2011.02.04 - Status Hearing

After the hearing, KB followed the defense out into the hallway. From inside the courtroom you could hear CM yelling John Allen! Get these people away from me. So the rest of the audience goes into the hallway to see what the commotion is all about. KB is asking questions of the defense regarding false statements to the court and CM is bumping her post-bunionectomy-shoe walker with his brief case. He calls her an a$$hole and gets on the elevator. She follows him and a deputy comes between them and indicates that she must get off the elevator.
Sgt Allen and another deputy are sitting in the front row behind the prosecution during the hearing. They wouldn't tell KB what they were there for. After the hearing JB and CM come up to them and talk. I think I heard that they promised to get some papers to them. I heard the word polygraph, but I don't know the context nor do I know who said that. The defense left the building without an escort of any kind. Sgt Allen and his co-worker left with the prosecution.

So what in the world is goin' on? Any speculation? Does this maybe need it's own thread?

Watch the interactions between JB and JA, LDB and HHJP and HHJS carefully and note how they have evolved. At the beginning they would challenge JB on the evidence and the material facts of the case, but while they may give him strange looks about some of his claims he was given a fairly long leash. They did not directly challenge the assorted claims coming out of his mouth. They would challenge him on his clients acts and actions. Not really his own. Typical interaction between lawyers.

Compare that with today. I don't think the subject of KC Anthony ever entered the courtroom today. Rather all parties were targeting and zeroing in on everything that came out of JB's mouth. Those Kathy Reich tweets... That was pre-preparation to challenge the lawyer, NOT the defendant. The difference is subtle but HUGE.

I think though that LDB and JA are quite rightly tired of all of the games and brinkmanship. They problably have more than enough on their plate and work to do and these delays and glitches are just creating even more work for them. You can be amused by JB's antics at first but when it starts to bite into your time and ability to do your job it gets very frustrating very quickly.

They just want JB to quit the games, give them what they need and, allow them to complete the depos. How many times do they need to appear in Court to discuss new deadlines for JB?

I did see at one point when HHJP was looking something up on his computer that JA was extremely agitated and making faces with his mouth ... as if he wanted to just end the madness but was trying very hard to restrain himself. LDB looked very strained as well.

HHJP has the patience of a saint and walks JB through stuff but the SAO are at wits end. It isn't strategy ... it is incompetence and sleaze.

In listening to JB, it sounded to me as if he has yet to even talk with any of these people.

I'm sorry, expert witnesses don't get paid if they don't, well, perform, for lack of a better word.
These are professionals. It is beyond ridiculous to entertain that they are just suddenly not returning JB's calls. All of them? At the same time?
Someone here said a while back that all he had were a bunch of big scary names. I agree!!

Agreed ... JB tried to pitch it that these folks are doing it as a favor ... given ICA is indigent at no cost to JAC but ... you just cannot operate that way. If the experts are not returning JB's calls then is he really confident that they are going to be ready and willing to appear at trial?

Or is that JB's strategy ... the experts are a no show at trial and JB claims that it is because ICA is indigent and she cannot afford to pay them ... so she cannot get a fair trial?

Does he have these folks on-board or not?

Maybe next time he asks someone to do a second autopsy he will ask for a report at the time. I'm beginning to think I know more about the rules of discovery than Baez does- I'm sure he told Spitz to hang on to the report thinking that he could just flounce into the trial with it, not giving the SA chance to read it..

Both labs found the same stimulant, MDPV, which is known to cause psychosis, spike heart rate, and trigger heart attacks.

"There have been deaths associated with it," said Dr. Barry Logan, NMS Labs.

BBM I saw that too when I was rewatching it. It has to be exhausting. And whoever said they were worried about LDB (was it JSR maybe?)...I can see why. She did look very tense. Hopefully it's just that she is very over JB. She did kind of look like a mother of a strong willed child round about 7:30 pm. And that is what she is dealing with in JB IMO.

Maybe HHJP needs to call the three expert witnesses, that refuse to answer their phones for JB, and find out for himself.

JB is trying to keep Dr. Spitz's condition as much on the quiet as he can in order to stretch things out for as long as he possibly can. He is claiming there will be a delay now because he is drugged from meds or hospitalized. But what he almost assuredly already knows or has been told (if he has in fact contacted Dr. Spitz's staff or family, assuming they returned his calls) is that given the nature of the injury, and the nature and age of the patient, there is next to no chance that Dr. Spitz will be available for the start of this trial. JB knows that he is going to have to replace him. But he is trying to push that declaration back as far as he can in order to once again delay delay delay.

JB has no care or concern for Dr. Spitz's medical condition, privacy or HiPPA. (heck he probably wouldn't know how to look up HiPPA on the web). Like everything we have seen from JB to date his concerns and claims are self serving to himself and his client, masked with a thin veneer of sleaze.

That veneer is thicker than it appears. It goes all the way to the rotten core.

The irony is rich! KB's station was able to get him on the phone but JB says he doesn't have a receptionist...it always goes to voicemail. Was that from the article on the bath salts?

HAHA!!!! Maybe that's why CM was beating her with his attache. She was telling him she had spoken with Dr. Logan and he had no idea who Jose was and tell him to stop blowing up his voicemail.

And even better! According to the article, WFTV bought the stuff last week, or shortly before and have the results back already AND a quote from the good doctor. There, Jose! put THAT in your pocket square!
