2011.03.18 Order Denying Defense Motion to Suppress -"Agents of the State" Motion

On the night of the phone call, I don't think CA knew she was dealing with a murdering daughter...a lying, thieving, conniving daughter, maybe.

She had long covered up KC's minor crimes (I have a friend who bails out every single one of her adult son's misdeeds and crimes).

So despite KC's lying and thieving, I do not think CA would have ever imagined KC capable of killing Caylee. Nothing so far had indicated that KC had violent tendencies. If KC had been gradually building up to and committed violent acts, CA might be able to wrap her mind around the possibility of her being able to commit murder.

But KC's minor crimes did not alert CA or anyone for that manner, that KC was progressing to something much more heinous.

If she could believe it I think she would have turned her over to LE, but instead, the night of the phone call she wanted KC arrested for
"stealing" a car she had been allowing her to drive. I don't think murder was on her mind. Even with the death smell. She could not make that leap.

So now, despite the facts of the case, it seems as if she still cannot believe her daughter could commit this sinister act.

Yes, I'm with you on this one - I think they "knew" ICA may have been involved in something pretty terrible that involved a dead body, but just don't think they were able to make the leap that it was Caylee.

And I'm no longer certain CA cannot now believe ICA has done this - I think she is very afraid she has - and if ICA has, CA is also very afraid ICA will be put to death. I don't believe CA thinks in any way that ICA will walk from this.

Just thinking of depos and testimony by the way, although CA claims she has not watched any of it - she may very well not have. However I believe she watched her own civil deposition and was horrified because we have never seen her wear green again. LOL

Someone put together a montage of pictures from the civil deposition. She needs to study her body language and never act like that again. I think this was two weeks after Caylee's memorial service.

No, they aren't are they? Despite how much they would like to appear to be.

When George testified "I'd sell my soul to the devil to get my granddaughter back" the thought that crossed my mind was "You already have, George. You already have."

During the upcoming trial, I expect Judge Perry will not tolerate a whole lot of "behaviors" from either George or Cindy - or anyone else for that matter. I also expect that whether or not the Universal trip evidence comes in or does not come in, there will be a fairly speedy conviction.

Off topic, but I wanted to comment on it: I finally got to watch that Jane Valez Mitchell show from when they discussed the hearings. I did not think it was particularly slanted to support the defense as I believe someone else had perceived it to be. I noticed at the very end of the segment, one of the female lawyers - I think her name is Stephanie, from Florida? - said "It doesn't really matter if this evidence comes in or not. They have enough other evidence to convict her with no problem".

As I see it, the only question is whether or not there will be a death penalty recommendation from the jury.

Cindy scares me sometimes... watching this video is one of those times. I have never watched deposition since it was released... now I remember why.

She must never watch the videos of her appearances or she would stop that CHOMPING.

The whole family scares me. Even now, when Cindy is relatively calm, I'm on pins and needles waiting for the crazy to come out.

I watched some of those depos today and she responded to one of the questions saying something like 'Casey is a grown adult with a child of her own'. She said it in order to dodge a question.

Cindy and CM need to get their stories straight. CM still thinks Casey is a 22 year old child. :waitasec:

Baznme, are you talking about the part where she says she was read her rights? No one will be playing that part, because it is irrelevant. All the statements they want to introduce from her were obtained before she was read her rights, and HHJP has ruled that they will come in anyway.

Faefrost, I assume you were NOT talking about that part of the video, since there would be nothing helpful to the defense about Casey being read her rights. But you are correct that the defense couldn't introduce a video of Casey telling "her story." They also can't ask Lee what Casey said. The SA can, though, and will. :)

I stand corrected. Thank you. I actually was trying to make the point the judge surely would have seen that tape to clarify that she had indeed been read her rights as it seemed to be Baez's objective to bring to the forefront that KC had not been read her rights. Even YM admitted he had never read her - her rights. So not only was Baez wrong, so was YM. I believe this may have been influential regarding Judge Berry's decision on the latest motions by KC/Baez. I guess I'm anxious for the trial to begin, already referencing a "jury"....LOL

AZlawyer, I have a question...... Why does the State of Florida record these jail visits if they can't be used in a court of law? What is the purpose of the recordings? They are released as public records so I don't understand that.

I would think that if there is something relevent in them, they will use them.

They can be used! But sometimes they will be irrelevant, hearsay, etc., just like any other evidence.

Everyone knew her rights were read on July 16--CM just screwed up when he did his argument. Also, it wouldn't matter if her rights were NEVER read, except as to the statements the SA wanted to admit as evidence, and as to those statements, everyone agreed her rights were NOT read.

She never gave any statements to LE after July 16, therefore it doesn't matter whether or not her rights were read at that point.

You can't get a case dismissed because your Miranda rights were not read.
 
The reality is, Cindy is not the one responsible for Casey's actions. Casey murdered Caylee... not Cindy. Casey is going to get whatever punishment she gets because of her actions.

I know we like to put a lot of blame on Cindy and George... we've blamed them both for the person Casey has become... and a lot of it is true. I do think they raised a monster... but at the same time, Casey didn't have to murder Caylee. If she really wanted to hurt Cindy... Casey could have worked hard, gotten State Grants to continue her education, moved out of that home with Caylee and make a damn good life for just the two of them. She could have done all this the right way, but she was just too lazy! She didn't want to put the work in... like her father! Caylee didn't have to die!

Casey loves every minute her parents are up on that stand being tortured by the lies they are telling... I believe it gives her great satisfaction to see how they are choosing HER over Caylee. I could not even believe that Jose asked Lee whose side was he on? Thank God he answered Caylee! I'm not so sure whose side Cindy and George would have chosen... they would have had to think about that one. I would have loved to hear it though!

Well, if it is true, and Cindy and George will be sitting down with Insession this upcoming week, we will get to see how angry they are that they couldn't prove themselves "Agents of the State."

Re the bold: Spot on, succinct and tied up with a pretty little bow! Casey was always jealous of the attention Cindy gave Caylee and, imo, it was the main impetus for Casey murdering Caylee - because she is "a spiteful b*tch". One of the saddest parts of all of this is it has worked for her. She got her way AGAIN. She is back to being Cindy's #1 priority. It works for Cindy too, because she gets to shine in the role she cherishes so much - the ultimate martyr. "What kind of mother would I be if I abandoned my child?" Their attitude regarding Caylee's death is "What is done, is done. Moving on. Our mission now is to protect Casey."

After all they've been through and almost 3 years later, absolutely nothing has changed regarding this family dynamic. They don't get it because none of them are willing to take any responsibility for their mistakes. They don't see their role in any of this and I honestly don't think they ever will. I don't believe anything will ever change.

Now we know why she refuses to watch anything else after she saw her own disgusting behavior in this video - and why she now plays "grandma mouse" when she gets up on the stand and testifies.

I don't know if it is true or not, but when I sit down to write, I always chew gum. For some reason, it makes me think clearer?
