2010.06.09 Prosecutors File for 911 Calls to Come into Trial

I have a question about judges’ pre-knowledge of evidence, especially considering Cindy and her testimony.

Do judges typically review all discoverable evidence that is released as soon as possible, or do they tend to only review evidence that is brought before them for judgment?

The reasons I ask is that HHJP has stated that he does not listen to TV news shows, and thus may be completely ignorant of Cindy’s bad behaviors, the dispositions in the ZG case, her profiting from Caylee’s death, her attacking protesters, her treatment of TM etc., etc., etc.

But will he have even reviewed her statements to police and that were released in discovery?

Part of he reason I ask, is that Cindy may put on her grieving grandparent act, as she has often used it with not only the media, but also the police and they have mostly treated her with kid gloves, and have let her get by with a lot more it seems then they would a normal witness, and if she plays that card in court, and if the SA’s questions get too rigorous, I am afraid if JB objects they are badgering the witness, HHJP may side with her, because of her poor me act.

However, if he has at least read all of the released evidence, he will realize what is really going on.

I fully expect Cindy to perjure herself, for I do not believe she is any more capable of being honest then her daughter, I am just hoping that Judge Perry will be able to recognize it himself when it is happening and not have to relay on SA to point it out to him, for I don’t want the SA to come off looking like bad guys in his eyes for attacking a poor grieving grandmother.
 
I can't answer your questions kushka, but I do believe the judge will be well versed on all the items up for debate on the 15th, including the tapes and various transcripts following them. He is always prepared and armed with case law no matter what or who arises in his court so I don't imagine this to be any different.
I think it'll be very interesting to see how CA comports herself in his courtroom. She won't be able to have BC parked with her at the front of the room, squeezing her hand to calm her and I don't imagine he'll be able to object. Just CA, assuming she's so much smarter than everyone else in the courtroom.
She's busy as a bee right now memorizing her depositions and the tapes to find a brand new middle of the road explanation that incorporates all her previous versions, I'm sure. And I'm sure she'll get caught up in her web of lies thereby proving hers were excited utterances on the tape, versus the contrived lies she's told ever since. I wouldn't be surprised if she hasn't called and or written BP already telling him how to run his court so he may have a good idea who and what CA's all about already.

But what a performance it will be. For starters I think she won't be able to take her eyes off KC and will have to be redirected back to the task at hand often. She'll be angry from the onset and attempt to morph into the grieving Gma but......the SA has her number and will morph her back to her normal state of rage. I don't think she really has any allies on the defense side either, she just doesn't realize it yet.
 
And it boggles the mind to remember that MASON/the DEFENSE asked for this Hearing on the 15th!
They pretty much forced the Prosecutors to subpoena Cindy and Lee to testify!
The Inmate has only her "boys" to thank for this!

Why doesn't he list LBK as one of the defense attorneys on that motion? Doesn't she have the right to know what her left hand is doing?
 
Actually, the SA's argument is not to show 'consciousness of guilt' - it is to show the context and motive for the reason KC fabricated the Zenaida/kidnapping story and entry of the 3rd call is to show KC's state of mind (monotone affect vs. CA's hysteria).

Think of it this way - when JA and YM escorted KC to Universal and she reached the end of the hallway to her non-existent office, she was BUSTED. She had no office. No job. She had no choice but to admit she lied.

Same thing with the SA's motive/context argument. CA had finally found Casey and brought her butt home. Lee was there. They were not accepting her plea for "one more day". Cindy had called 911 twice already and the cops were on their way. Lee even asked Casey, "What are you going to tell them?" At that point, Casey had no choice BUT to concoct a story. She was out of 'outs'.

That is the legal basis for the SA's argument. Don't get me wrong - EVERYTHING ELSE is icing on the cake! Those calls are damning in every sense. So, CA's "there smells like there's been a dead body in the damn car" will be in there, but that is not the legal basis that the SA is attempting to get the 911 calls admitted.

I don't believe LA will lie for ICA, he needs to take the stand first, IMO...through him, CA learned that Caylee had not been with the prisoner for 30 days..when CA walked back into ICA's bedroom, she saw ICA in tears, CA stated, "CASEY, WHAT HAVE YOU DONE! Then she learned of Caylee's not being in her custody for a month. The 911 call (IIRC would be the third and final call that day) was excited utterance for now she can put the smell from the car to Caylee's alleged disappearance.

