He didn't say when and she wanted money to move out. I think Kaine wants her out sooner rather then later, without giving her a cent.

I know I wouldn't - I'd be all up in arms that I was being accused of horrible things, being kept from my baby and being forced out of my home in the process

I also wonder why he doesn't just change the locks while she is gone... have LE waiting at the end of the driveway to inform her when she returns... pack up her stuff into a trailer and have it taken to her.

I really wish that he hadn't left in the first place.... I am really worried about Kyron's room. She could trash the whole house and claim it was broken into... and they couldn't prove otherwise. I do hope he puts in an alarm system and has some form of security at the driveway, at the very least.

However, it is also possible that he is more comfortable in his own house. Because he knows they will find him no matter where he is. At least in his own house he knows what noises are normal, exactly where everything is, how to get in and out the fastest if someone does come in, etc. He may feel he has a slight advantage on "his territory."

I hope that it gets done fast... I just want her out and want to know that Kyron's stuff is all okay.

Perhaps he needs her officially & legally ousted quickly before her arrest.

Once she was arrested, it might be more time-consuming for him to formally oust her. Not to mention, if Terri was arrested, she could post bond and move right back in if the matter was not settled ahead of time...

Kaine is at Starbux, having a calming, soothing cup of Zen tea, he reads the following in a newspaper comment: TH has had a friend over who has a young son, whom she allowed to play with Kyron's toys. He is understandably shaken, and asks his lawyer to get her out now.

But good for him. I've been worried about the condition of the inside of that house. There is no telling what she has done, especially to Kyron's room...I really hope it's still in one piece and just how he left it...

Hopefully he has a really good alarm system on that house, and if I was him, I'd be getting a pair of big dogs to scare her off if she tries anything. The faster she's out, the better. No more sitting on her butt waiting for a handout...

I couldn't imagine letting Kaine letting that woman live in his home while he believes she had something to do with his son's disappearance. If that didn't make him burn the house down just to preempt her existence there, her also having some role in a murder plot against him should... but if that doesn't do it, surely he'd want her to leave after he has text sex with a childhood friend. But if that somehow isn't enough to make him want her out asap, her wanting to get her hands on this other child may. Not to mention she still has access to Kyron's room and all his belongings. I'm sure his disgust-o-meter blew up a while ago.

I also don't think this has anything to do with some law enforcement strategy. In fact, I bet the only reason they told him about the murder for hire plot at all was because they had to. It was his reaction to that news that made all of these sordid details public. It couldn't have been avoided.

I have to agree that I would not feel safe there w/ Terri still free; however, how safe can Kaine really feel at any place? Terri and her sexting partner have already gotten his new address and google mapped it. Who knows if they have actually been there or what they might have been planning or are still planning. Why would anyone map it unless they intended to go there? What were their intentions? Kill Kaine? Abduct baby K? Both and disappear? What else does Terri have to lose at this point?

While I agree that google mapping the new address looks really skeevy, in fairness I have to say that it could have been done with the innocent motive of making sure of the place she has been ordered to avoid.

By including his new residence in the RO, that means that if TMH so much as drove past his house without stopping, that would be probable cause for arrest. If I were TMH, that would be enough to make me want to take every possible step to avoid violating the order. And that would include googling it if I weren't previously familiar with that street or area.

Actually I wondered when she was going to move out also. In the attorney's answer there was no time set. I don't blame Kaine at all.

There was, however, a hearing already set for 22 July 2010. One week from today. It's not like there hadn't been a hearing date at all.

If I were someone ordinary, who had to stand in line like the regular folks for my court dates, I might feel a little peeved that KH can't wait a week. And if it were my hearing that got bumped to make space on the schedule for KH, I'd be more than peeved.

Perhaps I am being unduly cynical and the judge in the case will give up his lunch time or stay late so as not to disaccommodate any other petitioner.

Due process is what I believe you are missing.

KH chose to leave his residence with baby K, which is his right. He does not have the right to unilaterally throw the other legal tenant of the household out without any legal recourse for that tenant at all. Sure, people do it but that doesn't make it legal; speeding is illegal too and I see no shortage of offenders.

In a case with such a high level of scrutiny, I am sure KH and his lawyer want to stay on this side of the bright line between legal and illegal.

Is this an overstatement, or the actual rules of the forum? I'm asking because under lots of laws in lots of states it is perfectly legal to commit "bodily harm" on someone under certain circumstances. For example, if you are threatened with deadly force in your own home. I wouldn't hesitate to post that, since it is the law. Are you saying that stating the law is taboo? Not trying to be cute, but I really am having something of a hard time figuring out *the rules*, and I can see myself jumping in on a topic like that and saying what the law is about deadly force.

I don't understand why he wants to go back to the house. He was so focused on keeping his current location secret -- was that to protect his daughter? to protect the person(s) he was staying with?

But now he is going back to an address Terri clearly knows.

Of course. I agree, the google could be innocent. In fact, I did that with a friend who got a TRO in a civil rights/free speech matter, we needed to see if any of the adjacent corners were inside or outside of the area since we wanted to continue demonstrations. No biggie, on its own. IMO
