Exclusive: Capital murder suspect fights for her infant
Maxwell, from Muskegon, Mich., remained in the Bell County Jail in lieu of bonds that totaled $750,000. Maxwell’s pretrial is scheduled July 26.

“BELTON — Capital murder suspect Maya Maxwell, the mother of a child in Child Protective Services’ custody since his birth, is ‘continuing to fight for her rights as the mother of her child,’ her criminal defense attorney, Wade Faulkner, said.

Faulkner is not the attorney for that case, he said. Maxwell’s attorney in the CPS custody case is Brittany Darby, Faulkner said.

Although double-homicide suspect Cedric Marks, also jailed, firmly believes he is the father of Maxwell’s son, a DNA order has been issued but not collected yet by the representative for the Texas Attorney General’s office, Mike White, one of Marks’ attorneys, said.

Who will have custody?

White did know that Maxwell’s family at first expressed an interest in getting custody of the infant, but not since then, he said.

However, members of Marks’ family have continuously expressed an interest in getting the child, White said. White didn’t say who the family members were, but did say Marks’ brother, Otis Marks, was not interested in fostering or adopting the child.

Born June 2, Maxwell’s infant son remains in the custody of CPS, John Lennan, spokesman for the Texas Department of Family & Protective Services said Tuesday.

Maxwell in 2014 gave birth to a little girl and gave her 6 pound, 9 ounce baby away to a family she’d hand-picked, according to a post she made on blogspot.com.

She was also known as Maya Rady, and wrote the post when her daughter was 8 months old, according to the blog. She claimed she was an advocate for adoption.

Marks has the custody of two sons, one from his marriage with Ginell McDonough, and one born while he was in a relationship with April Pease. Marks was in the middle of a custody battle with Pease, and Pease was given custody by a judge. However, Marks was legally given custody of their son after Pease was reported missing on March 17, 2009.

Pease filed a protective order against Marks, which was extended several times before it was dismissed, when she disappeared.

McDonough was charged in Michigan with harboring Bell County fugitives from justice — both Maxwell and Marks.

Maxwell admitted in an arrest affidavit she took Swearingin’s car and drove it to Austin to hide it, was in the house with Marks when he reportedly killed Swearingin and Scott, drove with him to Oklahoma and was there when the bodies were buried.
4/3/19 Update: Indicted with 3rd degree tampering or fabricating physical evidence. Bond increased to $750K. Retrial hearing on 4/25. Arraignment scheduled on 4/26.
4/26/19 Update: Charged with capital murder of multiple persons. For both counts next hearing on 5/3. 5/3/19 Update: Waives her arraignment. In the letter sent to KWTX reporter Brandon Hamilton, Marks talks about wanting to prove he is the father of Maxwell's son in order to gain custody.

"Since giving birth, CPS took our child and placed him into foster care. Maya has no family support, but I do," Marks wrote.

On page four of the letter, Marks writes, "I am a family man first and foremost, so it is heart wrenching that our son has been here for a month and three weeks, yet I don't even know what he looks like."

A DNA test to determine whether or not Marks is the father is scheduled for Thursday, White said.

"Our son does not deserve to be a pawn...I do not want our son in this system," Marks wrote.

An attorney for Marks, Michael White, told the newspaper that his client “was not surprised” by the move and “is anticipating his day in court when his story is told.”

Last summer, Scott filed for a protective order against Marks, KWTX reported. “He told me he had killed someone in Oklahoma, but that he was able to cover it up and that he could do the same here in Texas,” she alleged in the filing.

It has been six months since accused killer Cedric Marks escaped from a Texas Prisoner Transportation Services van. Now, a former transport agent with the company is speaking.

Ray Kirwan said there were many mistakes made the day Marks escaped from their van in Conroe.

"When they picked him up and put him on that van he should have never gone anywhere but to Bell County," Kirwan said.

Kirwan said the agents were told by management to put what's called a black box over Marks' handcuffs for extra security. When they stopped at McDonald's, one of the agents opened the back door so the inmates could get some fresh air and Marks saw his opportunity to escape, Kirwan said.

"All he had to do was kick the gate and it came open. He simply stepped out and walked away,” Kirwan said. “It was that simple. There was no Houdini move to it, just junk equipment and a pickup that shouldn’t have been made."
