Ashton is right! Reading a few newspapers isn't enough to give an opinion!!!
But he was overruled

Her opinion means nothing...it's the outcome of research that matters and her research has been reading newspapers and observing other DP cases involving mothers who murder their children. H$ll I could be a witness...we all could!

there is no jury present. JP will allow them to say whatever and he will deny them at the end. At least this way they had their say.

That's what I think...I read these motions are generally formalities in case laws change. I think he's protecting his decision on appeal as well.

I submit that it's BEHAVIOR that's being scrutinized <media> when a mother is accused of killing her child. The human mind HAS to reconcile BEHAVIOR with the ACT.

Just as a side note most any statistic on the DP and woman is going to blow the defenses gender bias argument out of the window. Just some samplings.

Actual execution of female offenders is quite rare, with only 568 documented instances as of 12/31/07, beginning with the first in 1632. These executions constitute about 2.8% of the total of confirmed executions in the United States since 1608.

Eleven female offenders have been executed since 1976.

Since 1976 1192 males have been executed in the US. (1203 total executions - 11 females)

I really thought AL would be better at questioning than this. She seems to be stumbling around with her questions. I wonder if she had expected the judge to deny this witness right now and was not completely prepared?

Ok, is it just me or does anyone else think this witness will be in tears before too long? LOL The objections by the state are throwing her off. Not so sure this witness is going to do any good for the defense. She, herself, admitted she isn't an authority or something to that effect.

Can I just cut to the chase here?
Q. Why do these cases receive such attention?
A. Because mother's aren't *supposed* to kill their children. Any woman who kills her child is NOT a good woman or a good mother.

Number is small

Prof can answer ?'s but must be qualified by small number of cases.

Lyon: In your opinion are prosecutors more or less likey to seek a severe sentence if there is intense media interest?

Prof goes on to describe good mother defense. Juries will scrutinize to see if she was a good mother and antagonistic if they perceive she was not. Difference between good mother and good woman perception (good woman...not scantily clad etc )
