You ask, we answer: Why was bond reduced for Maleah Davis' stepfather? Will there be more charges?
KHOU’s legal analyst, Gerald Treece, weighed in on some of the legal questions in the case.

1. Why was Derion Vence’s bond reduced from $1 million to $45,000?

Gerald Treece says bond amounts should be determined based on how likely someone is to show up for court. They should not be punitive or about how serious the crime is.

Treece says the $1 million bond amount was unusually high, and if he was the defense attorney, he would have asked for it to be lowered as well.

Attorney Thomas Burton III is representing Vence and said he intended to file a motion to lessen the bond amount, but was surprised when it was already done by a judge in Monday’s hearing.

Burton III said he has yet to receive any evidence from the state against his client, which would include surveillance video from outside the home where Maleah was last seen.

2. Will any family members be charged in Maleah’s disappearance?

Treece says people who are party to a crime are equally responsible in Texas. Although he doesn’t have firsthand knowledge of the investigation, he says charging more people is often a way to build a case against the main suspect.

“The government goes out and finds people, and works out a deal with them - especially in cases like this where they can’t find a body - to build a case based on so-called accomplices testimony. That’s what I think will happen,” he said.

3. Can Vence be charged with murder if Maleah’s body is never found?

Treece says a body is not required in order to file a murder charge. However, not finding a body makes it much harder to prove beyond a reasonable doubt that someone was killed.

Members of Texas EquuSearch said teams were combing an area near the Creepy Hollow Haunted House off State Highway 288 in Brazoria County. They would only say they were investigating a tip they had received.

“He was physically abusive to young Maleah,” said the activist, who claims Bowens knew about the abuse but didn’t report it.

“It’s a shame because that could have saved young Maleah’s life had she had the strength and the courage to get away from Maleah’s stepdad when she saw these dangerous warning signs that he was physically abusive.”

Quanell X said Bowens herself was abused repeatedly as a child and she was “taught to live with that.” He said she now realizes she should have done more to protect her daughter.

Vence’s arrest confirmed what many relatives had feared from the beginning: That they will probably never see Maleah again.

Some believe Bowens should face charges, as well.

"I believe that she's guilty because a mother is going to protect her child any means necessary,” Tamisha Mendoza said. She is the cousin of Maleah’s biological father. “I don’t care to hear that she was scared. You did not protect your daughter."

Miller knows all too well the heartache of losing a child and not knowing what happened. His 16-year-old daughter, Laura, was one of the first Killing Field victims. She disappeared in 1984, but her body wasn't found until '86.

Miller says he's hoping for a miracle for Maleah, but he knows in his heart it’s not going to happen.

Joe Vence didn’t want to comment about the details of the case but said he wasn’t worried about his brother.

“Once God is with you, the whole world, the whole city, everybody can be against you,” Joe Vence said. “We’re a strong, praying family. God is on our side. God is with my brother.“

Joe Vence was asked if he wanted to say anything about Maleah Davis, who has been missing for more than a week.

“Maleah, I love her and hopefully they get all this stuff straightened out,” Joe Vence said.

Volunteers expand search for missing 4-year-old Maleah Davis
Walking through a dense wooded area at Cullinan Park off Highway 6 in Sugar Land, volunteer search efforts for Maleah Davis lead by JM continued Tuesday.

Equipped with rainboots and machetes, dozens of people have been dedicating up to 10 hours a day, zeroing in on patches all around Houston for 4-year-old Maleah Davis-- who's been missing since May 3.

"We've been to Katy, up and down Alief. We’ve searched every park in Alief, every bayou. We’ve been to some parts of Sugar Land, Missouri City, Richmond. We’ve been to a lot of different places looking, but so far, there’s nothing," Marsden said.

Texas Equuseearch said Maleah’s stepfather, Derion Vence, who has now been charged in connection with her disappearance, may have worked a mail route in Rosharon with the US Postal Service. A representative for USPS confirms Vence was an employed carrier from June 2017 to August 2018.

Maleah Davis update: Search continues in Rosharon for missing girl
The search continued in Rosharon Wednesday for missing 4-year-old Maleah Davis.

Crews were searching near Skydive Spaceland Houston, which is in the 16100 block of FM 521 Road.

Texas EquuSearch was in the Rosharon area Tuesday afternoon searching for Maleah near a haunted house in the 12800 block of Valley Vista Drive.

Search for missing 4-year-old continues near Houston
The search for missing 4-year-old Maleah Davis continues in the small Brazoria County community of Rosharon on Wednesday as a skeleton crew from Texas EquuSearch scours the area where her stepfather once worked a mail route, organizers said.

Tim Miller, founder of the private nonprofit search group, said he and others will be going up in a helicopter around the town to see if anything turns up.

Vence worked as a mail carrier, Miller said, and had a route in the Rosharon area. Equusearch has received several tips over the last few days indicating she might be in the area, or somewhere in Fort Bend County.

The Fort Bend County Sheriff's Office offered up its helicopter to assist Miller's team in their search, Miller said.

Search area expands and gag order issued in Maleah Davis case
Texas EquuSearch is following up on tips and canvassing new search areas as they continue to look for Maleah Davis.

While the search continues, a legal order is complicating the case in court. A gag order has been issued ordering attorneys and the media to strict confidentiality of the CPS records involving Maleah's family.

The order says that if the release of this information continues, the pre-trial publicity will interfere with rights to a fair trial.

This gag order includes documents involving the family since July of 2016, so we know they had a history with CPS, but now, we’re likely not going to know any more about it.
