    The judge said both sides will need to meet with the expert and go over the evidence now, outside the jury. They will determine what's there and not there, what's been handed over or not. #trialtweets #jimmyrodgersontrial #nbc2courtcoverage #teresasievers
 
What a crock! This public defender should be held in contempt. Do you mean to tell me that in 2019 a seasoned public defender doesn't have the ability to look at files uploaded to a system and outline which documents cannot be opened? All you have to do is outline what the extension is. For example, .pdf is a pdf doc, .xls is an excel file. If there was a file that "couldn't be opened" as she claims, why hasn't she been more specific and given the extension of the file? Further, if the FBI agent said that 100% was turned over in .pdf format (which she did, under oath) than that is the end of that. Any materials NOT included are part of the questioning of the witness. This is a bullSh$$ stalling tactic and the public defender comes across as a sniveling baby who didn't get her way on the continuance - even though Judge Kyle was crystal clear on why that was denied - so she has boo-hoo'd every day. What a disservice to the people of Florida to have such a person - so disrespectful to the court - as a public defender, paid for with taxpayer dollars.

As a florida resident, i can't believe just what a childish act she is putting on. They've had YEARS to get stuff. This is only for appeals and she knows she has a losing case. I fully expect her to lay down in the middle of court and throw a kicking screaming temper tantrum. Most UNPROFESSIONAL I've ever seen... and thats AFTER watching the CA trial and Baez. LOL
 
Tuesday, October 15th:
*Trial Continues (Day 5) (@ 8:30am ET) - FL – Dr. Teresa Ann Grace Sievers (46) (June 29, 2015, Bonita Springs) - *Jimmy Ray Rodgers (28) arrested & charged (2/23/16) & arraigned (5/5/16) with 1st degree premeditated murder with a weapon, conspiracy to commit 1st degree premeditated murder & burglary. Plead not guilty. No bond. DA will seek DP.
Trial began on 10/10/19. Trial expected to last 4 to 5 weeks. Jury: 5 men & 7 women, 2 alternates: 1 man & 1 woman.

10/14 Day 3: State witnesses: Jeffrey Conway (works for the Doe Run Company, in which JRR was a laborer). Nick Schueneman (Detective with the Jefferson County Sheriff's Office in Missouri. Was assigned to execute two search warrants in 2015). Kimberly Van Waus (certified crime scene analyst with the Lee County Sheriff's Office)-recalled to stand. Could be recalled later in trial by defense. Amy Lusk (worked as Crime scene tech for the Lee County Sheriff's Office). Lunch. Assistant State Attorney Cynthia Ross said two FBI investigators will probably be called to the stand this afternoon. Assistant Public Defender Kathleen Fitzgeorge said she has not had time to dispose these witnesses. Judge Bruce Kyle in regards to FBI witnesses. The defense is likely to depose these witnesses this afternoon prior to them taking the stand. Apparently one of the jurors sat next to someone at lunch who had info about the trial on his laptop. The juror is being brought into for questioning. Juror said he saw a photo of evidence previously submitted (a tshirt) on someone's computer at lunch. He said he requested the person to move. He said there were no conversations otherwise. No action by Judge. State & defense are deposing the FBI experts now. Judge requested this get handled and the experts testify today as opposed to holding until tomorrow. Breaking for about an hour now. Deposition completed of one expert. Spoke to second expert but not formally deposed. Defense agreeing to this as acceptable. State still arguing defense could have deposed previously. Judge asking the questions of the FBI expert on the stand now outside presence of jury to find out if bench notes are available. Linda Otterstatter (FBI analyst) is on the stand with no jury present. Fitzgeorge asks for time for the FBI witness to show her where this evidence is and the judge agrees to let that happen. Trial continues on 10/15.
*Mark D. Sievers (50) – Trial tentatively scheduled for 11/12.
*Curtis Wayne Wright, Jr. (41) arrested (10/14/15) & charged (10/20/15) & indicted (5/5/16) with 2nd degree premeditated murder. Plead not guilty. No bond. Took plea deal (2/26/16) plead guilty to 2nd degree murder; serving 25 years, waives all rights to appeal. Will testify at trials. Sentencing on 12/2.

Fitzgeorge said there was a FBI file with data that could not be opened because the defense and the state did not have the right software. "We did not receive what we requested despite my request going straight to the FBI," Fitzgeorge said.

    Both sides said they were able to speak with the FBI agent about the evidence analysis that was turned over to the state. The defense says there were some parts of the report they weren't able to access because it required a special software to open @winknews
