inflicting pain, injury, and terror on the victim.
The hesitancy to exert lifetime controls for all sex offenders needs to be overcome. MOO

I disagree. I know, unfortunately, multiple people SA-ed as young children who have gone on to become exactly the opposite adults than CA. IMO, the brain becoming "miswired" has everything to do with the disregard of injury and lack of concern of the adults around that child and NOT the actual trauma of the assault. That's what inhibits SA victims from healing, living and loving in a healthy way. MHO

He was most certainly NOT handcuffed. Both hands were free, the entire time he was in court.

I have been reviewing cases of missing women in the Memphis area. There are several...in this particular case, the spouse expected his wife home at a specific time. He asked someone to check her route. The fact that the kidnapping was realized so fast was the evidence left, a cracked cellphone, shoes, possibly blood...if the perpetrator had not left so much evidence of an obvious crime, if the victim had been single, unemployed, maybe a few days could have gone by without reporting her missing.

Was the person her husband asked to check her route the same one who found her phone and the slides? That would certainly make a lot of sense. I've been puzzling over how anyone knew to turn those items over to him.

Not all SA victims get sexual development linked to violence, many are never offenders.

I'm talking about offenders, not survivors who never offend.

The point is he was a predator at age 14, a STRONG indicator that he was a SA victim and his sexual development was affected. He sure the heck didn't have any treatment for any crimes visited upon him. He was a career criminal starting at age 11.
Tim Bundy was a violent sexual offender, his sexual gratification depended on murdering his victims, something happened during his development, in the womb, in his childhood, not treatable.

actually, the APA and NIH both estimate that less than 20% of ALL violent crimes are committed by people with mental illness...people with mental illness are far more likely to be victims of crime than perpetrators...

there are some people in this world who are just devoid of humanity and have no regard for the rights, property and lives of others...and it is completely unfair that they make the world unsafe for the rest of us...
I was only speaking of murder and homicide of convicted individuals perhaps I should have been clearer, I do apologize.
