he must have been doing another interview. I’d anyone has seen it please send a link. I’m very interested as this calls into question his claim that TO had Samuel because of his long hours.
 
I think the keyword here is "independent verification."

In the June 1 linked article, Grandmother also says she heard him on the phone last week but we know that SO was already deceased then (i.e., court docs report SO murdered about 5/12). It would also be impossible for Dad DO to talk/visit his son on May 21.

*Arraignment Hearing (Tampering & Assault) (@ 9am CT) - TX - Samuel Olson (5, would have been 6 on 5/29/21) (it was reported by Balboa that he was taken by an unknown male & his mother from a southwest Houston home in the 8800 block of McAvoy Dr. at about 7:30am on May 27, 2021, but he had been missing for 2 weeks before this, found June 1, 2021 inside a tote bag in the Best Western motel in Jasper; LE believe he died 5/12/21.) – for *Theresa Raye Balboa (29) arrested & charged (6/2/21) with tampering with evidence (human corpse). Bond $500K.
She was jailed on 6/2/21 & was extradited from Jasper County Jail to Harris County Thursday, 6/3/21.
*Charged (7/8/21) with capital murder-under 10 years. Denied bond (7/8/21).
*Charged (11/29/20) with assault (on family). Bond $5K. Bonded out on 11/30/20. Bond $100K (set on 6/7/21). Back in jail. Bond denied.

7/8/21 Update: Charged with capital murder-under 10 years. The Harris County District Attorney's Office has not decided if they will seek the death penalty in this case. They might seek 'life without parole.' Preliminary hearing on 7/12/21 @ 9am. Tampering & assault charges: Arraignment hearing on 7/29/21.
7/12/21 Update: Murder: Balboa entered the courtroom Monday without representation & left it without a bond amount for her capital murder charge. Balboa requested for a court-appointed public defender. The judge found probable cause to charge Balboa with the capital murder charge. Andrea Beall, the prosecutor who appeared on behalf of the Harris County DA's Office, said the next step is for the case to go to a grand jury, which can take up to 90 days. The grand jury will be tasked to make a determination on probable cause. Beall added DA Kim Ogg will also make determination on whether to pursue the death penalty. 7/12/21 Update: Investigators found blood in the living room & dining room of their Webster apartment, prosecutor Andrea Beall said. TB went with BR to buy the duct tape & bin & there is surveillance video of that. Prosecutor said Samuel was quarantining with TB. She is accused of killing the boy by striking him with and against a blunt object on or about May 12, records show. New details revealed in capital murder case involving Samuel. Prosecutor Andrea Beall said she will next present the case to District Attorney Kim Ogg to determine if they will seek the death penalty on the capital murder charge.

After that, the case will then be presented to a grand jury, which the Texas Code of Criminal Procedure requires.

Following Balboa’s court hearing, Bell said she was confident she could meet the burden in this case.

“I was reviewing the evidence in terms of the laboratory evidence and cell phones that we have received, making sure that we could in fact corroborate the statements of Benjamin Rivera in regard to who was responsible for the death of Samuel Olson, and after reviewing that I am confident that I can meet my burden in this case and get justice for little Samuel,” Beall said.

Beall said the charge against Rivera will not be upgraded at this time. When asked if anyone else will be charged in the case, Beall responded, "I don't believe so."


According to the initial autopsy report, Samuel died from "homicidal violence with blunt head trauma."

According to new court documents, Sam was struck with a blunt object.
 
its probably time to get her DP panel attorneys time to prepare.

Actually, seeking DP for TB has not been announced yet.

I believe delaying the arraignment also gives the District Attorney additional time to make this determination.
