Hoping I can find someone on Thread to humor me. The last supposed violence from Travis~throwing Falsity to the floor, choking her until she lost consciousness, plus other poignant accentuations~occurred in April, 2008. Have we ever been given the date? I searched all Threads and found mentions but never a date. She came so-o-oo close to dying, don't you know. She told us that's why she knew what Travis was capable of on June 4. How handy to have that justification for "defending herself".

No date. No report. No journal entry. No witness. She came so close to dying she decided to go back for more. That's what a reasonable person with an IQ of 119 would do right? Great to see you Tuba!!

Unless this new DT witness lives in a cave on Mars, the odds of him not seeing any media coverage of this case are slim to none, and slim left town months ago. So my question why would he be let on the stand to testify at this late stage?

The reason for sur-rebuttal would be if something new comes up on rebuttal that can't be handled on cross. I suppose Dr. DeM mentioning the stolen ring could be an example, but IMO Jodi doesn't have any evidence to rebut that information. She could get on the stand in sur-rebuttal to say that she didn't take the ring, but I doubt she wants to go through another JM cross-examination.

The jury is free to disbelieve testimony even if it is not countered by other testimony. The attorneys can use cross-examination and argument to try to cast doubt on the ME's testimony.

It looks as if the DT wants another forensics psychologist to testify in surrebuttal, but I'm not sure what the basis would be for JSS to allow this. JDM disagreed with the DT's experts in terms of PTSD and BWS. Dr. Samuels administered the MCMI and considered a personality disorder NOS, while JDM administered the MMPI and concluded BPD. To me, JDM just had a different opinion based on her testing and clinical interviews.

In terms of forensic psychology, JDM also administered the WAIS and a literacy test, but I can't see how these would have any bearing on the case now.

For those who were saying that JA was "taking a test" during court last week, I highly doubt that. Dr. Geffner's practice seems to have standard procedures for forensic work (http://www.fvsai.org/Forensics.htmhttp://) and testing protocol would not include her taking these tests without supervision, time constraints or a proper testing environment. It would be a huge failure for the DT to put up another quack expert and Dr. Geffner does not appear to be one.

I just can't see the basis for another forensic psychologist.

Let's hope that JSS smacks this request down in no uncertain terms.

San Diego is less than 2 hrs. down the coast from Long Beach, ALV's stomping ground. I'm sensing some kind of racket whereby these southern CA "therapists" endorse each others' books, schedule each other to come speak, offer short seminars where continuing ed units can be earned to keep their state licenses up to date, etc., i.e an "I'll scratch your back if..." buddy system.

Interesting that their motion states that the state failed to include in their CIC that Jodi had BPD. I don't believe it's the states job to present the defense to the jury is it? Maybe the judge won't rule to allow this motion at all if it's legally flawed. I'm no lawyer but that reads as legally flawed to me.

Expert witnesses are exempt from the admonishment to avoid the trial. They generally do so to appear unbiased but they are not required to do so to testify.
