WHAT ON EARTH!! Someone please explain this to me anyone. So in Virgina I could break into your house if I wasnt going to commit a crime??? Well excuse me I thought breaking into a house was a crime. No? And Wes was reportedly in the AB?
WAAAAAHHH!! I'm stopping now before I say something regrettable!!

I believe the statute says that breaking and entering is entering a structure with the intent to commit a crime. The judge believed there wasn't evidence that WH was there to commit a crime... he was trying to find a jacket. Not saying it is right - just how I think it is interpreted.

Didn't this come out a while ago? Wes claims to be friends with people high up in the Aryan brotherhood hierarchy. I think he technically considers himself a "retired" member but he's supposedly been hanging out with some real rough AB guys.

I don't think it has been anything to include in discussions since it was never in MSM. Some of the other facts help piece things together too.

I'm having trouble paying my rent, feeding myself and paying my bills this month. I think I'll go rob a bank and just tell the judge that I "had" to do it. "I didn't mean it, your honor!!" :facepalm:

I think if they had evidence of that - it would make it breaking and entering. Perhaps they don't have any evidence that he was planting evidence?

If any person break and enter a dwelling house while said dwelling is occupied, either in the day or nighttime, with the intent to commit any misdemeanor except assault and battery or trespass, he shall be guilty of a Class 6 felony. However, if the person was armed with a deadly weapon at the time of such entry, he shall be guilty of a Class 2 felony.

So, I could enter your house to get out of the rain and not be committing a crime. That sounds wrong. Perhaps I am wrong.

The using would probably be the bonding part. My opinion of the initiation process would probably get me sent to band camp. The wheels in my head go round and round.
 
I'm so angry and disgusted I can't really share my thoughts without ending up in the corner for like, a month. I'll be back when I'm not so mad. I want to say though, I'm so sorry to the homeowner who clearly will get NO justice for having her home violated and her dog assaulted by this walking pile of (self-censoring).

Tell the judge you only did it because you had to get all jacked up on coke in order to maintain your status in the Aryan Brotherhood. That ought to get your charges dropped pretty quick.

It says to me that there needs to be a new definition of "INTENT".
Unfortunately I guess I also feel that it may have been dismissed to protect the 4 witnesses
don't know if I'm right, and please don't throw stones, but if they charge WH with it, then
wouldn't the witnesses be considered accomplices?

Maybe he's just committed trespassing and perhaps vandalism if he broke anything... if he was not planting evidence, just looking for it.
