Who said TES is stalling? That is so silly, Mark had a scheduling conflict. He gave the court a list of several dates that he can be available that are in the very near future. What in the world? Who said they were stalling?

Mr. Nejame stated in his interview that is in writing, in quotes and in full in a link on this thread, and on video........that the defense has NEVER came to ask to see the records, since the judge's ruling in August!! They have not asked for a date to depose Mr. Miller....again since the judge's ruling...in August. It is in post 9. Intermezzo was kind, and fast I might add, to find it for me this morning.

They didn't do so in September
or October
or November
or December
or January
and we are in the second week of February

There is no excuse for this. NONE. If they have the time, energy and enthusiasm to make national media appearances they could have made time to schedule a 1-2 day deposition of Mr. Miller, even on Andrea's limited Thursday and Friday time tables.

They are going to look so silly in court with this. I expect Mark to make a motion to strike, for these reasons and ask the judge to not even entertain this motion. The judge may have the hearing on the motion, to reiterate for the record his earlier ruling, as some of you have mentioned....Baez seems to need to hear things more than once before he gets them. I hope he will keep it short and in his words "Rule and Roll", and say..what's next....Mr. Baez , now let us discuss your deadline for the witness list.

They need to admit that Casey is indigent and get on with it.

Sounds like malpractice to me. Baez isn't taking depositions, therefore he's not doing his job defending KC, and his reason is no money? In that case, he has an ethical obligation to declare her indigent and have an attorney assigned to her case. Her defense shouldn't have taken her case pro-bono if they can't afford to represent her properly! JMO

I don't see this as much as the Defense affording the money to pay .... it is all about wanting to pay and wanting to seek the court's assistance. They don't want to pay and they want help to review the records, like the tips/leads. It is not THAT important. Moo.

What price is KC's life worth to the Defense?, to the A's?, to KC? It isn't the cost. It is all relative. Moo.

Having said that, the Defense has succeeded in their goal.

The goal was to take the focus off the recent SA motion and the new evidence and materials from that investigation -- in that the Defense have succeeded in creating a different noise about TES and the searchers. Moo.

So now it changes from the Judge's ruling that a representative be present and the defense is to pay for it to NeJame is charging to have a person watch over and its $300 an hour.

I would be more than happy to provide the link again.

Better yet, my question to your question is "And just how did you come across this information?"

I am just looking for a number. Perhaps one of the Lawyers could weigh in. What do you think he is charging?

This is extremely important!! If JB cannot afford to defend KC completely, fully, rapidly and, voraciously then he needs to step aside and allow someone to take over who can -- or allow KC to file as an indigent.

JB is jeopardizing KC's right to a fair trial if he is delaying, not doing everything or, unable to do certain things due to finances or resources.

Last time I checked TES was not a suspect in this case or any of the volunteers associated with TES for that matter so how would they be above justice. You are talking about volunteers who were out searching for this child's body while her mother sat behind bars stuffing her face with cheetos, while those grandmothers and grandfathers, moms and dads all gave up their time and energy to search. And this is the thanks Caylee's innocent Mom gives to them. Keep painting that picture for KC Mr. JB because if you do, stupid will be the best you will ever look. JMO

In the check fraud hearing, when discussing court costs and fees due by KC......Andrea Lyon said...."well we can just have her declared indigent". There is a reason thay have not done so...... IMO I believe that it may be due to the fact that a portion of her defense thus far has been paid for out of fees earned in the sale of photos.

I am not sure what the requirements are for qualifying as indigent, but given the fact that JB fought so hard to keep the terms of "KC's Defense Funding" confidential, they may be stuck between a rock and a hard place. If they declare her idigent, those records will become public.......

I do not have any knowledge of this as fact, but it is certainly a plausible explanation...This is MOO with a complimentary contribution of an explanation and supporting statements that helped me arrive at that opinion.

NTS, you're right, you have mentioned that several times. I've always wondered how you know what Baez wants? Him wanting us to think he's stupid isn't in any discovery we've seen nor in any of his interviews or statements. How are you privy to his inside strategy, if you don't mind me asking? Not being snarky, just curious.

I honestly think that there are some who are desperate to paint the Defense and their actions in a more credible, plausible and, heroic light because the Defense are doing so badly and grasping at straws .... so they are also grasping at straws.

It isn't an easy job at all, in fact it is very tough. You need someone to support the underdog right? -- throughout everything. Bad and worse.

ITA! I think the defense (and their supporters) are trying desperately to appeal to potential jurors who would buy into a "conspiracy theory". There are people who harbor ill will against LE and Prosecutors, and Baez and Co. want to convince everyone and their Grandma about how maligned "poor Casey" is. Frankly, they are not giving average citizens enough credit! I think its pretty obvious that rational, sane, logical thinking will ultimately rule the day. JMO...

No matter what ill feeling anyone might harbor for LE or prosecutors nothing would appeal to a jury less than a mother who has killed her child trying to blame it on an innocent person. It didn't work for Susan Smith. JMO

I believe that it is precisely that ..... when the SA did the motion to look into Defense funding and KC made the affidavit I think it closed many doors on future planned Defense funding. Moo.

Yes, you are spot on, imo and the judge is about to reign this in. The fact that Andrea already mentioned it in open court, on the record tells us it is not if they will , it is a question of when they declare her indigent. We called this one a long, long time ago.

I think the stuff is about to hit the fan, since Dominic testified finally. " RHornsby from his q and a thread was asked what is up with Dominick not wanting to be deposed, you gottta love this answer:
"You don't fight a subpoena this hard unless you have something to hide. If I recall, Judge Strickland said there was not privilege with him and Baez anymore, if that is the case, he will eventually testify."

I see many of you responding to what looks like someone said something disparaging about TES, I am just at the end of the thread and don't know all the posts yet, but let me just ask.... if anyone is doing that....please don't!!

Mr. Miller, his wife and his family have done over 900 searches over the eight years since his daughter was murdered. In in all that time...they have never, ever once been accused of any impropriety. Baez better pick a lesser man to attack than Mr. Miller. The jury will despise that.

We don't make accusations without a link to the published proof. That is vile!

Maybe Baez's strategy is to make us feel sorry for KC because her lawyers aren't doing sh*t to defend her. He must think we're stupid... :waitasec: But wait, he wants us to think he's the stupid one ... Stupid strategy in my opinion.
