I don't know, Maschula...but I believe a gag order is just that, it would stop the flow of information under the sunshine law...perhaps this should be asked on the lawyer thread...however, I do recall JSS did say a gag order wouldn't apply to CA...that I recall hearing...so maybe you are correct...JMHO

The gag order would have only silenced the lawyers on both sides from commenting on the trial. It had nothing to do with discovery or the sunshine laws.

When Cindy rose to ask a question in court that day, Strickland told her the gag order wouldn't apply to the family.

So I guess the judge declared this issue a moot point w/ Baez yesterday without a hearing on it? He said he read from it that Baez just wanted it stated on the record...so this issue is put to rest now?

That's what I understood, it was a standing objection for the record and the motion does not need to be heard. The Sentinel filed their motion to intervene just to be safe in case there was to be a hearing.
So, even though it is very well written and takes a few pokes at JB it is moot at this point.

As a Canadian, I find the Florida Sunshine Laws fascinating. What we have in our country is a blackout on any court proceedings until it is over, and then the media or I guess a private citizen can apply through our freedom on information laws to get the real low down.

But what we get is Mr. So and So is in court today facing charges of blah and blah with a possible sentence of blah blah. Nada during the trial except maybe for a blip from either side of lawyers about the tough slog through the evidence or that their client is holding up well, but beyond that - the next thing we hear is the jury is out, the jury in back and the verdict is guilty, sentencing will be such and such a date. End of story.

We are just now beginning to hear details on the Robert Pickton trial, who murdered at least 26 women and more likely 60 or more, and we will never hear all of them because many of the "details" are considered too gruesome for public consumption. And only because of the mega messups by our national police, the RCMP, that information is finally surfacing.

Maybe its just me but Jb's color codeing was hilarious and I was curious as to what color he uses if the depo's were 3/4 done and does everyone receive new papers when the colors change. Oh yes and could'nt help wondering if
he has the Co- counsel on color codes. One color for leaving, one for ready
to leave. One for not showing up etc.

This was probably Casey's input and project.
She does have a limited amount of colored pencils......and her mother does have dreams of her bright and shining daughter going to Law School....some day....when she parks her RV I guess during the winter months??

He objects (via motions and soundbites) to the release of KC's commissary orders. Ummmmmmmmmmm... Do "hot cocoa and sports bra" have some other meaning that I am missing?????

But he allows the comments (read soundbites) made by his HBF (Hispanic Best Friend aka Geraldo) painting KC as "guilty" to hang out in the media wind without a rebuttal?

Oh wait.....maybe we will hear it after the Geraldo Retrospective TV Special.

How true! He'll attend the birthday party of his HBFF and it's ok if he says she is a guilty, selfish dimwit... but god forbid...DO NOT mention cocoa. WTF?
