Ugh - just realized why this case is creeping me out so much. It's The Shining. Mad Jack Nicholson breaking through the bathroom door to get to his screaming wife and child, then grinning like a maniac through the broken door and saying 'Little pigs, let me come in...'

I think she got stuck in the tiny window. Can't recall what he used to break the door.

An axe. In the book it's a croquet mallet he wields.

IMO seemed genuine.

Related well--despite being a 'big, tough guy", was quite scared at how close he came to very serious injury. And how lucky he was not to have suffered same.
 
I'll be interested to hear what led up to the 'I'm one up' conversation and exchange of the gun.

It would be all kinds of crazy if the words/actions just came out of nowhere in the middle of dinner....

He came over as genuine and unfazed, yet baffled.. he had no idea why Darrin had bought a gun into the restaurant.. he was shocked by what happened, and I got the impression the shock reverberated for quite some time. He didn't go into the whys and wherefores of the bit where Darrin takes the blame. Oscar asked him too, because of 'the press' .. that was the reason given.. He gave no opinion as to why Darrin would take the blame for it.

The police contacted him about it, people had talked.. he got hassled by reporters, he told them no one was shot, but a shot had been fired.. but he was very aware that he , himself , escaped a serious injury.
 
That is HUGE. First of all, obviously arguing would explain the escalation. Secondly, it proves that Oscar was lying. Why would he lie? He says they were sleeping, he woke up to get the fans, etc.. No, they were not sleeping, according to the witness. It's her words against his, and you all are already uncovering other lies he has told (bail statement vs. trial). So on the one hand you have a witness who has no reason to lie, on the other a defendant who has already lied about other aspects of the night.

My concern is that the defence will produce a witness/es who is prepared to say that they themselves were having an argument that night in a neighbouring house.

As for the evidence of Michelle and Charl - I simply cannot see the point of accusing them of collaboration. Of course their accounts will be similar, they were together, of course they discussed it! It's not reasonable to expect anything else. It's just the way it is. Had they been two strangers in adjoining hotel rooms, it might be worth attacking the point, but it is what it is.

They order... Larena orders pasta. I think the meal arrives.. the gun suddenly appears being passed under the table at the restaurant. . Darrin says, as he passes it to Oscar 'I'm one up'... Larena takes this to mean that the gun has one bullet in the chamber... here ( Australia) the expression used is 'I'm one in '... next thing, kaboom.
 
Samantha Taylor's sister is there today in the court so I guess Samantha is waiting in the witness room. She could be on later if time but I doubt it now.

then.. there is a total silence.. no one says anything.. everybody in the restaurant is still and quiet...

Oscar says, Im sorry, i'm sorry, Darrin, etc.. then he gets to the main thrust.. and asks Darrin to take the blame for it, the press will be on him, etc
 
Logically the next witness may be Sam Taylor who will talk about OP firing his gun through the sunroof, as he was pissed over being stopped by police a short while earlier.

Thus Pros. wants to present a case of a pattern of great (and grave) recklessness with guns. JMOOC

You know what, that sounds like two men feeling a need to impress a young, very strong, good looking man who made them feel a little insecure....
 
Larena had no doubt at all that it was Oscar who fired the gun.. none at all. this was in no way disputed...the gun had been passed to Oscar..

That is just downright strange. Was messing about with guns just normal behaviour for Oscar and Darren then?

You have to remember this is SA, not Germany.

Carrying guns is fairly common there. Oscar is known to usually be carrying his.
Darren never thought it would be fired, and indeed several actions may have been needed to be done before it could be fired... And even issued a warning about one up.

For Darren he presumed maybe Oscar wanting to see his, and maybe show him his own or such.

Not making excuses--a very dangerous thing to do especially if the other person may have grave defects...
