if he wants TM as a witness so badly couldn't he call him as a hostile witness? I'm not getting why he is poed that TM is not on the states witness list...

Nejame is pointing out that he's agreed that TM can be deposed by the defense and says he is "baffled" that the defense hasn't scheduled a depo. Nejame asks where the defense has been and wonders how they can come to the court with such an argument in good faith.

He agreed to have him here and says since Aug no one required it or arranged it, says how can they have an argument. Additionally, says last Aug judge ruled that TES to provide info on 32 people who were in area of remains, says BC came in to go through documents, flag relevant docs , BC spent hours tagging docs and these were released.

wow BZ tried to send a copying company to do their work! And MN said no, violation of privacy - then they were asked to fax the docs - again violation and risk.

MN had them copied and hand delivered as a favor. THe documents sat with BZ for months with no request from BZ for anything else.

Yes, notice that when NeJame talks, the Judge listens intently. When JB talks the Judge starts rocking in his chair, he does this invariably when he is irritated...
Baez is laughing while NJ speaks.
