2009.11.19 Defense files motion suggesting Kronk as the killer. #3

Ok, Ok, so RK is meter reading near the A home, sees Caylee outside, nabs her and kills her.(reason? because his sister won't let his niece sit in his lap, no evidence, just speculation) Then he goes back to the A's, breaks in and steals the baby blanket, laundry bag, trash bag, and oh wait the tape, he stole the tape first so he could use it to kill Caylee. Then he put Caylee in the trunk so he could frame KC. Then he decides he doesn't want to frame KC so he takes Caylee out of the trunk and dumps her down the street. Then he finds Caylee and calls 911 numerous times. Meantime innocent KC who has repeatedly lied to LE, parents and everyone else, decides not to report her daughter missing, continues to steal from her friends, hides from her parents and parties for 31 days. KC only admits Caylee is missing when she's forced to and says that a nonexistent nanny took her. Obviously JB & co. have no problem insulting the intelligence of potential jury members. If I were on the jury I might be inclined to give the DP just for having such dishonest attorneys who think I'm that stupid. JMO

Kronk may not be as innocent or perfect as a mockingbird. But it's a sin to pin a murder on an innocent man when all he did was find the body of a discarded murdered forgotten little girl. No matter in what way he found her body he surely didn't commit this murder.

Part of what has gone on with this latest developments is what's wrong with the world today. It's a sad state of affairs ....

I know, right? If I were on the jury, I'd be alternating my time between laughing nervously, looking confused, and then searching for the hidden cameras, waiting for Allen Funt or Suzanne Sommers to jump up from under Strickland's desk.
 
JSR I love it! It made me think of my grandma who, although a very sweet and delicate lady, used to keep a 22 on the porch to shoot pigeons. She called them nasty scavengers who crapped on everything and did nothing but spread disease and filth. She fed squirrels out of her hand (yeah, I know, rabies? hello!) but shot every pigeon she could find.

Wish she was alive to sit on that jury. The defense is loaded with pigeons.

snipped for space. What a great post JSR! To JB and co, Kronk is a blue jay. And apparently because bluejays play video games, might like kink, and don't pay child support, they're fair game. All I know is that I'm drooling all over my keyboard waiting for the state's response to this ridiculous motion.
 
In my opinion, the arguments brought up by the defense in this motion are reasonable. If JS dismisses this motion, I think the defense will use the dismissal later as one of the grounds for appeal, should Casey be convicted.

This motion brings into question whether or not LE has used tunnel vision in this case. Once Casey became their main suspect perhaps LE was not quite as zealous in investigating other possible suspects. Had LE paid closer attention to the red flags in the statements made by RK, they would have uncovered the findings in this motion. Perhaps they did investigate but had not yet released the results to the defense. If JS allows these findings to be used at trial, it could hurt the states case. IMO he will most likely dismiss this motion.

The unofficial survey at WESH tv has nearly 3,000 responses. 89% say RK should not be considered a suspect. I am one of the 11% who say RK should be a suspect. I consider the circumstances with RK finding the remains to be odd. IMO this motion only bolsters the oddity of those circumstances.

For over a year we have heard the media’s interpretation of the evidence we know of. Aside from a couple little peeps from the defense about junk science, we have heard precious little from the defense about evidence.

The media has indicated this trial will be a battle of the forensic experts. My interpretations of the docs we have available leads me to believe the prosecutions theory is likely. However, since we have not yet heard a cross-examination from the defense (and won’t until trial), I am curious to find out if the defense will present a theory that is also likely.

The media is powerful, but not necessarily just. Michael Jackson was portrayed by the media as a hero, then as a zero, then back to a hero again. The media is fickle. If for monetary purposes the media thought they could make more money by taking Casey’s side now, IMO they would do it in a heartbeat.

It may well be my imagination, but it feels to me there is a slight change afoot. This motion is only the beginning for the defense, a molehill in the mountain of rebuttal I expect to surface from them.

I like to keep an open mind until I’ve heard both sides of the story, it gives me a better grasp on the whole truth. In my opinion, this motion is only the beginning of the defenses side of the story.
 
Ok wait I think I've got it now. A reasonable Defense hypothesis.

Casey was on the phone, texting, twittering, ect, ect. Mean while Caylee was in the garage playing with Jo-Jo's stuff. We all enjoyed playing with potentially hazardous materials as kids. I know I did. While playing she decides to do a little game with herself by placing tape on her face in an effort to play peek a boo solitaire. Caylee then finds it hard to breath and can't get the tape off.

While struggling to get the tape off, Caylee falls into two plastic trash bags that George had set up for lawn refuse. Now she is in a real pickle. Caylee is thrashing about on the floor and bumps against the wall that has the shelf holding the laundry bag. The laundry bag falls on her and while thrashing about Caylee ends up inside of it.

Finally coming to her senses she stands up and proceeds to hop like a sack racer into the house to get mom. Unfortunately Casey's car is in her path with the trunk open and Caylee falls into the trunk and with that the trunk lid falls closed.

