I am not a lawyer, but I think the idea behind the expectations of both partners getting some share of the family savings at the time of a divorce is that that a spouse without paid employment who has stayed at home to watch minor children has, in effect, made it possible for the other partner to work and accumulate the wealth s/he has. Thus, in normal proceedings, s/he would have some reasonable access to the family wealth accrued during his or her unpaid service in the home.

Now, that is in theory. So don't take it as an endorsement in this case, as I don't know the particulars, at all.

they will calculate her expenses out a year, and allow time for her to get on her own feet (transitional).

and oh! yes, she has very significant expenses, by the way...
criminal attorney fees, then family attorney fees topping the list.

And yes, this is why you remain on your best behavior when divorce papers are serviced (either side) and you do not start sexting your spouse's friends.

And yes, this is why you throw every allegation you can dream up upon your soon-to-be-ex. And that goes both ways.

I feel for the family court judge. His/Her Honor is going to need a lot of chamber breaks.

The only reason she doesn't have a job is she got canned as a result of her child endangerment conviction. So I see no reason that it be just and equitable that Kaine pay a dime to her after only three years of marriage and when there is nothing wrong with her physically that would prohibit her from getting a job.

Not to mention, as the non-custodial parent, she should be paying him child support.

To the best of my knowledge, Terri has not been gainfully employed since she became Kaine's "live-in". She reportedly gave up a teaching position to move in with Mr. Horman and care for baby Kyron. The rest is history ;)

This is not unreasonable, if they had a joint account and he has not allowed her access to any money, she is going to have a hard time paying a deposit or rent on any place else to move out to. I would think access to enough funds to do that would make KH's life a whole lot easier if it would get him back home faster.

Someone can still have savings from prior employment, inheritance, heck - she could have won a small scratch off lottery ticket. Since we don't have their bank stubs, we don't know. It's not unreasonable to assume someone of her age will have contributed, at least in small part, to the family's finances.

Plus, as WhyaDuck? stated, many states do tend to give support to spouses that stay at home with children.

Unpopular opinion, but I agree. How is she to cover the costs of moving if she has no money? How is she to find another place to live? She's probably limited in her access to their joint accounts - and she has not been convicted of anything. I don't think it's fair or equitable to kick her out completely destitute.



So we should follow the law....but only when we want to? I don't think that's how laws work.

I dont think..the way the laws work your supposed to make children disappear that you have raised or try and hire someone to kill your partner. Likewise I dont think its fair to not try and find t he missing child. But thats just me i guess.

If she is destitute so what? If she has to live in a cardboard box so what? She will most probably still be better off than Kyron is :(

Hell, I bet we could get dozens of volunteers to move her out of the house asap.

Why does it seem like Terri still has the upper hand even with everything that's happened? OK she may be entitled to some money but she needs to START TALKING. jmo

IMO it was interesting phrasing that it was previously reported that Terri agrees to move out of the house but now we find out that she first wants to be paid.

It's like I told you that I've agreed to give you my car, but only if you give me 10.000 dollars.

That's not an agreement, that's a sale attempt.

Talking about cars - if she needs money why doesnt she sell the mustang?

That's not an agreement, that's a sale attempt.

There is no proof Terri did anything, and her affair started after her husband left her. In this instance then, using your example here, it is a sound business decision to give someone your car for 10,000.

If she has been charged and out on bond, I could see the argument that she's got nerve asking for support. It isn't about what's appalling, it's about what is legal for a woman in the State of Oregon being thrown out of the family home to expect from the spouse doing the throwing.

We can be appalled in the public court of opinion, but Oregon still has to follow statutes set by the law.
