IMO, ICA would resent it more and show her true colors more if LDB did the cross, should she take the stand.

Must say, I agree. Thinking of her "relationship" with her mother, she may resent being challenged by a female more so than by JA.
 
Does anybody know: Did Diane Downs testify on her own behalf (I read AR's book about her case, but can't remember)? How about Susan Smith?

Yes, IIRC Diane Downs did.
Susan Smith didn't, but she did have shame as she only looked up when she had to. Susan Smith is exactly where she belongs.
 
I voted "No", originally, but now my mind has changed on that -- for some of the same reasons others have already expressed (competency hearing, HHJP's statement today, etc.).
 
At the end of the day the judge was talking to lawyers without jury present and told them he will be asking casey if it is her choice and only her choice to not testify she shook her head yes like it was her choice not to. Maybe someone else can look and see if they feel the same
 
I believe Casey will testify. LDB should be the lawyer to do this in my opinion. The jury should not see JA as being a "bully" to her. JA tends to get emotional at times and I can see Casey bringing this feeling to a head with JA. (Poor guy could pull his hair completly out!) LDB keeps her emotions in check and seems like a pretty cool "head". Don't get me wrong, I love JA, but this shouldn't be his "job". He should definitely close with those emotions! LDB seems to think quick on her feet, keeps her emotions under wraps and pisses Casey off. This most certainly could work in the states favor! Casey has a past of covering her butt and she's going to try to do it again. I'm sure she thinks she has everything to win and nothing to lose. She only needs to get ONE jury member to believe her. I wouldn't be surprised if Jose has backed up this belief.

Personally, KC likes a stage and thinks she's smart enough and conniving enough to fool us all. I think she will take the stand and maybe think she can plead the 5th on cross. Who knows? I think she will try, yes. JMO.
 
I voted No but, I do think there is a chance she will. Many of you have already posted the reason's. She just thinks she is smarter than everyone else.

I don't think the DT has made a decision yet. I think they will wait and see if any of their remaining witnesses make a dent in the states case. They probably won't though so they might use her as a Hail Mary.

Also, I think that once the judge asks her personally she will impulsively decide to go for it. imoo

Living in the Orlando area, both my school and my job has said if she does, we will get it broadcasted to us so we can stop what we're doing and watch!! :great: Even the local radio station I listen to all the time has said they'll stop whatever they're doing to broadcast it. I've missed the majority of the trial due to my busy schedule and only catch up here - so this will be much appreciated if she does take the stand!
 
I didn't think Casey would take the stand but that was before the mental evaluation to see if she's competent. If the legal beagles guesses are right, maybe she wants to take the stand against the advice of counsel and they are doing a CYA just in case she does decide to take the stand.

I wouldn't be surprised if Casey does decide to take the stand because I think that she thinks she can talk her way out of anything.
 
If she does, will we get any warning ahead of time or will Biaz just say "the defense calls Casey Anthony"?
 
Although no doubt her team does not want her to, I believe (AND PRAY!) that she will. The competency motion made up my mind. I think she thinks she can fool everyone. I will die a happy woman after I watch her being torn to shreds up there. I would love nothing more than to see LDB and JA take turns with her but I think if one has to do it, it will be and should be LDB.

I would LOVE to hear her being cross examined about the tragic 'accident.' Let us hear it out of her mouth. She will not get away with ' it was early morning, no afternoon, oh wait, it was morning ..." . NOPE. She will be questioned about every detail and she will find herself at the very end of the hall, once again.
 
While I would LOVE to see this trainwreck if it happens, I have to ask myself what she would actually do on the stand?

I can only see two possibilities:

1. Lie/perjur (sp?) herself
2. Plead the 5th

Not sure how either one of those is going to do her any good.

Does she realize that if she gets on the stand... she will be asked questions by the prosecution...? and she will have to answer them?? She can't just have a q&a session with Baez and go back to her seat.
 
No way will she testify. But I sure would love to see it. I mean I would REALLY REALLY love to see it.
 
I am hoping she does. But if she doesn't, I think she testified alot during this trial without even taking the stand. The jailhouse videos, her 911 call, the pictures, etc..etc..etc..

No it cannot happen and no she cannot.

Likewise, if a person does not take advantage of the Self-Incrimination Clause, and instead takes the stand on his own behalf, he cannot later refuse to answer questions on cross examination. He must make "plead the fifth" first or take the stand, he cannot do both.

Yes, she will- but in trial #2, granted due to ineffective assistance of counsel.
Gives her time to match her story to a better defense.
(And I doubt the new trial will be televised).
