Authorities await autopsy in missing girl case

Investigators with the TBI believed Evelyn’s mother and grandmother had information about her whereabouts. The Amber Alert issued for Evelyn said she was last seen Dec. 26, but authorities said they weren’t sure of the date because of the mother’s and grandmother’s conflicting accounts.

Authorities stressed that the investigation was ongoing and there was limited information to provide Friday. The identity of the property owner wasn’t revealed, and authorities didn’t indicate whether there have been any additional arrests or charges. The district’s attorney general, Barry Staubus, said authorities would evaluate the case once the investigation was complete.

“Based on what’s happened tonight, there’s a lot of work to be done: forensically and just old-fashioned investigative work,” Staubus said.

According to Capt. Andy Seabolt of the Sullivan County Sheriff's Office, there were several calls in about heavy traffic in the area. He also told News 5 the property owner expressed concerns about his driveway being blocked.

If you decide to visit the makeshift memorial, the sheriff's office recommends you park at the church's lot.

TBI agent describes finding diapers, toys during search of Boswell’s home on Muddy Creek Road
Clothing, diapers, and toys were all items described by TBI Special Agent Brian Fraley as items found at a home on Muddy Creek Road during a search Friday night.

Investigators found clothing matching the description of the clothes Evelyn was last seen in, as well as other child’s clothing, toys, and diapers.

“The clothing, with the prior interview of Ms. Boswell, the clothing described in that interview was the exact clothing that was found on this child,” Special Agent Fraley said.

While testifying in court, Frayley also described finding “various child clothing, diapers, toys, that kind of thing that would belong to the child.”

Judge increases Megan Boswell’s bond to $150,000

Judge James Goodwin increased Megan’s bond to $150,000 during the hearing in Sullivan County court. It had previously been set at $25,000. She is charged with giving false reports.

Fraley said a body of a child approximately one year to one-and-a-half years old was found during a search at a home in the 500 block of Muddy Creek Road belonging to Megan’s father, brother and grandmother.

Fraley said Megan did not have a permanent residence, based on conversations with her.

While testifying, Fraley said that Megan had made an out of state trip to Texas in the fall of 2019, and trips had also been made to the Knoxville and Gatlinburg areas.

Evelyn Boswell: Neighbor calls police after memorial for deceased Tennessee tot girl expands to his property
After learning of a Tennessee toddler’s death, numerous community members brought dozens of stuffed animals, flowers, and balloons to a makeshift memorial around Muddy Creek Road over the weekend, which has since moved after a neighbor complaint.

A memorial for the little girl apparently grew so much that it blocked off a neighbor’s driveway, who asked for it to be moved.

Sullivan County authorities told the Bristol Herald Courier that the neighbor made several calls to police concerning the high traffic around his property.

“Our patrol officers have responded several times today to calls regarding heavy traffic, etc., on Muddy Creek Road. The owner of the property on Muddy Creek Road expressed concerns over his driveway being blocked and the heavy traffic.”

Happening right now: Megan Boswell, mother of Evelyn Boswell, is appearing in Sullivan County court BEFORE her next court date scheduled for May. Investigators say they found remains they believe to be of Evelyn on property belonging to Megan’s family.

Evelyn’s memorial moved due to property owner not wanting it on his land

The memorial had grown since Friday night and spread to a neighbor’s land.

The memorial’s organizer, LH, told News Channel 11 that the Living by Faith Freewill Baptist Church’s pastor allowed them to move the mountain of memorabilia to a shelter behind the church.

Moving forward, the group has decided to donate the stuffed animals to children’s hospitals to spread love and put a smile on little ones’ faces.

On February 25, Maggie told WCYB News 5, that she was planning to take a polygraph exam related to her daughter’s disappearance, but then claimed that it goes against law enforcement’s policy to give the test to pregnant women.

When asked for clarification, Maggie again asserted she was pregnant.

But on the same day as she made those claims, police indirectly disputed that she was pregnant. ...

Organizers of the memorial told News Channel 11’s Pheben Kassahun on Monday afternoon that the memorial will remain at a shed behind Living by Faith Freewill Baptist until Friday.

We continue to be in awe of our community. As you can see, the memorial to Evelyn at the Sullivan County Sheriff's Office continues to grow. Due to rain in the forecast, we will be moving the memorial in an effort to preserve it. It will now be located under the overhang at the center of the building, where it will remain for a few more days. Once the memorial is taken down, we plan on distributing the stuffed animals to agencies across the State of Tennessee that help abused, neglected, or at-risk children.

Another key moment came when Judge James Goodwin asked Fraley about statements Megan made during interviews with investigators.

“Did Ms. Boswell make any inculpatory statements with regard to the death of Evelyn Boswell?” asked Goodwin.

“Did you say culpatory or…?” Fraley asked.

“Inculpatory,” Goodwin said.

“Yes,” Fraley answered.

Inculpatory statements are legally defined as incriminating or placing guilt or responsibility.

When asked further about the inculpatory statements question, Staubus told News Channel 11 he could not elaborate further beyond what was actually said in court.

“The judge asked if there was any inculpatory information that Agent Fraley had obtained during the investigation. He said yes,” Staubus said.

"The community is wonderful. There are amazing people here," said Mendota resident DeeDee Taylor. "So, for the past twelve months, this is now the second time that Mendota has become a buzz word in a negative light."

The body of a child wearing the “exact” clothing that missing toddler Evelyn Boswell’s mother said she was last seen wearing was discovered Friday in an outbuilding on property owned by the mother’s family, a Tennessee Bureau of Investigation agent testified during a hearing Monday.

Court Documents: Megan Boswell’s attorney fights bond increase, says the state is basing amount on ‘anticipation of possible future charges’
Court documents obtained by News Channel 11 reveal more about the state’s motion to increase Megan Boswell’s bond and the response from her attorney.

The state detailed in the motion to increase bond that a child’s body was found on the Boswell’s property March 6 “in an out-building…” This is something that was not previously revealed to the public in prior news conferences about the discovery of a child’s body on that very property.

In a response to that motion, Megan Boswell’s attorney, Brad Sproles, said in part, “The State seeks to have the Court increase her bond based upon the anticipation of possible future charges. The State’s position is contrary to the purpose of a bond not being used to punish a Defendant, but to insure {sic} their continued appearance on court;”
