Who said TES is stalling? That is so silly, Mark had a scheduling conflict. He gave the court a list of several dates that he can be available that are in the very near future. What in the world? Who said they were stalling?
Mr. Nejame stated in his interview that is in writing, in quotes and in full in a link on this thread, and on video........that the defense has NEVER came to ask to see the records, since the judge's ruling in August!! They have not asked for a date to depose Mr. Miller....again since the judge's ruling...in August. It is in post 9. Intermezzo was kind, and fast I might add, to find it for me this morning.

and we are in the second week of February
There is no excuse for this. NONE. If they have the time, energy and enthusiasm to make national media appearances they could have made time to schedule a 1-2 day deposition of Mr. Miller, even on Andrea's limited Thursday and Friday time tables.
They are going to look so silly in court with this. I expect Mark to make a motion to strike, for these reasons and ask the judge to not even entertain this motion. The judge may have the hearing on the motion, to reiterate for the record his earlier ruling, as some of you have mentioned....Baez seems to need to hear things more than once before he gets them. I hope he will keep it short and in his words "Rule and Roll", and say..what's next....Mr. Baez , now let us discuss your deadline for the witness list.
They need to admit that Casey is indigent and get on with it.

I don't see this as much as the Defense affording the money to pay .... it is all about wanting to pay and wanting to seek the court's assistance. They don't want to pay and they want help to review the records, like the tips/leads. It is not THAT important. Moo.
What price is KC's life worth to the Defense?, to the A's?, to KC? It isn't the cost. It is all relative. Moo.
Having said that, the Defense has succeeded in their goal.
The goal was to take the focus off the recent SA motion and the new evidence and materials from that investigation -- in that the Defense have succeeded in creating a different noise about TES and the searchers. Moo.
So now it changes from the Judge's ruling that a representative be present and the defense is to pay for it to NeJame is charging to have a person watch over and its $300 an hour.

Sounds like malpractice to me. Baez isn't taking depositions, therefore he's not doing his job defending KC, and his reason is no money? In that case, he has an ethical obligation to declare her indigent and have an attorney assigned to her case. Her defense shouldn't have taken her case pro-bono if they can't afford to represent her properly! JMO

I honestly think that there are some who are desperate to paint the Defense and their actions in a more credible, plausible and, heroic light because the Defense are doing so badly and grasping at straws .... so they are also grasping at straws.
It isn't an easy job at all, in fact it is very tough. You need someone to support the underdog right? -- throughout everything. Bad and worse.
ITA! I think the defense (and their supporters) are trying desperately to appeal to potential jurors who would buy into a "conspiracy theory". There are people who harbor ill will against LE and Prosecutors, and Baez and Co. want to convince everyone and their Grandma about how maligned "poor Casey" is. Frankly, they are not giving average citizens enough credit! I think its pretty obvious that rational, sane, logical thinking will ultimately rule the day. JMO...
In the check fraud hearing, when discussing court costs and fees due by KC......Andrea Lyon said...."well we can just have her declared indigent". There is a reason thay have not done so...... IMO I believe that it may be due to the fact that a portion of her defense thus far has been paid for out of fees earned in the sale of photos.
I am not sure what the requirements are for qualifying as indigent, but given the fact that JB fought so hard to keep the terms of "KC's Defensing Funding" confidential, they may be stuck between a rock and a hard place. If they declare her idigent, those records will become public.......
