IMO the whole "tainted by the arrest" question is irrelevant here because there was nothing wrong with the arrest for stealing property. There was probable cause for it. The question here is whether that (perfectly proper) arrest was "undone" enough that a reasonable person would have felt they were no longer "in custody" later on when talking to LE.

Would that arrest be considered "undone" if Deputy Eberlin's supervisor, Hosey, said to him, withing ICA's hearing" to take the cuffs off, that this was about a missing child case, and the other issue was not a priority?

If so, did anyone testify that Hosey said that in ICA's earshot? I don't recall it.

STATE: they removed handcuffs and free to go about before YM showed up, for at least 1 hour

Is it usual for one of the parties to the action not to listen at all to the other side's argument? Defense team is so busy with staff, papers, electronic devices, they seem to have moved on to more pressing matters....but what could be more important than preparing to do some damage control of their own case?

The fact that the OCSO removed the handcuffs almost immediately and let her go about her business certainly would send a clear message to any reasonable person that they were not in custody.

This after she cites some killer case law.

Does anyone find it interesting that Jim L. throughout these hearings has been sitting on the prosecutions side of the courtroom and not with the Anthony's? I noticed this last week also.

Yes, for the longest time he sat with CA then he started sitting behind her, now he has migrated to the other side!

Well we all know Joy Wray is an <unusual person>. Isn't she a searcher? And why does she feel it so important to be in the courtroom? Is she on the defense side?

might as well take a break the defense was doing there own darn thing anyway. The defense might as well just go home, they seem to have no interest at all in what's happening in the court room!
