Is there actually a motion to keep out the jail call home?? :waitasec:

I don't think so? But I read the witness list and the things that would be submitted and it says Casey's phone calls from the jail? Good question?
 
Sorry guys - this looks like I wait until every one has gone to bed and then I slip in and argue with everyone. But - er - um - I am three hours behind most of you.

Just wanted to take a moment to explain my questioning. The real problem is the way I think and how I problem solve. So pretend my problem, (or a presentation or a sales pitch or whatever) is a tree. My whole "thing" is clarity, then a logical process, then I add the do dads to flush an idea out and make it look "pretty".

So if the SA's case against is a tree with bark and a gazillion leaves, what I would do is strip everything off, including the bark, and just have it there naked. Then the most important evidence would be the bark I would add. Then as needed, I would put the details such as this conversation(although I think there are more important ones) back on one by one until I was satisfied the finished product was balanced, but not overloaded by too much so - haha - you couldn't see the forest for the tree.

I should probably just go to bed and quit trying to explain. I just know for sure that a lot of the times a lot of detail is just too much and overwhelms the listener, so basically they absorb little or nothing. :nevermind:

The prosecution did something like you describe by stripping the tree and putting back.
They were trying to explain what reasonable doubt was and had a huge white board in front of the jury. As they made their closing and discussed each small piece of evidence, they removed a sheet of paper from a random place on the big white board, revealing writing underneath. By the end of closing statements most of the pieces of paper were removed revealing that the saying underneath was reasonable doubt. The prosecutor then explained that it didn`t mean you had every piece of the puzzle but enough to make the correct verdict and pointed out they all could tell what was written on the board even though many of the letters were still partially obscured. It was amazing to watch!!!
 
Wait...that's the motion about the smell. Is there any mention of the smell in the "huge waste," "get me Tony's number" phone call??

No... I'm close to having this phone call completely memorized. No mention of the smell.... unless Jose thinks that when Casey stated that it was a "waste" he actually thought she meant "trash waste?"
 
No, but the motion seems to suggest that the statements the defense wants to suppress (not likely BTW) start after July 24, and I think that first phone call home was July 17, so I don't believe it's covered by the motion.

So, they had a chance to ask and blew it, it's past the deadline now, too late to amend? Is this the State's way of preventing this?

The addendum looks like it just says that the State wants a hearing on its motions in limine. And I think they're being heard next week, right?

But I agree that it is too late for the defense to file a motion in limine re: the first jail call home. I can't think of any basis for such a motion anyway. :)

Unfortunately it was more like 'human waste' than trash or pizza.

iirc, Yes she did attempt to call boyfriend Tony ...she also called 2-3 other(Chris.S, Jeff H house..and ?) guys from jail within days of her arrest on July 16th...

11:30 p.m. After her unsuccessful attempt to speak with Tony L. on the phone, Casey placed a collect call from the OC Correction Facility to Chris S. After hearing the announcement recording and Casey&#8217;s voice stating her name, Chris hangs up the phone. She called back about 3 to 4 minutes later, but Chris did not answer the call.

this has always been ??? for me..it's July 16..everyone now knows Caylee is "missing", Casey is upset with her family, angry with LE and instead of focusing on Caylee and her family she HAS to call at least 3 guys from jail...
 
Great news! I actually feel like I really am getting sick! My head is about to explode! I may have to go home tomorrow after my mandatory 8 o'clock meeting!!!

Thanks for that and I wish I'd actually seen that - sometimes I feel like I sound a bit looney trying to explain my own thought processes. I mean - they make sense to me - but out loud - maybe kinda :loser: .

There is a huge amount of sidebar stuff about this case that just is so irritating and wrong - things like those conversations CA had with Tim Miller, the family attempts to prove everyone else but ICA was guilty of this crime, the family emails from CA's mother and brother - stuff that makes me think what the heck goes on in this family.:maddening:

But whether or not these things are solid enough to bring in as evidence in a trial - that I don't know. I just know I get swept away with what seems morally wrong and have no clarity at all on whether or not they are also legally wrong.:waitasec:

I know I want justice for Caylee.
