2011.01.05 Hearing TES Volunteer Computer Subpoena

If you read JJ's statement to LE it is very clear that they were NOT permitted to have cameras and the pictures he took were of items he and other searchers found in JBP prior to TES coming into town. This statement was given in October of 2009 so that pretty much sums it up. My guess is Judge Perry read that statement prior to the hearing and is quite aware there are no pictures from the TES search of Suburban Drive. This is personal, very personal for JB. I think that LB is going to have a significant effect on JB's future as an attorney and he blames JJ for the fallout from LB. From our famous TWA: "You just can't make this stuff up." jmo

Well thanks TWA, because I read it and it was very interesting. Obviously if JB had read this statement he would have never filed that motion because it was quite clearly stated, no pictures were allowed to be taken. Oh, wait, he did read because JJ talks about turning over information to LE and now didn't JB bring that up in court. Maybe JB was hoping his honor did not read that statement. lol
 
That right there was why HHJP could not grant the defense a subpoena.

While NJ Lawyer's opinions are compelling, they only become relevant when or if Baez can substantiate the blogger, JJ, has any photos at all. Baez didn't do that; he only speculated.

What it came down to at the hearing was, imo, HHJP asking, 'Where's the evidence that the blogger took photos, and the evidence that the photos he blogged belong to him?'

Baez's answer amounted to, 'Um...he pointed to a map.'

He was going in circles.

I'm not a lawyer, but I would think no judge is going to issue a subpoena based on speculation, because that's not "just cause".

It really comes do to: What photos? Who took them? Prove both.

Of course, I'm willing to stand corrected by one of the lawyers here.

ETA: If Baez would have done his homework, he'd have that subpoena.

Just my opinion.

Sometimes I feel like I care more about what's going on with the evidence in this case than he does. His efforts just seem so half-hearted at times.

Based on NJ Lawyer's posts in this thread, he/she would be far more dedicated to making sure KC's defense was exhausted.


JB has a defeated attitude. He knows he's in over his head and not going to win this case. He had a lot riding on this case......it's a high profile case he thought was going to make him rich and famous. When you compare his arrogance in the beginning of the case to now, you can easily see the difference. He's still arrogant, but without any of the confidence he used to have. I think your description of JB being half-hearted is on target.

Every court hearing is showing how ill-prepared JB is at handling this case and courtroom procedure. His lack of experience is very evident. After the trial is over I doubt the media will be clamoring for interviews with JB, nor will there be any interest in a book on the case from JB's perspective.
 
Bottom line for me, there are laws against unlawful search and seizure, and those laws are not just applicable for people in custody. IMO, granting the defense motion over JJ would be saying because person A got arrested and charged with a crime, you, person B, are going to have certain rights taken away from you.

I completely agree with you, Lanie. CM made a comment the other day at one of the hearings something to the effect that KC was the one with the rights. (Forgive me - I don't remember his exact words, but it was the hearing where Rachel Fugate argued about the photographer zooming in on photos.)

KC is not special... everyone else has the same rights she has. I understand that KC is the one on trial for her life, but that does not negate others' rights. Besides that, her defense is trying to blame the murder on someone else, so protecting their rights is every bit as necessary and important and CRUCIAL as protecting KC's.

Yeah, that entire motion and hearing seemed like more of a huge gripe against JJ than actually trying do something to help Casey's case at all. That just seems to be extremely unprofessional of him or any lawyer to do.
 
I think I have mentioned this here at WS before, but if anybody (back in the day) has ever read the book Helter Skelter by Vince Bugliosi regarding the Manson murders and subsequent trial....I believe it is a preview as to how this trial will go as far as the defense tactics. Manson made a mockery of the judicial system when he was representing himself...by objecting to each sentence of the prosecution, rambling on and on and on, etc. It took 4x as long as it should have to finish the trial due to his antics. That, IMO, will be how JB and CM conduct themselves in the courtroom.

I 'm very familiar with the Manson case/trial, and have read Vincent Bugliosi's book........think I still have it. Yes, that trial was a mockery of court procedure.

Off tropic, but my sister owned a ranch not far from the Spahn Ranch where the Manson "family" lived. I lived with my sister prior to getting married, and she was a nurse working the night shift. When she was working, I was alone on a 5 acre ranch at the end of a dirt road - no street lights, surrounded by orange groves, and nothing behind the ranch but thousands of acres of mountains. I always felt scared at night. I called LE twice during the 2 years I lived with my sister after seeing lights in the orange grove at night. When the Tate-LaBianca murders happened and some of the facts emerged........I learned that the "family" was scrounging food from the trash bins behind the supermarket where we shopped, and creeping around houses in the area. I have no doubt that I had reason to be scared being alone on my sister's ranch at night.

I agree with you on some things, he does know he's in over his head, he is ill-prepared but I don't see a lessening of arrogance or confidence. You only have to read his emails to Mr Ashton and observe his willful and deliberate defiance of the court order to see that his arrogance is very much present and accounted for. I don't see a defeated attitude. I saw a pissy attitude at being sanctioned and I saw a pissy attitude at Judge Perry because the Judge was cutting through his BS at the JJ hearing and putting him on the spot. Baez doesn't like being cut off mid sentence or when his rhetoric is stopped short. Baez was very confident, in my opinion, that the Judge was NOT going to sanction him, hence his very responses to the Judge at that hearing.

I remember very well the words of Richard Hornsby many months ago saying "this defense team is lazy - they have done no work!"

And that he went to Suburban during the time of the TES searches and would not have a camera, ..Now I still haven't found IF he went to Suburban on another date...but I think not.

I agree.....I also have a suspicion this is a bit personal for Baez..just like IMO the way he responded to Ashton in the emails concerning the Discovery..to me it was personal and pay back for the States (Ashton's) response to the DP motion when he only listed the Statute numbers....

It was creepy and I was really scared being alone, but in retrospect after learning that the "family" was scrounging food at our local supermarket, and doing what they called "creepy-crawling" during the night, I was even more scared thinking about what could have happened.

The "family" was engaged in this "creepy-crawling", in which they practiced entering a home and creeping undetected through a house while the homeowners were sleeping. My sister's ranch was close enough to the Spahn Ranch where the Manson family was living, and remote enough that it could have been one of their targets.

The Spahn Ranch is gone......burned to the ground during a brush fire, but whenever I drive past it I still get goosebumps knowing what happened and the history of that ranch.

On the premis that the pundits and talking heads will acquire great wisdom after the fact, I can see the regulars on JVM, NG etc slating Baez for being a rookie lawyer who let his inexperience and ambition cloud his professional judgement. They will debate all possible plea deals and various defenses that could have been advanced.

And whilst that imo is mostly true, one has to consider Casey Anthony ultimately calls the shots.

If I remember correctly he said it was ICA courtroom. I was personally offended for all the taxpayers of Florida - as I believe it is THEIR COURTROOM. CM - reminds me of those words KC spoke, "Waste, total waste."

OMG - I am of "an age" that I remember the Manson Group very well. My skin is creepy crawling plus shudders just reading about where you were located and yes, I recall that they sneaked around while good folks were sleeping. Ugh!

I still cannot watch a news clip of him speaking - it brings the horror of it all back.

Gosh Paintr, I don't think anyone would want him for those jobs either. About the only thing I can think of that he is capable of actually doing, and not messing it up, is........ cleaning up after the horses you PAINT! But, then who would pay him for an invisible job? hehe

(Note: You never see poop droppings in Paintr's beautiful paintings. Just wanted to clarify so nobody takes me wrong!)
