….Prosecutors also accused Rudolph's girlfriend and manager of his Pittsburgh-area dental franchise, Lori Milliron, of lying to a federal grand jury about the case and her relationship with Rudolph.

She was found guilty by the same jury of being an accessory after the fact to murder, obstruction of a grand jury and two counts of perjury before a grand jury. She was found not guilty on two other counts of perjury….

I haven't really followed this case closely but am trying to catch up today.

Does anyone know the likely sentencing LR & LM will receive for their crimes?

Is he out on bond or has he been in jail leading up to the trial?

His past statements make him sound like a huge flight risk.

I can see him appealing this for as long as his money lasts.

moo
I forgot that even after he was denied bond release, the defense tried to get him moved to a detention facility located in AZ -- citing every reason they could think of including he was receiving generic brand Rx in Denver!

The man’s attorneys filed motions on Tuesday to get their client out of a Colorado detention center to Arizona, where he owns a home. They argue he’s 67 years old, has medical conditions and the case against him is circumstantial.

I stopped trying to predict sentences for federal convictions long ago because although federal sentencing guidelines exist (i.e., rules that set out a uniform sentencing policy for defendants convicted in the United States federal court system), they are also not binding, and the Court has full discretion.

It's also one of the reasons sentencing takes 6 months in federal cases (allowing for the court investigator to prepare and deliver a presentence report to the Court). It's a very precise computation.

What we know for certain is that most prisoners (serving less than life sentences) only serve 85% of their time-- after accounting for the amendment by congress to § 3624(b) to allow a maximum of 54 days of good time for each year of the sentence—54 days is almost exactly 15% of the sentence handed down.

Did anyone watch the 20/20 episode on this case?
I know that 48 hours had also had one last week!

On Saturday, CBS 48 Hours will revisit Bianca Rudolph's 2016 murder case and the subsequent federal investigation that helped bring the perpetrators to justice. The episode, titled Death on Safari, will air on September 10, 2022, at 10 pm ET.

Mistress Convicted of Lying to Grand Jury
Denver – The United States Attorney’s Office for the District of Colorado announces a federal jury found Lawrence Rudolph, age 67, guilty of murdering his wife, Bianca Rudolph, and of defrauding multiple life insurance companies. The same jury found Lori Milliron, age 64, guilty of being an accessory after the fact to the murder, obstruction of justice, and two counts of perjury before the grand jury.

ORDER as to Lawrence Rudolph, Lori Milliron: On January 9, 2023, the Court received an e-mail from attorneys representing Julian Rudolph, AnaBianca Rudolph, and the Estate of Bianca Rudolph (collectively, “Movants”) requesting information concerning filing a response to 296 the Government’s Motion for Mandatory Restitution and Forfeiture. The substance of Movants’ request is that the Court permit them to file a response brief arguing that the Court should recognize their rights as victims and entitlement to receive restitution in this matter. However, the Court questions whether Movants, who are not parties in this criminal case, have standing to participate in the restitution portion of these proceedings and directs briefing on this matter. See United States v. Kelley, 997 F.2d 806 (10th Cir. 1993) (holding that Congress did not provide a private right of action for victims in the Victim and Witness Protection Act, 18 U.S.C. § 3663, and precluding victim from appealing restitution order) (citing United States v. Johnson, 983 F.2d 216 (11th Cir. 1993) and United States v. Grundhoefer, 916 F.2d 788 (2d Cir. 1990)); see also United States v. Hunter, 548 F.3d 1308, 1313 (10th Cir. 2008) (analyzing Kelley). By January 18, 2023, Movants are DIRECTED to file a motion requesting leave to file a response to the Government’s Motion for Mandatory Restitution and Forfeiture that explains the legal basis for them to do so. By February 1, 2023, the Government and Defendant Lawrence Rudolph are DIRECTED to file responses to the Movants’ motion for leave to file a response. Defendant Lori Milliron may, but is not required to, file a response to the Movants’ motion. All parties should cite binding Tenth Circuit and Supreme Court case law to the greatest extent possible. Once the Court receives the motion and responses, it will determine whether a reply brief is necessary. Solely for the purposes of filing their motion, Movants will be permitted to appear on the docket as “Interested Parties.” The Court DIRECTS the Clerk to facilitate such appearances to the extent necessary and DIRECTS Movants to contact the Clerk’s office with any questions concerning CM/ECF. 6/24/23

