Some interesting developments as this retrial proceeds. Cory Batey is the only one going on trial at this time. Brandon Vandenburg's case was postponed because one of his lawyers is ill. This week Batey tried unsuccessfully to fire one of his lawyers. The jury has been selected and it looks like opening statements will take place on Monday.

Jim Todd, a Nashville defense lawyer and former prosecutor, said jury selection is like reading tea leaves, and it’s hard to predict whether the makeup of the jury could be beneficial to the state or defense. Todd is analyzing the case for The Tennessean.

“You pick people you hope are impartial and fair, but you also want to pick people you hope are receptive to your message,” he said. “I think the defense would hope that men would be more sympathetic to alcohol-induced mistakes and less sympathetic to the victim.”

IMO, it won't work worth a dayam if those men see their daughter or granddaughter in the victim's place.

It was all caught on video. And he was found guilty and confessed on Dr . Phil.

So the justice system is to blame for this retrial. Whomever dropped the ball and allowed this should be out of a job. Jmo.

Awful that this case had to be re-tried. Seems like torture for all involved.
 
I hope there are no 'plants' on the jury so this time the conviction (which I'm predicting) will stick. And I sure hope <modsnip> goes down for his part -- he also needs at least a decade in prison, IMO.
 
Female defense attorney's habit of saying "ok" after every answer she gets on cross-exam is so annoying. Hard to listen to.
 
Cory's attorney is on my last nerve. She comes off as unnecessarily rude when questioning Det. Mayo. "Did you take these pictures?" "Yes." "With what?" "Uh.... a camera?"

Going to be tough to listen to this trial if she talks a lot.
 
Batey's attorney doesn't have much to work with. Her client is guilty of multiple sexual offenses and she knows it.
 
Just watching it now. I was gobsmacked over the situation with the jury foreperson in the first trial. I truly couldn't believe that happened.

I'm a 70 year old white female. Cory Batey's Day 1 look would not have worked for me if I were a juror. He looks too hip, too cool, too casual for something as serious as this is. I don't think anything will change the outcome, thankfully, but if I were advising him on attire plus, I'd say go with the suit, the haircut, and clean shaved look from trial #1.
 
The audio from the video played would be enough for me to say Cory's guilty. I don't care how drunk you are, if you're having sex with an unconscious woman, and there's video evidence of the act, then you're guilty.
