2011.01.05 Hearing TES Volunteer Computer Subpoena

Thanks so much for that! Bad photoshopping on Joy's part, but hilarious! Why would the defense even think the prosecutors would want to use that???

They need something to fill up the paper this motion was written on.

At this point I don't think there is any depth that Baez won't sink to - he has proven his character time and time again as per the Florida Bar's objections to him have proven. Baez's character is deeply flawed, he doesn't play by the rules, he arrogantly shows the world his nature every time he opens his mouth. Life is all about choices, isn't it interesting how Casey's choice of lawyer fits so neatly with her own character? To be a good lawyer you must have a good poker face - you can't afford to let anyone know what you are thinking or what your strategy is. Baez like ICA, lets every emotion and every thought flit across his face and the jury will see it all.

It was a pleasure watching Judge Perry today and indeed it was a precursor of things to come.

I think it also showed a total disrespect for his co-counsel:footinmouth: too!

I honestly don't think anyone is going to fault him for showing disrespect for his co-counsel though. I mean at this point, who doesn't :innocent:

What in the world was up with Cheney Mason in today's hearing? The post about Weekend at Bernie's was pretty accurate! He sat in the same position, hand up to his mouth, turned sideways, slouching and didn't move. It appeared to me that at least twice JB turned to him as if to ask for help or get some input from him and he didn't even acknowledge him. It was bizarre to say the least!

I think he will shortly be jumping ship.

I also think that if they have a parent in the jury they are sunk-most of us have had that sickening moment when we realise the child we had with us just a second ago is missing-they've wandered out of sight-you can't breathe properly till they hove back into view then you alternately want to shake them and hug them.
31 days and she didn't tell anyone- never going to be believed!

I think all these experts have already JB a verbal summary of what they are going to say. I think JB instructed them NOT to write reports.

As to the issues that JB talked about at today's hearing, I think he is frantically trying to figure out how many of his experts he can withdraw from the case and still have a semblance of a case left! I doubt he is going to call all of these people, and I would not be surprised to see him file a motion withdrawing a number of them from his witness list.

Of course he did. I know he HAD to have instructed them to not prepare written reports because almost all experts want to prepare one.

How much of Baez's poor skills will the Judge put up with, can he toss JB off the case?

Let's see 1:30pm, after lunch.....Power nap, yep, power nap. I take them all the time.

i just read JJ's reply to the motion for his photos ( just posted in the motions thread) and while the motion itself is interesting, I just love the lawyer's signature. All I could think of is how I used to have to make those 0's over and over when I was first learing how to write cursive. I am sure this comment tattles on my age, but that's ok, I am still grinning at the signature.

It seems there should be nothing to hide.....unless there is nothing.

I missed the whole hearing. I had a filing I had to get out the door. But I appreciate the recap here!

Thanks everyone! Sounds like it was quite a hearing.

I think I just joined The Chief Judge's fan club. I sooo heart that man!

I think he was definitely alluding to some "problems" with getting the reports. I'd be interested to see Baez push Judge Perry a little further. Maybe Baez thinks he is setting Judge Perry up for a fall? Maybe Baez will try to show in the future he was discriminated against by Judge Perry.

In addition, I'm wondering if that's why Mason had his judge friend in court Monday?

Do you think they're fishing for another judge?

IMHO, it's a possibility.

Don't think it would ever work, though. Judge Perry knows the rules!

I think he just wants to play games and conduct a trial by ambush. Apparently, he was criticized by a former client for doing the same thing and it cost his client dearly. As in some evidence wasn't allowed to be admitted. JB doesn't learn from his mistakes.

Mr. Mason was putting on a show for the judge, hoping the judge would infer, the learned, experienced Mr. Mason, is as shocked and disappointed as the judge is. Hello....come in Tokyo....take the lead Mr. Mason, that is what you are on the case to do!!

LEAD!

The fact that he can't or wont is a concern. Does anyone have that clip of Kathi Belich's report from some time ago about mom, pop AND BRAD going to see the criminal defense lawyer, wanting to replace Baez, whom they told they had NO MONEY to pay, but would cut him in on media deals they were working on? Since Mason reads blogs, I must re post that!

This is a man who did not pay child support. That is about as low as one can get.

