*Trial continues (Day 6) (@ 9am CT) - TX - *Jason Wilder McDaniel (2) murdered on October 11, 2018, Wichita Falls) *James Irven Staley III (38 @ time of crime/40) arrested & charged & indicted (10/21/21) with capital murder of a person younger than 10, felony 1st degree murder & tampering/fabricating physical evidence. Wilder was found unresponsive the morning of Oct. 11, 2018, by Amber while she & Wilder were staying at the Wichita Falls home of James Irven Staley III, who Amber was dating at the time, according to allegations in court records. Wichita County LE authorities suspect Wilder was smothered with a pillow in Staley's home in the 2000 block of Irving Place, according to allegations in court records and an autopsy report. During the child’s autopsy conducted the day after he was found dead, the coroner found signs of blunt force trauma to the child’s head & abrasions. The coroner found indications of death by asphyxiation & signs of a possible struggle. The coroner ruled the death “undetermined,” but stated the scene was “irregular & highly suspicious of a homicidal death.”

''Amber McDaniel, Wilder’s mother, took the stand just after 9 a.m. Monday morning.

Prosecutors asked her if she smothered or strangled Wilder, to which she said “no.” They then asked her if she bears any responsibility for Wilder’s death. Amber testified that she feels she ignored every red flag she should have seen, and she has still not forgiven herself in the last four and a half years.''

''Staley has pleaded not guilty to the crime. In August of 2022, Staley’s change of venue request was approved and his trial was moved from Wichita County to Tarrant County.

Staley’s attorneys had said the local jury pool has been tainted against him due to media coverage and Facebook outcry, and the safety of Staley and anyone connected to the case was also a concern.''

DEFENSE CROSS-EXAMINATION OF AMBER WRAPS UP

Staley’s lawyers continued their cross-examination of Amber McDaniel, Wilder’s mother, on Tuesday.''
The defense played several videos of Wilder and Staley, and then asked Amber if it looked like Wilder was uncomfortable with Staley in those videos. She said yes to one and no to a few others.

Staley’s lawyers then asked Amber if she remembered reacting to Facebook posts the night Wilder died, to which she said, “no, I do not recall.”

The defense asked Amber if she ever told former lead detective Chad Nelson about the conversation she had with Staley in the bathroom the night of Wilder’s death. This conversation was when Staley mocked Wilder and told him to shut up. The defense stated Amber chose not to tell Nelson that those were the last words Staley said to Wilder. They pointed out that Amber didn’t choose to tell detectives about that conversation until later in the investigation.

Staley’s lawyers then ended their cross-examination of Amber.''
