Seems the judge was smirking at the states complaint....just brushed it off and said follow the rules. So...how does the state get discovery from JB? :waitasec:

They have already filed 2 motions for Reciprocal Discovery...
They should do like Baez does so often and file another Motion, the first 2 were heard by Judge Strickland and the Defense has yet to comply.

ICA doesn't appear to remember the names of any of these people in jail. Baez thinks she may recognize them if she sees them and then connect testimonies - or at least that was the connection I made.

I don't think HHJP knew whether to laugh or cry. I wonder if he's ready to have a few stern words to HHJS about stepping down and forcing him to listen to this crap. If that conversation was happening, HHJS wouldn't be able to hear what HHJP was saying because HHJS would be on the floor laughing so hard.

Hopefully they'll have plenty of fun nights and weekends to work on it!

And they should! When I prepare for trial I sure as hell work late nights and weekends. The amount of hours you put in for trial prep is unreal! And so should they!

Nobody told him the point of adding a colour to prioritize, is so you can sort by them.

You are correct. I've seen cases where the document count is as high as 150,000 pages. These documents are scanned in, they are usually searchable, indexed, etc. It's not like someone just dumped a forest full on paper in his parking lot.

Do we know if Baez knows where to find a Document and if he can find it, how to open it? He did describe "his people" as computer challenged. Maybe that was third party-speak?

JB wants depos of the correctoional employees done at the jail because ICA reports to him something that so and so says or does but she's not good with names so they want to do a line up thing I guess. Or like Logicalgal said. I was laughing and may have missed the details.

There are ways to organize your discovery to save you time and money. Baez is just too lazy to put in the necessary work to make his life easier down the road. He wants everything handed to him on a silver platter. Litigation doesn't work that way.

If JB could be given one magical power during each hearing which one do you he would choose?

a. The ability to recall greater that .035 % of the Rules of Criminal Procedure.

b. The ability to freeze time in order to locate by color, the answer to a question without the painfully loud ticking of the clock.

c. The ability to complete a sentence without using the terms: "actually", "well", or the phrase "I don't see why that won't be possible".

d. The ability to instantly create a large cloud of smoke and drop through a trap door in the floor.

I vote e.) the ability to always have the cameras focused squarely on himself

Really, they are going to set up a new lab in the US within 30 days ..and Baez expects the Judge to take his word on that? sure, sure LOL

You (and I suspect that JB) missed the key element to this. The defense can use any US lab they choose (pending certification arguements), but HHJP did not change the deadline for evidence reports from expert witnesses. That's still Oct 31. So if this outfit will not be up and running in Denver by then...

She does not want to attend her own Status Hearings and she has never sat in on any other depo (don't know if she is allowed to or not) so why this one...the excuse provided is not a compelling one...they could show her pictures with the names underneath.

Intimidation of the witnesses? Most people would be less inclined to speak badly of someone sitting right in front of them. But as to why these witnesses and not others, IDK.

Too true, Judge Perry told them on a previous occasion that there will be absolutely NO ambush tactics in his courtroom, but you know Mr Baez is very slow on the uptake and is not known for taking NO for an answer.
I liken Baez to a petty thief. He gets away with something and he goes for a bigger target. He's gonna get caught eventually.

Are there NO touch DNA experts within the United States dumb enough to take this on?

They might have to go through that many documents. Even if they do with that many attys at their disposal and with many years of experience between them all 23k worth of documents shouldn't take long. 23k in litigation is a small sum. Truly.

In a single production I've sent out 40k worth of documents (and it was just a single production) that needed to be gone through and labeled for confidentiality designations etc. If done in an organized manner it can be accomplished. But you can't be lazy about it. And JB and co. are lazy. They don't want to work hard. I hope Honorable Perry makes sure they DO work hard.

I know what you're saying and you are correct. However, you work with a HUGE firm that handles big cases. Baez can't even hold on to even one partner, doesn't have one competent paralegal and has NEVER handled a case 1/100th the size of the cases your firm has handled.

For instance, when they did the depos of the 35 LE in one day ( :rolleyes: ) I seriously doubt they reviewed 23,000 docs in TOTAL, much less 23K for EACH one of them. Honestly, after listening to CM and JB, in all seriousness, I doubt they have reviewed 23,000 docs during the past 2 years. And, yes, they are most certainly lazy. There are 5! attys. on the defense team now. There is ZERO reason they can't divide up these tasks and stay on schedule.

Exactly. And certainly not receive certification by then.