Graduated from St Thomas Law School in 1998. Was not permitted to practice law for 8 years. The FBBE(Florida Board of Bar Examiniers)and the FSC(Florida Supreme Court)issued an order that outlined his offences:
-unpaid bills
extravagent spending and other financial irresponsibility
(writing bad checks)
-did not pay child support payments on a regular basis and neglected to purchase and pay for his childs’ insurance needs (life/medical)
The FBBE and the FSC said about J.A.B.(Jose Angel Baez)
overall behavior: he shows “a total lack of respect for the rights of others and a total lack of respect for the legal system”.

Did anyone else think when JB was talking about filing more paperwork about the reports, that he is actually going to try and go up against HJBP to get JP order removed or changed when it comes to him having to supply reports from experts to the SA office....I seems to me that JB may be planning on challenging HJBP with some case law or something, I can tell you I would not be surprised if that is what he is going to do, and I would love to see JP throw the contempt and the $500 a day on him...Do you guys think that is what JB was alluding to?

Ohhhh, I sure hope so. That will be a good hearing to watch! :great:

When Judge Perry said the visiting judge was bailing, Cheney said no, he isn't supposed to go yet, as if he had a very specific section he wanted that man to hang around to hear. I laughed myself silly.
He had the nerve to ask another judge to sit in to peer review Judge Perry, as he is very, very excited about his plan to make one to twenty one federal lawsuits stemming from issues he disagrees with in this trial. Indeed the blaze of glory to retire on is very present in his thoughts. He makes reference to it just about every hearing in a sentence he mumbles. The judge knows it does not even warrant a response, so guess what? He doesn't give him one.
They are not pals, imo.

My guess only.
How Cheney behaves in the courtroom is very clear and intentional, it is unbridled hubris, of biblical proportions.

No worries!

In order to offend me, I have to have a regard for your opinion, and I simply do not...is the look on the very unphased Judge Perry's face. Love him!

Please note the updated sticky here in the main forum.

Will be handing out Time Outs for members that engage in namecalling.

Thanks. Looking forward to a productive discussion of the hearing & TIA to those providing commentary to the members unable to watch it live.

Bumping this for newcomers to this thread and a general reminder.

Don't want anyone to get in trouble.

Where this post lands is random.

IMO, Baez is incredibly rude to almost everyone he comes up against. Even in today's hearing, he brought up felony and felonious whenever he got the chance, like anyone has forgotten when he was in court with another motion to get JJ's tape saying no one on the defense had a problem with JJ taping it. He also made a snide comment about JJ trying to get in the way of the defense (forgot his exact words) and I was really glad to see the other attorney stand up and call him on it. It's like he can't get up and plead anything with the court without taking potshots at the court, the State, LE, random civilian witnesses, etc.

IMO, this all goes to their 'victim' strategy, how everyone is out to get their poor, innocent client, which is all well and good pre-trial, but I don't think is going to fly when the actual trial starts. It seems to me if Baez and/or Mason continue in trial to throw out unsubstantiated accusations against any and everyone with the slightest involvement in this case, they might both get contempt and get thrown in a cell.

"thwart" is the word you are looking for.
JB said that Joe J. was trying to "thwart the defense" and then implied that JJ's attorney was also helping to thwart the defense by being at the Hearing today!

and yes ... JB had NO problem whatsoever with JJ's illegal recording of his interview with the Defense investigator when JB wanted a COPY of the recording ... but now that JB wants to get more records from JJ, now JB highlights how JJ committed a "felony" by making the recording. I guess JB was trying to say that the Judge should allow the issuance of a subpoena for JJ, because he is a "felon"??? But JJ was never even charged with the felony.

That shows he's in sync with Casey, two peas in a pod. He put his own needs and financial needs above the needs of others, and... he didn't care about the needs (financial or insurance) of his own child!!!

On behlaf of my good buddies that are Florida tax payers, I am very concerned. The costs the defense is charging the taxpayers for these depos and transcripts is a lot. How one sits down with a searcher and does not ask them if they took any photos or video of their seach is astonishing to me. It would be like going to the Oakridge Lab staff depos and not asking to see their reports.

I am less and less and even more less impressed with Cheney Mason having forty years of experience, every day. What the hell did they ask him?

I'm with you. Totally. Depos are expensive. Hopefully the JAC isn't approving realtime for every depo because that's even more expensive.

And I too wonder what THE HELL they asked if they didn't cover these issues? They obviously aren't preparing well for their depositions. Which is scary because depositions tell you how a deponent is going to testify at trial. And you know the old adage you never ask a question you don't know the answer to at trial. JB and company are going to end up asking a witness a question and they aren't going to expect the answer or like what it will end up being.