Milliron was convicted last year of perjury, being an accessory to a murder after the fact and obstructing a grand jury in a case that’s garnered national attention. She was charged alongside Lawrence “Larry” Rudolph, a U.S. dentist who was convicted last year of fatally shooting his wife while on a 2016 hunting trip in Zambia. His sentencing, originally set for this week, has been postponed.

John Dill, an attorney for Milliron, said the prison sentence was longer than what is typically dolled out for such charges, calling it “excessive” and vowing to appeal. Dill argued that the convictions were merely based on Milliron’s perjury charges and do not implicate her in the execution of the crime.

Standing in front of the judge on Friday, Milliron insisted she was innocent of the crimes but said she was “sympathetic” to the Rudolph family.

Judge William J. Martínez argued that the long sentence was deserved because evidence pointed to Milliron “encouraging” the crime. Martínez added that Milliron seemed “unrepentant” in part because he judged her emotionally unmoved when she was shown graphic images and listened to wrenching testimony during the trial.

6/24/23

Lori Milliron, the girlfriend of Lawrence Rudolph, was tried alongside him in July 2022. A jury found her guilty of being an accessory after the fact to murder, obstruction of justice and two counts of perjury based on her testimony before a grand jury, according to the Department of Justice.

On Friday, she was sentenced to 17 years in prison and fined $250,000, according to federal judge William J. Martinez’s sentencing order.

The judge denied Milliron’s motion for non-guideline sentencing. Martinez instead granted the federal prosecutors’ motion for a longer-than-usual sentence. In their motion, federal prosecutors had argued that “Even now, Milliron has expressed no remorse.”

“Lori Milliron encouraged Lawrence Rudolph to kill his wife for her. She told him to divorce Bianca Rudolph. When he said he couldn’t afford to do that, Milliron responded by helping Rudolph procure propofol – a lethal anesthetic drug that could be used as a poison – before he took the trip where he did what she had wanted: get rid of Bianca,” their motion read.

8/14/22

A Denver federal judge has denied a new trial for a dentist convicted of shooting and killing his wife while on a Zambian safari, thwarting what Lawrence "Larry" Rudolph's attorneys described as "newly discovered evidence."

U.S. District Judge William Martinez also denied Rudolph's long-time mistress, Lori Milliron, a new trial.

Rudolph, 68, was convicted on Aug. 1, 2022 on one count of the murder of a U.S. national in a foreign country and one count of mail fraud for cashing in more than $4.8 million in life insurance claims in connection to Bianca Rudolph's death in 2016.

[..]

In a motion, Rudolph's attorney, David Markus, claimed that a 6-year-old email chain between Bianca Rudolph and a former employee of Rudolph's multi-million dollar dental office would prove that the dentist did not kill his wife.

The employee, Cassandra Olmstead, testified about "soul-bearing conversations" she had with Mrs. Rudolph about their marriage. But Markus countered in his motion that the emails show that Olmstead was not truthful and that her statements about her conversations with Bianca Rudolph should not have been admitted at trial.

Martinez denied Markus claim, concluding that the newly surfaced emails "were merely impeaching."

Staggering. How much money is enough? This very rich man said he couldn't afford to divorce his wife of over three decades, the mother of his children. He murdered her instead, and then profited from the murder via life insurances. It's a stiff sentence for his mistress, but well deserved I feel.

8/21/23

A wealthy dentist convicted of killing his wife while on a safari in Zambia so he could collect millions in life insurance is expected to be sentenced to life in prison today for murder.

Larry Rudolph, who prosecutors say had a lifetime 'spent seeking domination and control over others through wealth and power', fatally shot his wife Bianca Rudolph in October 2016.

His girlfriend Lori Milliron, 65, is facing 17 years in prison after being sentenced in June for encouraging the murder.