Later that evening Casey decides to go out onto the town and party at fushion or sleep with some random guy for the evening. She figures oh Cindy must have come and got Caylee while I was in the house. A couple of days later Casey opens her trunk and sees the bag and notices the smell. She thinks oh hey George must have put trash in here. Well since I'm such a good daughter and girl friend I'll grab Tony's from his appartment too and throw them both away together.

Before she does she forgets something at home and pulls into the driveway and opens her trunk to place the gas cans in it. Her dad doesn't mind her borrowing them because she runs out of gas alot. While Casey is inside the house RK comes to read the meter for the house. He notices that Casey's car trunk is open and there are trash bags inside and they smell pretty bad.

Being the "nice" guy that he is RK decides to take the bags out of the car trunk and toss them away for Casey. Maybe by doing this she will "repay" him. RK then drives down the road and nature starts to call. he stops to relieve himself and in doing so notices this area is used for dumping. He takes the trash and tosses it in the woods.

Casey is out driving around and her car runs out of gas and she decides she'll just get it later and leaves it. Not thinking about the trash she left in it, and calls Tony to come get her.

Later after this case hits the news RK thinks hey maybe that trash was Caylee and then proceeds to call the police after going back out there.

Casey never reported Caylee missing because she thought Cindy had her and was letting someone else watch her. Which is why she was upset when her mother asked about her involvement. Casey thought Cindy or someone Cindy hired was watching Caylle all this time and Casey just thought hey this gives me a slight break from my duties as worlds greatest mom. Even superman needs a day right?

Then Elvis steps out of an alien spaceship from his home planet of Iota along with his "Number 2" Jimmy Hoffa, science officer Kurt Cobain, and Security Office Tupac.

See there you go. I was able to present RK's involvement being equal to Casey, Accident theory, KC being innocent, and the other material facts of this case in a reasonable way....well ok you got me. Micheal Jackson was the Capt of the alien spacecraft and not Elvis.

No I am not trying to take this case lightly or suggest that Caylee's death was not gruesome and tragic. I am merely trying to point out exactly how outlandish some of what the defense is trying to get people to believe. Jurors are allowed to use thier reasoning skills when listening to evidence. I just don't see how the defense can argue this case. In my opinion the only way out for the defense with a "win" is to find some sort of technicality or smoke and mirrors to confuse jurors of the evidence and the law. The stories the defense has now are about as believable as the one above.

You're gonna carp if JB calls a presser to announce new information to clear his client and it turns out to be this. You might want to copyright the story so you can charge him royalties if he uses it.

Wasn't J. Jordan a member here at Websleuths at one time? Wasn't he the one that found clothes at Jay Blanchard Park? His search of the woods at Suburban on September 1st was a couple of weeks after Kronk called in August.

The motion was filed after Casey Anthony's defense attorneys found two people, not listed in EquuSearch's documents, who stated they searched the exact area where the skeletal remains were found.

Searcher Joe Jordan claims he searched the area on Sept. 1, 2008 with five or six others, including a dog handler named Danny Ibison and another dog handler from the Panama City Sheriff's Office, court documents show.

Another woman, Laura Buchanan, of Mendham, N.J., said that on Sept. 3, 2008 she searched "near the privacy fence and worked my way towards and then beyond the spot where the body was found," according to a sworn statement.

Both Buchanan and Jordan said there was no indication a dead or decaying body was in the area when they searched.

Even if Kronk's story of finding Caylee is "hinky" how on earth does that then translate into him having anything to do with what happened to Caylee? That is the biggest point in all of this that I am just not getting. There are to many things pointing to Casey that in no way, shape or form can be pointed to Kronk. So because he happened to find Caylee he MUST have had something to do with her death?!?! Can someone explain this to me?

I think that an open mind does not preclude a discriminating mind, which to me defines the reasonable. To accept the absurd may be described as due to "an open mind", but with all due respect, I think of it as a mind without determined boundaries. I don't think an open mind as implied, is remotely as valuable as a discriminating one- the former does not depend on logic or common sense but rather an acceptance of anything that is dished up as if it were equally valuable.

But here is what I don't understand....

By the time KC became the "main suspect" (evidence from trunk of car, decomp smell, false information, etc) who were these other possible suspects and what information was given to LE to consider these other possible suspects (other than CA's wild speculations without basis)? Prior to Caylee's body being discovered, what single piece of investigative evidence led LE to consider a particular SODDI?

We still do not know the details of the investigation by LE of RK, but assuming they did some investigating, what investigative evidence was there (in Dec of 08) to lead LE to suspect that RK was responsible for placing Caylee's body in the trunk of KC's car where CA, among others, reported a strong smell of decomposition?

What investigative evidence was there (in Dec of 08) to lead LE to suspect that RK may be responsible for removing items belonging to Caylee from the Anthony house prior to committing this crime??

Has there ever been a real kidnapping case where the mother of the child lied to LE about every single detail of the kidnapping and it turned out that the mother truly had no involvement?

Not to interrupt your post, but the mother of the missing child WHO WAS THE LAST PERSON KNOWN TO HAVE SEEN CAYLEE ALIVE....
