2011.01.05 Hearing TES Volunteer Computer Subpoena

OK, so if JB's motion was denied, what happens with JJ's motion for protective order? Does that get granted, denied or go into legal limbo land?

Didn't we know about Joe Jordan months before the defense deposed him? Didn't people on here and IS trace his blogs and websites?
I don't get why Jose says he didn't know about them beforehand. Surely if he was important enough for Jose and Mason to both be there when he was deposed a little google action beforehand would have made sense thereby discovering his blogs beforehand?
I think it would have made sense for one question for all those being deposed to have been-have you posted on the internet about this case? (as is your right!!!)

Pretty much all those with RELEVANT information have kept quiet (Tony Lazzaro, Rosciano (sp)Amy, Mark Hawkins etc)

I would like to take this opportunity to thank Mr. Cheney Mason for filing that motion for recusal. That has been the best thing they could have EVER done for Caylee.

They have bitten their nose off to spite their face in more ways than one.

eta: And I mean that as absolutely no disrespect towards Judge Strickland. But Judge Perry is sorely needed here.

I so second this....THANKS MASON!! :seeya:

Hmmmm... That sounds like a great idea for a new JibJab video!!!!
Where can we find the old one???:waitasec: Is it on JibJab.com? Was that just Joy Wray's posting of their heads on Elf bodies???

Yes, Joe was a poster here. We know Cindy read Websleuths, she could easily have told him!

Granted or forgotton. Either way is OK. :)

We knew exactly what JJ had posted, and so would anyone with an ounce of sense. It wasn't like he posted under a pseudonym FGS. (I will let CM look up FGS himself.)

I think there are hearings set up for some of the evidence, one being the Canine evidence, and JA is waiting for JB's experts report. He doesn't want to receive it Friday at 5:01 a couple of days before the hearing. He'd like the date moved up to sooner so the SA experts have time to look at it and build the SA rebuttal to JB's motion to exclude.

It's all about latest-minute filing Baez.

I think JA alluded to "4:45" at the end of the 20 days. I liked how he was grinning when he was talking about being more than happy to work with the defense on these scheduling issues, 'cause we all know who the problem is, and it isn't the State.

I really wanted to crawl through the screen and smack Baez upside the head. It irritates me the way he whines and whines about this expert discovery, like they (the defense) didn't even have access to any of this stuff until just a couple of weeks ago, and are now being forced to scramble around and get these statements in in an unreasonable amount of time. Those dogs "hit" in July 2008, and Caylee's remains were found in December of 2008. IMO, any decent defense attorney would have lined up an expert in July, if he was truly interested in casting reasonable doubt about the guilt of a mother whose daughter has been missing for over a month and a cadaver dog has hit on the trunk of her car, but at least in December, 2008, when there is no getting around the fact the daughter is actually deceased.

I'll quit now, since I keep a tight rein to keep from writing pages on how inept this defense seems to be.

Does anyone really believe that "experts" who are familiar with testifying at trial are going to be rushed to write a report? I think they already know what their opinion will be on what matter and have notes. Baez is such a whiner.

I think all these experts have already JB a verbal summary of what they are going to say. I think JB instructed them NOT to write reports.

As to the issues that JB talked about at today's hearing, I think he is frantically trying to figure out how many of his experts he can withdraw from the case and still have a semblance of a case left! I doubt he is going to call all of these people, and I would not be surprised to see him file a motion withdrawing a number of them from his witness list.

I think JB shot himself in the foot with this one. He either screwed up by not asking JJ about the photos during the deposition, or by his own procrastinating about actually working on this case, he really didn't know JJ was posting pictures? Or does he really know they are not of Suburban, and is trying to get back at JJ for changing his opinion and recording his investigator?
IMO, he is trying to get JJ in court to state that he originally thought Caylee wasn't on Suburban for a reasonable doubt issue. Why in the world would he think that jurors are so stupid that they will ignore the fact that JJ changed his mind and will say so.
He is just proving what an incompetent he is, imo.

I got the feeling that the defense is STILL trying desperately to squeeze at least 1 drop of credibility out of the Laura Buchanan mess - even though I believe she has been thoroughly debunked and discredited after the SA depo (which I hope we get to see soon!).

On behlaf of my good buddies that are Florida tax payers, I am very concerned. The costs the defense is charging the taxpayers for these depos and transcripts is a lot. How one sits down with a searcher and does not ask them if they took any photos or video of their seach is astonishing to me. It would be like going to the Oakridge Lab staff depos and not asking to see their reports.

I am less and less and even more less impressed with Cheney Mason having forty years of experience, every day. What the hell did they ask him?

OK, so if JB's motion was denied, what happens with JJ's motion for protective order? Does that get granted, denied or go into legal limbo land?

If the motion was denied - the protective order is nullified as not being needed isn't it - but left in "abeyance" in case the motion is brought up again.

How's that for a completely non-legal opinion?:great:

I'm pretty sure that WESH had it up, there was a link in the Daily News threads sometime in the last week I think - :)

Did you guys watch today's hearing. I did not know it was a live hearing??

Oh No!!! You MUST spend 15 minutes watching it - A CLASSIC! A definite "have to watch". It is beee-uuuuu-tiiiii-full!

He is the proverbial sloth. He got this case and proceeded to make himself look like an idiot when he examined Yuri Melich at the Bond Hearing. Why he was rude to him, I do not know. Melich is a detective doing his job.

The only thing Baez has done on this case is gain weight, get a new haircut and make sure his suits are ready for Court. Now the procrastination and sloppy lawyering is coming to fruition and he is being called to task and sanctioned. He will be sanctioned again as Perry said we may have to go to the 500 a day if things are not done (not verbatim) and Baez, stupidly shook his head, as if in shock.

I can see Cindy and George, especially George, hiring a civil lawyer to sue Baez for ineffectual representation when this is over. I know Cindy heard that part of Perry's parting words yesterday.

As we have all been told repeatedly, anything you put on the "worldwide web" is there forever and is in the public domain. If it was there, he could get a computer or internet expert to find what he is looking for, right? Come on JB. Do something useful.

Yep Baez just got schooled again in lawyering. Judge Perry does not miss a trick, Baez may have gotten away with a lot up to this point but yesterdays sanctions were a game changer. Baez does not seem to realize that yet. Mason wasn't having a bar of it today and had his back to Baez at times. There was no legal standing for Baez to go on his fishing expedition - Baez this is not TES all over again.

I can see further sanctions in the future, whether Mason will be untouched by these remains to be seen. Baez could be Mason's Waterloo and undo some of the shine on his stellar career. If Baez does not come up before the Florida Bar by the end of next year, I will be shocked.

The Bar needs to take a very close look at JB. This trial is going to land JB in the national spotlight. Does the bar really want the world to think they approve of his violations of professional ethics? Do they want the world to think they license unqualified attorneys?

Thanks to all of you who provided commentary to those of us unable to view today's hearing! I am always so grateful you are here keeping me up to date!

BBM

I honestly do not think he cares. I don't believe he has plans for one minute to continue practising law after the trial - win or lose. I believe he thinks he is going to be a big TV star and get that gig on Telemundo, Univision or wherever being a law commentator.

In his dreams at this point. IMO he is very simply a joke - a recognizeable joke - but a joke nonetheless.

Baez and Co. have got nothing, nothing and so we see these pointless motions filed one after the other. You only have to go back to the video of Casey on the day she was arrested for murder (will Worldaccording come in with a link? :) ) and the FBI agent flat out told her "we have more than that, we have a lot". It begins and ends right there. The state have more than enough.
