This makes sense. Separating the three issues at hand: Divorce, visitation, and criminal charges, seems to be a good way to protect Terri's constitutional rights while allowing civil proceedings to continue and await any criminal charges.

Maybe the attorney (attorneys) had a plan all along? Maybe they knew how to work the issue within normal legal, ethical steps and decided to do things that way. IANAL so don't know, but it's starting to seem likely. moo

If I were Kaine, and I believed TMH had anything at all to do with Kyron's disappearance, I would do everything in my power to not let TMH within 200 yards of my child.

If there was anyway possible to have my attorney fight to keep TMH away from K, those would be my instructions to my attorney!

terri has never spoken a word so I don't think we can really know anything at this point, moo. This is the first that we have heard that she wants to delay the divorce for up to two years and get visitation in the meantime though

? Did lawyer just change his statement? I think he said today that she's ready to agree to an immediate divorce and even divide assets today. Am I in the wrong thread? eeeck

I've never read any posts that indicate that TH wanted nothing to do with the baby, but rather how odd it is that she would wait 3 1/2 months to stand before a judge to implore for her parenting rights in the event that she is INNOCENT of those things KH listed in the RO that she didn't contest. JMHO, though.

This is why I am cautious about assuming--just because we never "heard" about Terri wanting to see her baby doesn't mean she didn't want to see her baby...the proof is right here that she did and does want to see her baby.

No, earlier it was reported that it could take up to two years to sort through all the muck. Today the attorney stated he would proceed straight to a divorce if Kaine was willing to divide everything today.

they are hearing abatement right now which is delay of the divorce. We are on the thread for the trial and that is what they are arguing now (money is up next)

She could have been fighting to see her daughter from day one for all we know. Seriously.

Can Kaine testify against TH is they are still legally married if and when there is a trial on KYRON???
Because Kaine just might go along with anything to get the divorce to do so.
I just have such sad feelings for Kaine, looking at the person he thought loved him and his son, yet hired someone to kill him (???) and his son gone, marriage over.
So many emotions.............wonder if anyone is crying in court.............would like to know if TH is or not..

Terri's attorney argued just this, today. The State refuses to turn over evidence, evidence they apparently truned over to Kaine Horman about a MFH plot including the 911 tapes that Terri made the night of the foibled sting operation, to proceed through a civil case. They argue that it provides one side with an advantage, and forces their client into a position of having her 5th amendment rights violated by having charges like this where she cannot prepare a defense due to not knowing what it is the State provided Kaine and seem to accuse her of.

This same violation was used to get a restraining order keeping her from her child.

Separating the divorce, the custody issues, and the criminal charges (if any should ensue) is what the lawyer seems to be attempting to do.

Really? I've only been involved in one trial, and I was always of the opinion that more got accomplished in lawyer-to-lawyer chats in the hallways and in the judges chamber than ever did in the courtroom!

amen! That is what I am saying... that it is hard to have an opinion on anything to do with Terri when she hasn't said a word... nor has her lawyer on the issue. That is what I meant in my last post that this is the first we are hearing of it.

And it seems to me that Houze is banking on KH not being willing to give Terri half of everything today and perhaps forcing him into an abatement (unless he has come prepared).

I agree with those have posted that this is a strategy to get Terri visitation with the baby.


eta: not that I necessarily agree with it or think it is a good strategy!

This is true. I don't spend much time reading various forums, but I recall that one day, somewhere, I read a post where someone said that TH had never cried for Kyron, NEVER. And I thought, how does anyone know that?

We only know the tip of the iceberg. And, as we were all taught, 90% of the iceberg is below the surface.