The defense is trying to claim, CA knew of the smell since she discussed it with her coworkers at Gentiva. Her supervisor made her leave work to go find Casey and Caylee...when she found Casey with no Caylee, then she realizes that smell may be connected to her granddaughters alleged disappearance, hence the final 911 smell of death call...

CA can spin it all she likes, if she states she only stated that to get the police to respond sooner, she may be reminded that it's a felony to make false accusations just go get someone to repond quicker, KWIM?? Either way, CA may be in for a bumpy ride for she cannot act as she did with the Morgan depos around HHBP...JMHO

Not an attorney here, but if the information is in the motion(s), HHJP reads them prior to the hearings. As he stated in his first hearing, he wanted a courtesy copy before it hit the media.

ETA: HHJP didn't get to his current position by being blind to false behaviors by defendants and witnesses. He pretty much has seen it all and probably within in minutes of one opening their mouths, can determine false statements. He will have all the A clan pegged immediately. As will Linda and Jeff. Have no fear.
 
I know I am being biased, and I am just judging this by the various public documents, postings filings, motions and interviews, but it almost seems like some of the observers such as RH and our own AZLawyer seem to be doing a better deeper and more thorough job of research than the actual defense team?

I understand the approach of "ask for anything and everything you may get lucky" but still?

ITA!! And, the above mentioned all are driven by passion not greed (the best word I could think of) for the law. RH may make $$ on his blog, but he's pro-bono here. After a long day, AZ comes and answers all our legal concerns etc. We're very lucky!! Luckier than KC but dare I say we have better collective karma than she does. So thanks for pointing this out faefrost!!

Now that CA has been served, is there any way that Brad C can manage to keep her butt off the stand? I can't believe that CA really wants to be sworn in and asked questions. Can she wiggle out of this? Anybody know?

I'm sure there is someway to wiggle out of it---but I also think they will keep coming back and I personally wouldn't want to test HHJP patience...I think her truly means what he says and will take action to keep this trial on track----:twocents:

I sure hope so, Zoey.

I think CA will have been coached by Brad C on how to behave and that the SA will handle her with kid gloves at this hearing. CA will be on her dignity and perhaps even manage to squeeze out a tear or two in her role as 'grieving Gramma'.

I wonder just how Lee will do. Is he just as ready to high five and call for CMA now that the abuse comments by KC have been made public?

No! And it's a hard no! She is not the one facing charges. As a witness she will be under an immunity for anything she says on the stand, so long as she does not perjure herself. So she has no option to not answer questions. It's either answer the questions truthfully or go to jail for contempt until she decides to answer them truthfully.

As far as her getting out of testifying? My entry in the betting pool is "complains of chest pains and rushed to the ER 8:30 pm 7/14".

Time has a way of dulling our memory. I just want to remind us who we are dealing with when Mrs. Anthony takes the stand on the 15th. She is not the modern day June Cleaver she portrays in her morning show interviews, subdued and sad.
Who she is is the hateful lady who threw Mr. Miller out of her home, and the lady who tried to pin the kidnapping and likely murder of a baby on innocent Jesse Grund!!!! God have mercy on her for that one, because, I sure don't.
In my opinion what she has done to this Tim and Jesse is despicable, just morally reprehensible.

She is a liar.
She lied to LE, repeatedly.
She lied to the Federal Officers.
She joked that she should have given the FBI agent the toothbrush she used for the dogs. Vile!
She lied throughout the civil depositions.
I fully expect her to get on the stand and lie.
That is what she does.
She lies.

Cindy is actually scarey in that video. Can you imagine living with her and having to withstand that coming at you in person if she was displeased with you?

Maybe KC has grounds for one mitigating circumstance if the jury could see a compilation of Cindy's public rants. It wouldn't excuse her actions but might sway a juror or two towards LWOP.

IMHO HHJP is more versed on the layout of this case then the defense at times...He has helped them out bit by bit at times just with court law and whatever...

A health emergency is pretty much the only thing that will get her out of it, and even that will only work temporarily.

Agree Zoey - While he doesn't watch TV (doesn't sound like he has the time) I'll bet he has read every document available to do with this case, and I believe that would include the Morgan depos. HHJP always appears to know much more about the case than the defense does, and he is beginning to show his impatience with that.

Now we know why ICA mouthed "I love you" to CA at the end of the last hearing. She needs her again.

Thank you for reminding me what a mean, vicious b**** Cindy is! This woman is COMPLETELY out of control.

Is the judge allowed to read/see/research all the public info on this case, or is he restricted to only seeing what is presented in court?


Could George Anthony's health be a legal reason for Cindy Anthony not showing up?
